MINUTES
JULY 7, 1977
Minutes of the regular planning and zoning commission meeting held in the
city municipal building July 7, 1977.
Present: Chairman Jack Menard, Commission members Jim Chatterton, Dwain Kinghorn,
Clifford Payne, Del Peters, Larry Rawlins and Dee Stalder and city engineer
John Alder.
Meeting called to order at 8:00 p.m. by Chairman Menard.
Chairman Menard asked for minutes of ~2 meeting to be read and then asked
for any additions or corrections. There being none, Larry Rawlins moved to
approve minutes as written. Clifford Payne seconded motion with all
commission members voting in favor.
PUBLIC HEARING ITEM #1 - Belva Adolphson, Route 2 North, Box 17, Pocatello,
has requested a variance from zoning regulations to allow the placement
of mobile homes on the lot west of 5423 Yellowstone and between 5411 Yellowstone
and 127 Briscoe Road. Property is presently zoned General Commercial (C-3). and
owned by Belva Adolphson.
Elaine Phillips, 127 Briscoe Road Stated she could not see where there is
room for two trailers in the area. She also said she understood the trailers
would be rentals. There are problems now with rental units not taking care
of garbage and yards. Mrs. Phillips said she also was speaking for Mr. and.
Leo Shamburg, Mr. and Mrs. Donald Gould, Mr. and Mrs. C. W. Clinkenbeard,
Mr. and Mrs. William Armstrong, Pablo Hernandez and daughter Lupe, Mr. and
Mrs. Don Mitchell and Verl Miles. Parties listed above were present and
agreed with Mrs. Phillip's statement.
Engineer John Alder showed the planning and zoning commission members the
exact footage and shapes of lots available for trailers in area on a scaled
map together with the placement of the proposed roadway and sewer easements.
Mr. and Mrs. Phillips said they would like a fence built between their property
and the rental property if a trailer is allowed on the lot.
Mrs. Adolphson said she understood council would look upon her request to
place trailers in the area favorably if she allowed closing of street from
Yellowstone and granted easements for street. Mrs. Adolphson said she would
put nice three bedroom trailers on lots and plant grass and improve the lots.
Commission member Kinghorn said Mrs. Adolphson's request for trailers in area
should be reasonable, however, that the council felt mobile homes would be
the best temporary use on this commercial property.
Chairman Menard reminded commission members that in the past the commission
had made allowances for hardship cases only and for parties making requests
that planned to live in the mobile homes. No variances have been allowed
otherwise that he recalls.
Chairman Menard read definition of mobile home park in zoning ordinance, which
reads; any area, tract, plot, or site of land, whereupon two or more mobile
homes are placed, located and maintained for dwelling purposes on a permanent
or semi- permanent basis and for which a fee, rental or contract for payment
for such use is collected by or collectable to the person holding the land.
Commission member Jim Chatterton said regulation to zoning should be
considered, that the P & Z commission turned down the Hernandez request, they
then appealed to council and by the approval of the city council, he felt a
can of worms had been opened.

PUBLIC HEARING ITEM #1 - cont'd - Commission member Jim Chatterton moved the
variance request to place mobile homes on Mrs. Ad~phso'n~$ proper~y which lies
west] of Yellowstone be denied. Commission member Dee Stalder seconded
motion. Commission members Chatterton, Payne, Peters and Stalder voted yes,
members Kinghorn and Rawlins voted no and Chairman Menard abstained from
voting.
Chairman Menard told Mrs. Adolphson she would be sent notice of denial and
she had the right to appeal the P & Z commission's decision. She could
inquire of requirements regarding appeal from the city clerk.
PUBLIC HEARING ITEM #2 - Mrs. Margaret Ohlin, 4855 Joy, has requested a
variance from zoning to keep their present animals on their property.
Property is presently zoned Combined Residential (R-2).
Mrs. Ohlin said their boy, age 17, is very attached to these animals and
it is very important to their son and them, as parents, at this time, to
be allowed to keep the ducks and rabbits. She informed commission they
have 6 pigeons, 12 rabbits, 16 ducks and 2 geese.
Rex Merrit, 4845 Joy, opposed the Ohlin's request of keeping the animals,
saying they are a nuisance and a health hazard, that he had put up with
the animals for one and one half years and he don't care to put up with them
any longer, they had been in his yard, ate his garden, left manure in yard
and the animals smell bad.
Mrs. Ohlin said they plan to install a six foot fence in back yard, that
several of theJr neighbors have enjoyed the animals. Mrs. Ohlin added that
Mr. Merritt's dog was in her yard often.
Commission member Kinghorn told commission he would like to abstain from
taking part in motion because of Mrs. Ohlin and himself being co-employees
at Kraft Food.
Commission member Larry Rawlins asked Mrs. Ohlin if she would reduce the
number of animals. She said, yes, they would reduce the number of animals.
Mr. Rawlins asked Mr. Merritt if he would object to a lesser number of
animals and Mr. Merri~a~ would still object.
Commission member Chatterton said he felt it was a matter of regulation and
Mr. Merritt had the right to object.
When questioned by Commission member Del Peters as to reducing the number
of animals, Mrs. Ohlin said whe would cut down the number of animals
to four ducks and four rabbits. She would get rid of the pigeons, geese
and fave the fence installed by fall.
Commission Del Peters moved to grant variance according to Mrs. Ohlins agreement
to reJu~tion of animals to four ducks and four rabbits within a period of
thirty days as stated by Mrs. Ohlin. That the variance be reviewed in one year
and if a larger number of animals are kept on their property at anY time the
variance will be void, and further that a six foot fence be installed between
Mr. Merritt's property and the Ohlin's property by fall. Commission member
Larry Rawlins seconded motion. Commission members Chatterton, Rawlins, Peters,
and Stalder voted yes, Commission members Kinghorn, Payne and Menard abstained
from voting.

Dan Maybe, employed now as the land use pl.anner for the Fort Hall Indian
Agency was present and told commission members if the city needs any further
help on the comprehensive plan he would be glad to help on his own time.
Chairman Menard told commission members the Comprehensive Plan and maps
are nearly ready and he would like to meet with commission to review. Meeting
was set for July 21st at 7:00 p.m.
Jim Chatterton asked to be excused from the August 4th regular meeting.
Commission member Payne moved, Stalder seconded that meeting be adjourned,
with full approval of commission.
