MINUTES
December 1, 1977
Minutes of the regular PLanning and Zoning Commission meeting held in the
citY municipal building, December 1, 1977.
Meeting called to order at 8:04 p.m.
Present: Acting Chairman Dell Peters, Commission members Dwain Kinghorn,
Jim Chatterton, Clifford Payne, Dee Stalder and City Engineer John
Alder. Larry Rawlins was excused.
Minutes of the meeting held October 6, 1977 were read. Mr. Peters asked for
corrections or additions to the minutes. There being none the minutes were
approved as written.
PUBLIC HEARING: Irene Hall has requested a variance from zoning regulations
to allow the placement of a mobile home on property located at 426 East
Chubbuck Road, in Chubbuck. Request states mobile home will be demobilized
and placed on a foundation. The property is situated in area zoned Combined
Residential-Livestock (R-2L).
Irene Hall said that her present home was small and old and that she would
like to place a mobile home on the front of her property. A drawing was
shown to see how the mobile home would be located on her property. She said
the present home would be retained and rented.
Commission member Kinghorn expressed'~concern if the mobile home would fit into
the rest of the neighborhood. Dean Morgan said the immediate neighborhood
consisted of brick homes.

· 1TDy granting a variance to Ms. Hall the zoning
laws would be broken down and other people with vacant land would be asking
to place mobile homes on permanent foundations. She said that when Mobile
Manor had been approved they had been assured it would be an attractive
development and she felt it had fallen short of being the development they
had expected.
Dwain Kinghorn said that the commission had had numerous request to place
mobile homes in residential areas and that the majority of them had been denied.
Mr. K.C. Gibbs said in his opinion it was not a mobile home after it had been
placed on a foundation. Jim Chatterton explained to Mr. Gibbs if it were not
a mobile home than a variance would not be required. Mr. Klane Forsgren, 4801
Whitaker Road, explained to the commission members the building code difference
between mobile homes and pre-fab homes.
Commission members expressed a desire to go and see the mobile home in
question. Mr. Gibbs said he would need an answer at this meeting on the
variance request.
~ommission Member Dee Stalder made a motion to deny the variance request of
Irene Hall, 426 E. Chubbuck Road, to allow the placement of a mobile home on
a permanent foundation. The property is situated in area zoned Combined
Residential-Livestock (R-2L).
Clifford Payne seconded the motion. The voting was unanimous.

OTHER BUSINESS: Steve Smart, Forsgren, Perkins and Associates, presented
the preliminary plat for the Planned Communites Subdivision, to be located
adjacent to Alturas Park Subdivision, on West Chubbuck Road.
Acting Chairman Peters said after studying the plat he Would be against
zoning a commercial area in this neighborhood. He said a hearing had been
held on a similar idea in the Neider Addition and that the people had
objected to it and the commission had abided with the wishes of the
neighborhood. He said that a commercial area had been requested in the
400 Block of West Chubbuck Road and it had been denied.
A discussion followed on the merits of neighborhood commercial areas in
high density residential areas. Mr. Smart said that his clients felt
neighborhood commercial tended to keep people in their own neighborhoods
rather than moving about on city streets.
Mr. Peters said he understood the county will prohibit any residential building
west of Philbin Road under their land use plan. He said he would question
if neighborhood commercial would be profitabJe~ the developers.
Mr. Smart said they were requesting three zones, Neighborhood Commercial, C-1,
Multiple - family Residential, R-4, and Combined Residentail, R-2. The
Multiple-family Residential, R-4, would be a buffer zone between the other
two zones.
A discussion followed on the park area. The Commission Members expressed
approval of the preliminary plat except for the Commercial zone.
Commission Member Jim Chatterton made a motion to recommend approval of
the preliminary plat of the Planned Communities Subdivision to the City
Council, with the recommendations of John Alder, City Engineer. Clifford
Payne seconded the motion. Chatterton, yes, Payne, yes, Kinghorn, no,
Stalder, no and Peters, no.
Acting Chairman Peters opened the meeting for nomination for a chairman
of the Commission. Jim Chatterton placed Dee Stalder's name in nomination.
Cliffor Payne made motion to close nomination. Voting was unanimous in
favor of Mr. Stalder.
Meeting adjourned at 9:55 p.m.
