Minutes of the regular meeting of the Planning and Zoning Commission held in the
Fire Station Meeting room, ~727 Yellowstone, July 2, 197~.
Present: Chairman James Branson, Commission members Allen Nar~in, Jack Menard,
Del Peters and Larry Rawlins. Ed Reese and Rodney Parrish excused.
Meeting called to order at 8:10 p.m. by Chairman James B. Branson.
Minutes of June 6 meeting approved as read and written.
PUBLIC HEARING ITt~4S: VARIANCE REQUEST - Mr. and Mrs. O. C. Johnson, 535 Bluebird,
Mobile Manor Subdivision, have applied for a variance which will allow them to
retain the following described structure. A step platform about & ft. 6 inches
wide and 20 feet long with steps on each end and not attached to the mobile home
with a ~ foot steel awning over this platform. The steps and awning are within
the seven foot side yard requirement.
R. B. Bistline stated the structure was attractive and moved the Planning and
Zoning Commission grant the variance. Mr. Bistline was informed that motions
were not accepted from the floor. The commission would be required to take
the proper action. Mr. Bistline insisted on a second before Mr. Olson was
allowed to present his remarks. Mr. Ray Blanchard seconded the motion.
William D. Olson, Attorney representing Mr. and Mrs. Francis Seaver, 523 Bluebird,
and Mr. and Mrs. Wayne L. WArd, 529 Bluebird presented a petition in opposition
to the proposed zoning variance of Mr. and Mrs. O. C. Johnson. Mr. Olson stated
the restrictive covenants prohibited this structure and also the structure is
in violation of the city ordinance.
Attorney Olson presented a plot of a typical lot showing the side property
setback to be seven feet. Mr. Shannon verified this information.
Attorney Olson said he thought some names on Mr. and Mrs. Johnson's petition
were not actually the property owners.
Mrs. Johnson stated all the names on their petition are property owners.
Mrs. Clara Brown said she had the same circumstance with her neighbor, Mr.
Housel having a shed closer than the seven foot required and she would like to
see this thing settled once and for all.
Allen Martin moved the commission recommend the city council deny the variance
request because it is within the 7 foot side yard requirement and does not leave
enough room for proper fire protection around the trailer. Larry Rawlins
seconded the motion with an unanimous vote in favor.
Mr. and Mrs. Johnson were informed by Commission member Jack Menard their porcches
and awning could extend only 3 foot into this 7 foot side yard requirement.
REZONINGREQUEST - Kent J. Parrish, Mobile Manor, Inc., requests Lots 1 thru 11,
Block i and Lot i , Block &, Mobile Manor Subdivision be rezoned to Residential
-2 Trailer zone. This area is presently zoned Residential -2.
Mr. Bistline stated these lots should have homes comparable to the ones on the
north side of Chubbuck Road built on them. These lots are covered with dry
grass ~hree feet high and he moved the motion be tabled until this fire hazard
is taken care of.
Chairman Branson informed those present the fire hazard was a responsibility of
the city. The Planning and Zoning Commission's responsibility is to take action
on this rezoning request.
Mr. and Mrs. Blanchard said they would approve rezoning if the lots were sold
and home owners placed the double wide mobile homes on the lots.
Mrs. Brown said they would approve of the double wide homes if they would have
the same restrictive covenants as the present Mobile Manor Subdivision.

After further discussion Commission member Rawlins moved the Planning and Zoning
Commission recommend the city council approve rezoning the lots requested in
Mobile Manor Subdivision to Residential -2 Trailer zonet with the provision the
restrictive covenants be the same as all of Mobile Manor Subdivision and be
restricted to double wide mobile homes only. Del Peters seconded with an un-
animous vote in favor of motion.
Mr. Bistline asked if he would need to appear before city council to get some
action on the hazard of dry weeds on the lots along Chubbuck Rd. Mr. Menard
told him he could contact the city office with his complaint.
VARIANCE REQUEST - Garland Henry ~929 Yellowstone, has petitioned the Planning and
Zoning Commission for a variance to permit him to reside within his mobLle home
at its present location of &929 Yellowstone. This being in a Commercial - 3 zone.,~
Mr. Menard ~ asked what other variance mentioned in his petition had been
granted. Mr. Henry said he thought it was the Carefree Mobile Sales. Mr. Menard
informed Mr. Henry this was for business use only and not for living quarters.
Mr. Menard moved this request be tabled until the city can get some legal advice
on a few matters. Allen Martin seconded with all commission members voting in
favor of motion.
Mr. Menard told Mr. Henry they would take care of this co council could take
action on the matter July 9th.
LAND INVESTMENTS, INC. - Kent J. Parrish presented a revised preliminary plat
for Mobile Manor First Addition. This plat includes the area which has been
rezoned Residential - 2 Trailer zone. Commission w~ll review this for any
recommendations.
Commission member Menard suggest the commission amend various items in the
zoning ordinance, e.g., frontage on culdesac lots and allowance for front step
within the front yard setback.
