SEPTEMBER 4, !980
Minutes of the regular meeting of the Land Use & Development Commission held
in the city municipal building September 4, 1980.
Present: Chairman Michael Metcalfe, Commission Members: Dwain Kinghorn,
Myrna Cain, Dee Stalder, City Engineer Steven M. Smart and Secretary
Dorothy Ward. Janet Williams and Dean Wood were excused.
Meeting called to order at 8:00 p.m. by Chairman Metcalfe.
Chairman Metcalfe asked for the minutes to be read of the meeting held August
7, !980. He then asked for any additions or corrections. There being none
9wain Kinghorn made motion minutes be accepted as read. Myrna Cain seconded
motion with full commission approval.
PUBLIC HEARING ITEM: LARRY C. HUNTER, FOR A CONDITIONAL USE permit, to
erect two 3' x 6' signs at his business at 4805 Yellowstone, Chubbuck,
Idaho.
Carrie Sue Hunter represented Mr. Hunter. She explained how the signs would
be erected. One sign would be mounted on the building and the other a free
standing sign.
The Commission questioned Ms. Hunter as to the construction of the signs; and
as to how they would be mounted and if they would block the view of traffic
approaching Yellowstone Avenue from West Chubbuck Road,
Dee Stalder made motion to recommend to the city council for approval of
placement of two signs for Larry Hunter, 4805 Yellowstone, and that the signs
conform with the Land Use Ordinance #205, Section 3-4, page 25 (D). Free-
standing on-premise signs not over thirty (30) feet in height, having a
maximum total sign area of one hundred (100) square feet per display area
and located not closer than ten (10) feet to any street right-of-way line and
not closer than thirty (30) feet to any adjoining lot line may be erected
to serve a group of business establishments. There shall be only one (1)
free-standing sign for each building, regardless of the number of businesses
conducted in said building.
Myrna Cain seconded the motion with full commission approval.
PUBLIC HEARING ITEM: MARK L. AND MARY B. BUNCE, EOR A CHANGE OF LAND USE
District on property 117' x 168'adjoinihg Ramsgate and adjacent to 755 and
765 East Chubbuck Road also a conditional use permit for a multiple
dwelling on said property.
Chairman Metcalfe explained to Mr. Bunce that under the Comprehensive Plan
of the City of Chubbuck this particular piece of gro~ would be zoned
Limited Residential (R-l); therefore a conditional_i~_ permit could no
be granted, but that they could act on a variance request and the present
publication would take care of this.
A petition was presented to the Chairman from residents in the area, cOncerning
the requeSt for a multiple-dwelling on this property.
Mark L. and Mary B, Bunce, continued,
Mr~ Bunce explained to those attending about the property and that he
had a person interested in buying it and building a four-plex. He read
several letters from tenants and neighbors of the people interested in
buying property stating how well they maintained their property. He
said Mr, & Mrs, Hess would live in one of the apartments~ so would be
there to see that it was well maintained. Mr, Bunce showed pictures of
property owned by the Hess's.
Blaine.Bupp,4727 Chateau, said by allowing a four-plex to be built, the
city would be setting a precedent and if some one else came in asking for
a variance for a four-plex the city would be obligated to allow it. He
said multiple dwellings do not add to the value of surrounding homes.
Ron Thomsen, 703 Bedford, said they had attended a meeting previously when
zoning had been discussed and had been assured the city would comply with
the Comprehensive Plan,
Residents in the area discussed the following items~
1. Concern for the children in the area.
2. Traffic flow.
3. Value of their land.
4. Parking
5, Concern whether the people would sell property.
Dwain Kinghorn said he had driven through the area and saw several signs
of concern; such as vacant lots with weeds and a home that was not lived
in growing up in weeds.
Myrna Cain made motion to deny the variance request of Mark L, and Mary B.
Bunce for a multiple family dwelling on property 117' x 168' adjoining
Ramsgate and adjacent to 755 and 765 East Chubbuck Road, that wishes of
the residents in the area should be considered and that by denying request
it does not create hardship for Mr. & Mrs. Bunce.
Chairman Metcalfe explained that zoning change would be handled with
recommendation to the city council for Limited Residential (R-l) if
Mr, Bunce wished to have property re-zoned according to the Comprehensive
Plan. Mr. Bunce asked if property could be zoned only Limited Residential
(R-l) why he had had.to go through this meeting.
Chairman Metcalfe called for a second to the motion,
Dee Stalder seconded the motion. Stalder, yes; Kinghorn, yes, Cain, yes
Metcalfe, yes,
Chairman Metcalfe read to Mr. Bunce the proceedure for appealing the
decision from the Land Use Ordinance #205.
PUBLIC HEARING ITEM: ALVAH L. MATHEWS FOR A CONDITIONAL USE PERMIT to place
a mobil home on his property at 5261 Lucky.
Mr, Mathews said they owned the property and had rented it since moving
away. That they did not wish to sell but liked to keep it rented to keep
the yard up.
Ray England, Hawthorne Road, said he had obServed the lot had been well
maintained as long as a mobil home had been on it.
Alvah L, Mathews, continued
Gladys Rippe, 5242 Lucky, said she would like to see a mobil home on the
property.
