A special meeting of the Land Use & Development Cc~mission held in the city
municipal building, November 12, 1980.
Present: Chairman Michael _~etcalfe, Cc~msision Members: Dwain Kinghorn,
Dean Wood, Dee Stalder and _Myrna Cain, City Engineer Steven Smart and
Secretary Dorothy Ward. Richard Allen was excused.
~eting called to order at 7:00 p.m. by Chairman Metcalfe.
This meeting called at the request of American Heritage Builders, Inc.,
Samuel T. Briscoe, Manager, for relief frc~ the bond requirements on
Heritage West Subdivision.
~. Briscoe said they would like to start doing scme building thiswinter,
but that the city engineer recon~ended that the roads not be paved until
spring. He said in lieu of bond they would deed 7 lots to the city. Lot
numbers ~ 8, 9, 10, 11, 12, 13, & 14 in Block 4. He also said they would
provide a letter of cc~mi~t, Note and Deed of Trust from Sherwood &
Roberts.
The cc~mission discussed the bond r_equirements, Commission Member Kinghorn
said he could recc~mend to the city council for approval with the security
_Mr. Briscoe had presented until the weather was mere favorable.

deed of American Heritage Builders to seven lotS~ ~ 8, 9, 10, 11, 12, 13,
and 14 in Block 4, as security , in lieu of bond requirements, for the
Heritage West Subdivision.
Dee Stalder seconded the mtion. Kinghorn, yes; Stalder, yes; Wood, yes;
Cain, yes and Metcalfe, yes.
The Commission spent sc~e time discussing the bend requirement of developers
such as:
1. Irrevocable documentary letter of credit
2. Cashiers checks
3. Deeding of property
Chairman Metcalfe made motion to reconmend to the city council the Land Development
Ordinance be amended in the foliowingway: Chapter 3, Section 3-2: Dedications
in C~_neral, page 14, D, -the developer furnishes a completion bond, or
letter of credit or cashiers check, or lots deeded to the city as approved
by the city as to fo~n, amount and surety.
DeanWood seconded the metion, with all commission members voting in favor.
Chairman Metcalfe asked commission members to study the Land Use and Land
Development ordinances with possiblymeeting at 7:00 p.m. on December 4,
1980 with any recut~tendations for changes.
Chairman Metcalfemademotion to adjourn at 7~40 p.m. with all voting in favor.
