February 3, 1977
Minutes of the regular meeting of the Planning and Zoning Commission
held in the city municipal building February 3, 1977.
Present: Chairman Jack J. Menard, Commission Members Del Peters,
Clifford Payne, Dee Stalder and Dwain Kinghorn. Members Larry Rawlins,
Jim Chatterton and Dick Anderson were excused.
Meeting called to order at 8:00 p.m.
Minutes of meeting held January 6, 1977 were read. Commission Member
Clifford Payne made motion to accept minutes as read. Dee Stalder
seconded the motion. The voting was unanimous.
LACEY PARK SUBDIVISION: Mr. Roy Lacey presented the preliminary plat
of Lacey Park.
A discussion followed on the possibility of opening up Joy Street to
relieve some of the traffic from Hawthorne Road. Mr. Lacey said that
he and Dennis Leslie would like to work with the School District
and exchange some property so this could be accomplished. He once
more asked the City's help in contacting the School District. He said
if Joy Steeet could not be opened he and Dennis Leslie would put a
street in between their property.
Commission Member Dee Stalder made a motion to recommend to the City
Council the Lacey Park Subdivision preliminary plat be accepted. Clifford
Payne seconded the motion. The voting was unanimous.
PUBLIC HEARING: Peter W. Schell has requested a variance from zoning
regulations to allow the operation of a small home-planning and
drafting business called "Spectrum Drafting" on residential property
which he is purchasing at 365 Stuart. The property is located in an
area zoned Combined Residential (R-2).
Mr. Schell was present and said that the business would only attract
a very few customers each week. He said that they would like to have
a small sign but that it was not a necessity.
Mr. Halvord Green, 197 Stuart, was present and said that the restrictive
covenants did not permit businesses in the Stuart I Addition. Chairman
Menard reminded Mr. Green that the city does not enforce restrictive
covenants that it is up to the people involved to do so. Mr. Menard
told Mr. Schell that according to ordinance only a two foot square sign
would be allowed.
Commission Member Del Peters made a motion the variance request be granted
for a period of one year for Mr. Schell to operate a drafting business
at 365 Stuart. If traffic or other problems arise the variance will
be cancelled. Commission Member Dwain Kinghorn seconded the motion.
Kinghorn - yes; Stalder - yes; Peters - yes; Menard - yes and Payne -no.
PUBLIC HEARING ITEM: Pursuant to Section 67-6526, Idaho Code, a
proposed area of city impact will be examined. The proposed area, is
within the city's trade area, is geographically adjacent to the city,
has topographic features that influence the direction of city
development, and is an area that would be expected to be annexed to
the city within a reasonable time.

Chairman Menard reviewed the Area Impact with those present. Mr.
Glen Marshall asked how the impact area was determined and about the
zoning of the impact area. Mr. Menard said that it was a combination
of developed subdivisions and those in the planning stages. He said
that it will be up to the county to enforce the city ordinances in the
impact areas.
Commission Member Dee Stalder made a motion the City Impact Area as
described in public hearing of February 3, 1977 be carried for
negotiation to joint Bannock County Planning and Zoning and Chubbuck
Planning and Zoning meeting to be held February 23, 1977. Del Peters
seconded the motion. The voting was unanimous.
RE-VISED BUNCE SUBDIVISION: John Alder, Engineer for Bunce Subdivision,
requested the city exchange the park area in Phase II of the Bunce
Subdivision for a 4.4 acre park south of the Chatterton and Mountlake
Subdivisions.
A discussion followed on the location of the park.
Commission Member Del Peters made motion to recommend to the city council
the preliminary plat of Bunce Subdivision Phase III be accepted. Clifford
Payne seconded the motion. The voting was unanimous.
A discussion followed on By-Laws for the Chubbuck Planning and Zoning
Commission.
Meeting adjourned at 9:45 p.m.
