HomeMy WebLinkAbout003 21 74 Special MeetingPLANNING AND ZONING MEETING MINUTES - March 21, 197~ Minutes of a special public hearing meeting of the Planning and Zoning Commission held in the city municipal building March 21, 197~. Present: Chairman Branson, Allen Martin, Del Peters, Jack Menard and Larry Rawlins. Meeting called to order by Jim Branson at 8:00 p.m. PUBLIC HEARING ITHMS: CONDITIONAL USE PERMIT REQUEST: Kent J. Parrish, representing Mobile Manor, Inc. requests a conditional use permit to allow them to construct six four-plexes on lots facing Chubbuck Road which is zoned Residential -2. Mobile Maner Inc. could build duplexes on this property without a conditional use permit. They prefer the fourplexes because of having offstreet parking with no backing onto Chubbuck Road and more lawn area. Dick Anderson questioned off street parking in development. Roy Whitehead also questioned the parking arrangement. Max Parrish informed those present that off street parking lots would be provided in back of fourplexes but the duplex parking would need to back out on Chubbuck Road the same as residential homes on north side of Chubbuck Road. Several residents were present protesting the construction of four-plex units. Max Parrish stated a fence would be installed on the south side of the property. Kent Parrish said they would accept approval of four four-plex units instead of the six requested in the conditional use permit request. Earl Romriell stated he would like to see the Parrishes sell the lots for residential use. Max Parrish told Mr. Romriell they had tried to sell the lots, but would prefer to sell them as a group. Mrs. Verda Moo~stated she would prefer trailers went on the property. After further discussion Del Peters made motion the P & Z Commission recommend the city council grant the conditional use permit for four four-plex units on Lots 3 to ll, Blk l, Mobile Manor Inc., with a five (5) foot chain link fence installed on south property line with no gates and fence to be completed behind each unit as unit is completed. Martin seconded with all four members voting in favor of motion. Larry Rawlins had been excused from meeting earlier. VARIANCE REQUEST FOR PLAC~ENT OF MOBILE HOME IN RESIDENTIAL -2 ZONE - Jerry R. Tydeman, 156 Hiway Avenue, requests this variance to allow the placement of a mobile home on his property so they might care for his ailing grandparents. Mr. Tydeman said he was asking for this temporarily because if either of his grand- parents became ill or passed away the other could not live alone. Mr. Peters read from zoning ordinance where a variance does not allow a change in zoning. Mr. Peters said he felt this was not a true hardship case. Allen Martin stated hardship case means nursing care and continual supervision and by granting this the commission would be breaking ordinance. Dwain Kinghorn stated he felt if Jerry put a trailer house on his acreage it would create a hardship on the neighbors because of decrease in value of surrounding property. Mr. Kinghorn said he plans to develop his property and trailers in area could effect him securing a loan. Allen Martin made motion P & Z commission recommend council deny this variance request. Peters seconded with all commission members present voting in favor of motion. VARIANCE REQUEST TO ALLOW CITIZENS BAND RADIO EQUIPMENT SALES AND SERVICE BUSINESS - M. R. Metcalfe, 226 Adams, requests the above variance in his home which is in a Residential 3 Livestock zone. Chairman Branson read from the zoning ordinance that a business as such would not be allowed as a home occupation. Del Peters informed Mr. Metcalfe that a lot of work and time had gone into these ordinances and the commission feels they should observe what is set up within the ordinance. Page Planning and Zoning Commission Minutes - March 21, 197~ Jack Menard moved the commission recommer~ the city council deny Mr. Metcal£e's variance request. Martin seconded with anunanimous vote in favor of motion. Jack Menard suggested the commission members read the zoning and subdivision ordinances and underline sections they feel need reviewed and have special meeting to review same and better acquaint themselves with requirements.
