HomeMy WebLinkAbout001 06 77PLANNING AND ZONING MINUTES January 6, 1977 Minutes of the regular meeting of the Planning and Zoning Commission held in the city municipal building January 6, 1977. Present: Chairman Jack Menard, Commission Members Del Peters, Jim Chatterton, Dick Anderson, Dwain Kinghorn, Dee Stalder and Clifford Payne. Larry Rawlins was excused. Meeting called to order at 8:05 p.m. Minutes of meeting held December 2, 1976 read with the following correction - Zone for Impounded Cars - Rezoning would be considered. Commission Member Peters made motion to accept minutes as corrected. Dee Stalder seconded the motion. The voting was unanimous. PUBLIC HEARING ITEM: John L. Holman and Brent R. Clark have made application for a conditional use permit to construct a three bedroom 4-Plex at 5272 Lucky. The property is presently zone Mobile Home Residential (R-2T). Mr. Holman said they had purchased the property with the understanding they could build a 4-Plex. After having the money committed to build they found the property was zoned R-2T. Mrs. Gladys Rippe, 5242 Lucky, said they were opposed to an additional 4-Plex in the area. She said that children would be over running their place. They felt that it was to much density on such a short street. Mr. George Wainscott, 5282 Lucky, also expressed disaproval. He said they were already having parking problems. Mrs. Rippe said that other neighbors disaproved but were unable to attend the meeting. Chairman Menard asked Mr. Holman if they had checked into the availability of the sewer. Mr. Holman said they had been told by Mr. Belangee that it was at least 15' deep. Mr. Menard checked the as built plans ~ and it was determined that the sewer was only about 7' deep; and would not be deep enough to serve the 4-Plex in the area planned. Mr. Holman said that they might have to move the trailer house and build the 4-Plex on this lot. Commission Member Chatterton expressed sympathy for Mr. Holman and Mr. Clark for the investment they had made but said he also felt the people's wishes in the neighborhood should be considered. Commission Member Clifford Payne made a motion to recommend to the City Council that this conditional use permit not be acceptable as presented. Dick Anderson seconded the motion. Jim Chatterton - yes, Clifford Payne - yes, Dee Stalder - yes, 'Dick Anderson - yes. Del Peters and Dwain Kinghorn abstained from voting. OTHER BUSINESS:Don Marchant of Forsgren, Perkins and AssoCiates, presented the pre-liminary plat for the Dixon-Manning Subdivision. Chairman Menard said that this subdivision lies within the one mile limit of Pocatello and as they are the larger city they will have jurisdiction. The only involvement that Chubbuck will have is their request to hook-up to the city's sewer. Pa~e Two OTHER BUSINESS: Barbara Kinghorn, Realtor, stated that Merlin Phillips had requested her to list his property at 127 Briscoe for sale. She requested a clarification of the zoning. It was determined that the Phillips property would be in General Commercial (C-3). ~--R~'Lacy said that he had purchased ten acres of property from Lester Selders and was in the process of purchasing five acres adjacent to it. He said that he and Dennis Leslie would like to see a road extend to Joy Street. He asked if the Commission would work with them to contact the School District and see if something could not be worked out. He said that he understood Mr. Leslie would trade some property with the School District. He said that he liked to develop planned areas and would like to see Canal Street be opened from his property into the Heights Subdivision. Chairman Menard reported that Bannock County had turned down the Bar X Tract Subdivision. Chairman Menard asked Mr. Kinghorn to report on the City Council determination of the Aztec Park Subdivision. Several members stated they had'~b~en ~ contacted by Mrs. Johnson and Mr. Henscheid and that they reported '_' ' Mr. Seaton had not been in contact with them. The Commission Members were concerned about the 6½' in question and felt the original decision should be upheld. A discussion followed on the Area of Impact. Chairman Menard said there would be a joint meeting with the County Planning and Zoning on February 23, 1977. Commission Member Jim Chatterton made a motion that on February 3, 1977 a Public Hearing be held for citizen imput on the Area Impact. Dee Stalder seconded the motion. Voting was unanimous.
