HomeMy WebLinkAbout010 02 80LAND USE & LAND DEVELOPMENT COMHISSION MINUTES October 2, 1980 ~linutes of the regular meeting of the Land Use & Development Commission held in the city municipal building October 2, 1980. Present: Chairman Michael Metcalfe, Commission Members: Dwain Kinghorn, Myrna Cain, Janet Williams, Richard Allen, Secretary Dorothy Ward. City Engineer Steven Smart was excused. Meeting called to order at 8:00 p.m. by Chairman Metcalfe. PUBLIC HEARING ITEM: PROPOSAL BY SIGH SYSTEM, INC. FOR A CONDITIONAL USE permit to erect three wall on-premise illuminated signs for the Sea Galley Restaurant in the Pine Ridge Mall. Jack Croly, President of Sign System, Inc. discussed with the commission the signs that would be erected. He said the illuminated signs would be placed on the building with a small directional sign. Janet Milliams made motion to recommend to the City Council for approval of three wall on-premise illuminated signs for the Sea Galley Restaurant in the Pine Ridge ~all. Richard Allen seconded the motion with all commission members voting in favor. PUBLIC HEARING ITEM: CITY OF CHUBBUCK FOR A LAND USE DISTRICT. CHANGE on property located at 1~ Hiway Avenue, Lot 14, Hiway Acres Subdivision, to General Commercial (C-2). Engineer Steven Smart had recommended to the Commission for this property to be rezoned. This property falls in the qeneral Commercial zone in the Comprehensive Plan. Commission Member Dwain Kinghorn stepped down from the Commission at this point because of a possiblity of conflict of interest as he owns property in the area. Commission Members discussed the buffering of the property from the residential area. Chairman Metcalfe said property to the east should be protected. Betty Long, 131Hiway Avenue, asked about the fence, she said the city had placed a board fence across from her place when they installed the police station and that it was not very attractive to look at. Dwain Kinghorn, !45 Hiway Avenue, said the city should develop according to the Land Use Ordinance, the frontage should have curb, gutter and a green belt so that the aesthetics would be changed as little as possible. Mrs. C. A. Edmunds, 151Hiway Avenue, asked about curb and gutter along Hiway Avenue. Dwain Kinghorn explained how a L.I.D. was financed and the difficulty of selling the bonds. CITY OF CHUBBUCK LAND USE 9ISTRICT CHANGE continued -. Richard Allen made motion to recommend for approval Of the proposa by the City of Chubbuck ~or a Land Use District change on property located on Lot 14, Hiway Acres Subdivision, 144 Hiway Avenue, to General Commercial (C-2) subject to the city meeting the standards set forth in the Land Use Ordinance before occupying the property. Janet Williams seconded the motion. Allen, yes; Williams, yes; Cain, yes; Metcalfe, yes. PUBLIC HEARING ITEM: JERRY TYDEHAN FOR A LAND USE DISTRICT CHANGE on property located on Lot 15, Highway Acres Subdivision, 156 Hiway Avenue to General Commercial (C-2). Engineer Smart had recommended to the Commission for this property to be rezoned. This property falls in the General Commercial zone in the Comprehensive Plan of the City of Chubbuck, Mr. Tydeman was present and said he felt this was a good time to have his property rezoned as the city had requested their property adjacent to his to be rezoned. He said he had no immediate plans for the development of this property. Betty Long, 131Hiway Avenue, said she had lived next to commercial proper~Y~i~h no problems. Dwain Kinghorn, 145 Hiway Avenue, told Mr. Tydeman he was going to ask the Commission to deny the request for the following reasons: 1) He feels there should be more control than the Land Use Ordinance gives. 2) Comprehensive Plan is a long range plan, if property is zoned Commercial the city will loose control of the residential area~ 3) More people will be asking for a change of zoning. 4) The City of Chubbuck has plans for their property. Richard Allen explained the city can require controls on this property as well as ~? on any piece of property within the city, The Commission discussed with those present the following: 1) Change of zoning pertinent to the area. 2) Conforms with the City of Chubbuck Comprehensive Plan. 3) Need to uphold the direction of the growth of the city. Berniece Kinghorn, 1~.5 Hiway Avenue, asked that the zoning not be changed until such time that Mr. Tydeman was ready to develop commercially. Mr. Tydeman said he did not wish to be the buffer zone. Richard Allen made motion to recommend for approval to the City Council the proposal by Jerry Tydeman, 156 Hiway Avenue, for a Land Use District change. That Mr. Tydeman meet all requirements of the Land Use Ordinance, before any commercial development curb, gutter and sidewalk be installed before any occupancy.
