Minutes of the Planning and Zoning Commission meeting held in the city
municipal building August l, 197&.
Present: Chairman James Branson, Commission members, Jack Menard, Del Peters
and Rodney Parrish.
Meeting called to order by Chairman Branson at 8:25 p.m.
Minutes of July 2, 9, and 23 meetings approved as written with Chairman Brauson
requestingthe phrase" enforcement of the removal of" fire hazard was a responsibility of
the city being added into minutes of July 2, 197&.
PUBLIC HEARING ITEM: Mr. and Mrs. William Sparks, 228 Burley Drive, request
a variance of zoning to allow them to place a mobile home on their lot which
adjoins their property at 228 Burley Drive. Mr. Sparks told the commission
their daughter married recently and they would like to allow them to Place a
trailer on the property for living quarters.
Commission discussed the request. Rodney Parrish said he felt this should
not have been rezoned from Residential 2 Trailer to Residential Livestock
approximately one year ago.
Commission member Menard moved the commission recommend the council allow Mr.
and Mrs. Sparks to set trailer on lot for one year as a hardship case for
his daughter and son-in-law Bill and Cindy Knight to live in.
TRAIL~ REQUEST - Ken Thomas was present and requested permission to place his
trailer on Mrs. Markers property along Mingo Lane. Commission informed Mr.
Thomas that Mrs. Marker would need to make the request for the variance to
place a trailer on property as she is the property owner.
GARAGE BUILDING - Dale Hall, 238 Henry desires to build a garage on the
back of his property approximately seven feet from the rear lot line. He
doesn't have enough side footage to build along side of his home. Commission
determined from ordinance that no buildings are allowed in the required twenty
foot rear yard setback. Commission informed Mr. Hall he would be required
to request a variance before any action could be taken to vary from zoning
ordinance.
MOBILE MANOR ADDITION#i - Commission discussed and reviewed the pre-application
plat presented to council by Kent Parrish, president of Land Investment, Inc.
This is in a Residential - 2 Trailer zone and will be a residential trailer
subdivision.
After studying recommendations made by the city engineer and discussing
the plat as submitted Del Peters made motion the commission recommend
council approve pre-application plat with followirgexceptions$ Lot 7
Blk 5 be revised to meet the frontage requirement of 60 foot,-and also Lot
i Block 7 be made available for future estension of Whitaker Rd. Menard
seconded motion with Peters and Menard voting yes and Parrish abstaining
from voting.
PERFORMANCE BOND - Chairman James Branson recommended the city require
subdividers furnish a performance bond according to cost of installation.
Rodney Parrish stated the problem now is when developers request an inspection
on streets, etc., from the city employees the subdivider doesn't get any
answer back on their inspections.
KIND~GARTEN REQUEST - Commission reviewed a letter from Delores Pitman,
&6&O Teton Drive requesting permission to operate a kindergarten in her home.
The commission discussed Mrs. Pitmans request and determined ~'he would need
to make a formal request for variance which wi.l] be acted upon at September
meetings of P & Z and Council.

Rodney PaRRISH asked if Bart Parrish could ~uild storage sheds on east
property line of their industrial land on East Chubbuck Road. Councilman
Menard told him he would discUss this with the council at the next meeting.
