HomeMy WebLinkAbout006 02 77PLANNING AND ZONING COMMISSION MINUTES June 2, 1977 Minutes of the regular ~lanning'and Zoning Commission meeting held June 2, 1977. Present: Chairman Jack Menard, Commission Members Dwain Kinghorn, Del Peters, Clifford Payne and Jim Chatterton. Dee Stalder joined the meeting later in the evening. Larry Rawlins was excused. Meeting called to order at 8:00 p.m by Chairman Jack Menard. Minutes of the meeting held May 5, 1977 were read. Chairman Menard asked if there Was any corrections or additions. There being none, Commission member Del Peters made a motion minutes be accepted as read. Jim Chatterton seconded the motion. Voting was unanimous in favor. PUBLIC HEARING ITEM: A1 and Arlene Pierce, 4806 Hawthorne Road, has requested a variance from zoning regulations to allow them to keep and maintain the fence they have just installed. The property is presently zoned Combined Residential-Livestock (R-2L). A1 Pierce said that they had replaced a 4½ foot board fence with a grape stake fence that graduates from 4 foot to 6 foot. Mr. Pierce stated that they had driven through the driveway of the four-plex units and that the view was not impaired. He said they had replaced the fence for privacy. Commission Members Del Peters and Jim Chatterton noted that it was an attractive fence and they felt the Pierce's had intended it to be an addition to their property. Commission Member Del Peters made the motion that Al and Arlene Pierce, 4806 Hawthorne, be granted a variance from zoning regulations to keep and maintain fence they have installed. Jim Chatterton seconded the motion. Voting was unanimous in favor. PUBLIC HEARING ITEM: Terry Lee Gardner, 324 Henry, has requested a variance from zoning regulations to allow him to place a building within two feet of his property line. The property is presently zoned Combined Residential (R-2). Terry Gardner said that he would like to place the building in the right rear corner of his yard so that he could maintain a nice yard and a garden. He said that he had a 6 foot board fence around his back yard and the building would be approximately 6 foot with a peaked roof. Commission Member Dwain Kinghorn asked Mr. Gardner what the building would be used for. Mr. Gardner said that it would be used for garden supplies and for storing yard equipment. Commission Member Del Peters asked if it would be placed on a permanent foundation. Mr. Gardner said that it would be and be approximately 100 square feet in size. Commission Member Jim Chatterton made the motion to grant the variance request of Terry Lee Gardner, 324 Henry, to allow him to place a building within two feet of his property line; if constructed of siding to be kept painted and if metal to be maiO~ained to the standard of rest of property. Clifford Payne seconded the motion. The voting was unanimous in favor. John Alder, City Engineer, told commission members on granting these two variances that if our ordinances are not reasonable they should be amended. CHUBBUCK LAND DEVELOPMENT CONTROL ORDINANCE: Chairman Menard read from ordinance and discussed with Engineer Alder and Commission Members areas he felt should be changed. A joint meeting with the City Council and Zoning Commission was scheduled for June 7, 1977 at 8:00 p.m. to further discuss ordinance.
