April 14, 1977
Minutes of the regular meeting of the Planning and Zoning Commission
held in the city municipal building April 14, 1977.
Present: Acting Chairman Del Peters, Commission Members Dwain Kinghorn,
Dee Stalder, Larry Rawlins, Dick Anderson, Jim Chatterton and Clifford
Payne. Chairman Jack Menard was excused.
Meeting called to order at 8:00 p.m.
Minutes of the meeting held March 3, 1977 were read and approved as
written.
PUBLIC HEARING ITEM: Pablo Hernandez has requested a variance from
zoning regulations to allow the placement of a mobile home on property
located at 5411 Yellowstone Avenue. The property is situated in area
zoned General Commercial (C-3).
Lupe Hernandez said the house is old and not worth repairing, that they
could not afford to build a new home; but could buy a mobile home.
Chairman Del Peters reminded the Hernandez that this property is located
in a General Commercial Zone. Elaine Phillips, 127 Briscoe, said they
were in favor of the variance, that the Hernandez family had been good
neighbors. Mr. John Merzlock, representing Mrs. Belva Adolphson, stated
they objected to the variance being granted, for a mobile home. He said
they had asked for building permits to develop duplexes in the same
general area on property that they owned and they had been denied the
permits until an orderly growth pattern was developed. He said they had
their property surveyed but a building permit was still denied until
the road was brought up to city standards. If and when the city accepts
Mrs. Adolphson's development, they would have no objection. Mrs. Clarice
Clinkenbeard, 5409 Yellowstone, said they had no objection to the old
house being replaced with a mobile home. She said their yards are
adjoining and the Hernandez family were good neighbors. She said the
road going into this development was part of her driveway. Mr. Merzlock
said he would like to see an L.I.D. created to have a chip and seal
road installed. Mrs. Phillips asked what the objection to mobile homes
was? Chairman Peters reiterated the property is zoned General Commercial
and residential living purposes should be discouraged.
Commission Member Dwain Kinghorn stated the cOmmission has to look at
this variance request as it affects the entire city. He said the sewer
was installed in this area at the insistance of the city council and that
the city would like to see a road developed according to city standards.
Commission Member Clifford Payne made a motion that the variance request of
Pablo Hernandez, to allow the placement of a mobile home for residential
purposes, at 5411 Yellowstone Avenue be denied. Larry Rawlins seconded the
motion. Kinghorn, yes; Stalder, yes; Anderson, yes; PaYne, yes; Peters, yes;
Rawlins, yes; Chatterton, no. Chairman Peters told Mr. Hernandez he
could appeal the decision to the City Council.
PUBLIC HEARING ITEM: JOhn L. Holman, on behalf of C & H Investments, of
Pocatello, Idaho, has requested a conditional use permit to construct a
four-plex residential unit at 5262 Lucky. A trailer on the premises would
be re-located on the same premises. The property is situated in an area
zoned Mobile Home Residentail (R-2T).
Mr. Holman said they had purchased the property with the understanding
they could build additional four plexes.

Mrs. Gladys Rippe, 5242 Lucky, said they objected to another four-Plex
in this area. Mr. Rippe said that if the trailer was allowed to be re-
located at the back of the property they should be able to do the same.
Mr. Kinghorn said that if they met the requirements they could do so.
George Wainscott, 5282 Lucky, said they would like to see the conditional
use denied. He Said that traffic is already heavy on this street and
this would add to the density. Rex Christensen, 5201 Lucky; Dartell Beebe,
5202 Lucky and Malinda Harris, 5281 Lucky all voiced concern as to the
additional traffic that would be on Lucky Street.
Chairman Peters asked Mr. Holman if they had any concrete engineering for
the sewer if they moved the trailer. He said they had no'study; but fett.
with a trailer there would be adequate drop.
Commission Member Dwain Kinghorn said that due to the undeveloped property
lying between Lucky Street and Yellowstone Avenue there would be considerable
building going on in the area.
Commission Member Jim Chatterton made a motion that the request of John L.
Holman, on behalf of C & H Investments, for a conditional use permit to
construct a four-plex residential unit at 5262 Lucky and to relocate
the trailer house on the same property be denied. Dick Anderson seconded the
motion. Roll call vote: .~ Chatterton, yes; Anderson, yes, Stalder,
yes; Peters, yes; Payne, no; Rawlins, no; Kinghorn, no. Chairman Peters
informed Mr. Holman he had the right to appeal the decision to the City
CounCil.
PUBLIC HEARING ITEM: Kent J. Parrish, in his capacity as President of
Land Investments, INc., has requested that the following property (a)
be re-zoned Neighborhood Commercial (C-1), or (b) be re-zoned or granted
a variance, as appropriate, for placement of mobile homes: That property
located east of Hiline Road between East Chubbuck Road and Interstate
15W to a depth of approximately 300 feet, all located in Section 11,
Township 6 South, Range 34 E.B.M., in the City of Chubbuck, Bannock County,
Idaho. The property is situated in an area zoned Agricultural-Transitional
(A-T).
Commission Member Larry Rawlins asked Mr. Parrish what plans they had
for the canal if they developed this area and how~the widening of Hiline
Road would affect the development. Max Parrish said they planned to
culvert the canal when it would be necessary.
Doyle Chatterton, 739 E. Chubbuck Road, asked what plans Mr. Parrish
had for Hiline Road if it was re-zoned Neighborhood Commercial. Rob Weaver,
owner of adjacent property, asked what type of development was planned. Kent
and Max Parrish said they would like to have Neighborhood Commercial as
they felt that Hiline Road would be a commercial area. Chairman Peters
said that it was his understanding that Hiline Road was to be developed
for an arterial road, not commercial. Gordon Wilkes, 885 E. Chubbuck,
said that two of the nicest subdivisions being developed in Chubbuck was
in this area east of Hiline Road. Bill Cottle, owner of property in area,
suggested to Mr. Parrish the land be re-zoned R-2, or just to let it
stand as it is until the time comes they wish to develop. He said he felt
there was a definite need for a soft buffer zone.
A lengthy discussion followed on the development of Hiline Road.
Commission Member Dick Anderson made a motion that the request of Kent Parrish
President of Land Investments, Inc., that the following property as described
in Public Hearing Notice, (a) be re-zoned Neighborhood Commercial (C-1), or
(b) be re-zoned or granted a variance, as appropriate, for placement of mobile
homes be denied. Dee Stalder seconded the motion. The voting was unanimous.
PUBLIC HEARING ITEM: Kent Parrish, Land Investments, Inc.
Commission Member Larry Rawlins then made a motion to recommend to the
City Council that property located east of Hiline Road between East
Chubbuck Road and Interstate 15W to a depth of approximately 300 feet,
all located in Section 11, Township 6 South, Range 34 E.B.M., in the
City of Chubbuck, Bannock County, Idaho be re-zoned Residential Two
(R-2). Dick Anderson seconded the motion. The voting was unanimous.
REVIEW OF ROBERT AND KAREN KENNEDY VARIANCE: The Commission Members
reviewed the variance that was granted the Kennedy's in April, 1975
to operate a Drapery Labor Room at 5122 Hawthorne Road. Commission
Member Jim Chatterton made the motion to grant the Kennedy's an
extension of the variance granted in April, 1975, to operate a Drapery
Labor Room for the period of one year. Clifford Payne seconded the
motion. The voting was unanimous.
Thel Commission Members reviewed the request of the Pocatello
Industrial Park to be de-annexed from the City of Chubbuck.
