Minutes of the regular Planning and zoning commission meeting held May 5, 1977.
Present: Chairman Jack Menard, Commission members Dwain Kinghorn, Dee Stalder,
Dick Anderson, Clifford Payne, Council member Wayne Taylor and Attorney
Don Burnett. Del Peters and Dorothy Ward excused.
Minutes of April 14 meeting were read. Chairman Menard asked for any corrections
or additions. There being none, Commission member Kinghorn moved to approve
minutes of April 14 as w~itten. Motion seconded by Clifford Payne with an
unanimous vote in favor.
PUBLIC HEARING ITEM: Melvin A. Christensen is requesting a variance of zoning
to allow the placement of a mobile home on his property at 241W. Linden.
The request is being made to allow his elderly mother the privacy and
priviledge of her own home. Property is in a multiple-family residential-
livestock (R-4L) zone.
Melvin Christensen stated his mother is 88 years old and she would love to
have a place of her own. Mr. Christensen says she needs this convenience
afforded her. Mr. Christensen informed commission that he plans to tear
down the older home at 241W. Linden.
Commission member Kinghorn told Mr. Christensen that variances should be
granted only on hardship cases and would be granted for a period of one
year only at a time. That he would need to hook the trailer up to city
sewer andwater. Mr. Christensen informed commission there is a separate
water and sewer service to the lot he plans to place the trailer on.
Mr. Kinghorn told Mr. Christensen the citywould like a time limit set on
tearing the old building down. Mr. Christensen said he felt he could have
the building torn down in three months.
Commission member Kinghorn made a motion to allow Mr. Christensen to place
a mobile home at 241 West Linden for his mother to live in, variance to
be granted for a one year period. Commission member Dick Anderson seconded
motion and voting was unanimous in favor.
Chairman Menard told Mr. Christensen he would be receiving a letter from
the city granting the variance.
LAND DEVELOPMENT CONTROL ORDINANCE - Attorney Don Burnett reviewed the changes
in the new land development control ordinance. Attorney Burnett explained
the review procedures of the new ordinance and asked how the commission feel
about their role set forth in the new ordinance. Also, how do they feel as
to their responsibility of looking at subdivision preliminary plats and not
having full approval authority.
Chairman Menard told Attorney Burnett that he felt serving on the planning
commission is a community service to take the load off the council and he felt
satisfaction in doing so. Commission member Dick Anderson said that if the
commissions review of plats helped the council he would like to have the
commission continue to do so.
Dan Maybe, Bannock County planner attended the latter part of meeting and
reviewed the new proposed land use control ordinance with commission and
Attorney Burnett.
Councilman Wayne Taylor said he liked the subdivision review procedure as
it is now being handled.
Dick Anderson moved to adjourn at 10:00 p.m., Clifford Payne seconded with
the approval of all commission members.