Chairman Metcalfe reported he had talked with the City Attorney, Donald L.
Burnett, Jr, and the moratorium would not affect placing a mobil home
on this property,
Dwain Kinghorn made motion to recommend to the city council to allow
a conditional use permit to Alvah L, Mathews to place a mobil home
at 5261 Lucky, subject to the condition property is kept in proper
maintenance.
Dee Stalder seconded the motion, with all commission members voting in favor.
PUBLIC HEARING ITEM: DETERMINATION WHETHER TO RECOMMEND ANNEXATION AND ZONING
CLASSIFICATION AS REQUESTED BY ROY J. LACEY, with respect to the following
parcel of land located in the South ½ of the Northeast Quarter of the
Northeast Quarter of Section 4, Township 6 South, Range 34 East B .M.,
Bannock County, Idaho. Said parcel contains 16.3 acres more or less. Mr.
Lacey is requesting land be zoned Limited Residential (R-l) and General
Residential (R-2) per the Comprehensive Plan of the City of Chubbuck. Mr.
Lacey is also asking for a review of the preliminary plat of Espie
Addition.
Mr. Lacey reviewed the Espie Addition with the Commission. He said:
1. Lot sizes are larger than required.
2. Plans to have pressurized water for lawn & garden use when water
in canal duri~ irrigation season.
3. Addition lies line with the city.
4. l~ater lines on Hawthorne Road and sewer at the back of property.
5. Covenants will be similar to the Roy Addition, with houses to be
similar to this addition.
Ray England, Hawthorne Road, stated he would be a neighbor to this development,
that Mr. Lacey had worked hard to develop it since he had purchased the
property. He said he would like to request the city require a fence be
up between his property and the Lacey property, to protect his property
after Mr. Lacey is no longer associated with it.
Mr. Lacey said he had developed several properties and had always exceeded
the requirements, and he felt a chain link fence would not solve problems
of keeping children out of Mr. England's property.
The Commission discussed with Mr. England and Mr. Lacey and Mr. Fred Wilson
the survey line. They confirmed the property line would be the fence
line, with all parties agreeing to this.
Owain Kinghorn explained to Mr. Lacey the city would expect some type of a
capitol improvement fee, if this property is annexed into the city.
Mr. Lacey said he would be willing to connect his water line to the end of
Dell Road. He said he had talked to Rodney Clark about the parks in
Heights Subdivision and that he seemed willing to exchange these two small
parks, if the city was willing, for ground by the Portneuf Library, Mr.
Lacey said he would then purchase one acre there and present it to the
city for expansion of Stuart Park.
Espie Addition - continued
Mr. Lacey said he would be willing to help develop this area with some
trees and shrubs.
Chairman Metcalfe made motion to recommend to the City Council for annexation
of thelSouth ½ of the Northeast ¼, Northeast ~ of Section ~, Township 6
South, Range 34 East B, M. North of Delmar Acres and ~'lest of Hawthorne Road.
And said annexation be contingent with city ordinance pertaining to
dedication of park and recreation lands or monies in lieu of or other
agreements - and that capital improvement fees will be condition to said
annexation.
Myrna Cain seconded the motion with all commissioners voting in favor.
Chairman Metcalfe made motion to recommend to the City Council that zoning
on Espie Addition, property to be annexed by the City of Chubbuck, to comply
with the outline of Comprensive Plan. The Chandler property should be
viewed either to conform with Comprehensive Plan or Agriculture Transitional
in its zoning.
Dee Stalder seconded the motion with all voting in favor.
Chairman Metcalfe made motion to recommend acceptance of preliminary plat,
submitted by Roy J. Lacey of the Espie Addition subject to City Engineers
recommendations.
Myrna Cain seconded the motion with all commissioners voting in favor.
PUBLIC HEARING ITEM: SCOTT BIRD FOR A CHANE OF LAND USE DISTRICT for property
at 4404 Burley Drive, to be zoned Industrial; also a conditional use permit
to open a boarding and breeding dog kennel.
Jane Bird said they planned to open a commercial boarding and breeding kennel.
There would be indoor - outdoor runs and would be constructed of concrete.
She said it would be about a 60' building and would be constructed close
to the freeway.
The Commission discussed with Mrs. Bird the need for this type of kennel. She
stated their was a real need in the area for a good kennel, for people to
board their animals while on vacation or during the breeding time.
Dwain Kinghorn made motion to recommend to the City Council,for their approval,
the change of Land Use District for property at 4404 Burley Drive from General
Residential (R-2) to Industrial (I) as proposed in the Comprehensive Plan;
as requested by Scott Bird.
Myrna Cain seconded the motion. Stalder, yes; Metcalfe, yes, Kinghorn, yes;
Cain, yes.
Dwain Kinghorn made motion to recommend to City Council the proposal of Scott
Bird, 4404 Burley Drive, for a conditional use permit to operate a boarding
and breeding kennel, to follow recommendation of Boarding Kennel Association
and the local veterinarians; and that facilities for sewage and sanitation be
adequate for facility. Myrna Cain seconded motion, with all voting in favor.
Dee Stalder made motion to adjourn at 11:25 p.m,
