October 6, 1977
Minutes of the regular Planning and Zoning meeting held in the
city municipal b~ilding, October 6, 1977.
Meetiug c~lled to order at 8:00 p.m.
P~esent: Acting Chairman Dell Peters, Commission members Dwain
Kinghorn, Dee Stalder, Clifford Payne and JimChatterton.
Minutes of the meeting held September 1, 1977 were read.

PUBLIC HEARING ITEM: Donnell and Michele Davies, 257 Henry Street,
requests a variance from zoning to si1 ow them a two foot side yard.
A discrepency of property line has been determined since their garage
was built. The property is presently zoned Combined Residential (R-2).
Bruce Bistline, Attorney, representing Michele and Donnell Davies,
presented a drawing of the property line and the garage in the
variance request. He said that the Davies and Hunters had agreed on
a property line before the fence had been built. He later built the
garage with the proper side yard and it had complied with the city
ordinances. Mr. Hunter had notified the Davies this spring that
he had had his property surveyed and that the fence was on his property.
Mr. Davies said that he had his property surveyed at this time and
found the fence was on Mr. Hunterts property. He said that Mr. Hunter
offered to sell him the property but the price was to high for the
amount of ground involved. He said he has removed the fence.
Acting Chairman Peters asked how long the property had been owned by the
Davies. Mr. Davies said since 1972.
Mr. Hunter was asked if he had agreed with the Davies as to the property
line before the fence was built. He said that he had. He said he had
no objection to the garage.
Commission Member Dwain Kinghorn asked if the driveway was on the
Hunter,s property. Mr. Davies said that it was and that a contractor had
been contacted to remove it as soon as his schedule would permit.
Mr. Peters said he felt circumstances of property line was no fault of
Mr. Hunter andMr. Davies.
Dwain Kinghornmade the motion to allow Donnell and Michel Davies, 257 Henry
Steer, a variance from zoning to sllow them a two foot side yard between
their garage and property line, with the stipulation that the driveway
encroaching on the Hunter property be removed within a forty five day
period. Jim Chatterton seconded the motion. Voting was unanimous.
Dwain Kinghorn discussed with the commission members several items
that were before the City Council.
Meeting adjourned at 8:50 p.m.
