Minutes of the regular meeting of the Land Use & Development Cc~nission held
in the city municipal building November 6, 1980.
Present: Chairman Michael Metcalfe, Cc~rmission Members: Dwain Kinghorn, MI;rna
Cain, Janet Williams, .Richard Allen, City ~Engineer Steven Smart and Secretary
Dorothy Ward. Dean Wood was excused.
Meeting called to order at 8:00 p.m. by Chairman S~tcalfe.
Chairman ~tcalfe asked for any additions or corrections to the minutes of
meetings]%~ldOctober 2 and October 14, 1980. There being none, Janet
Williams made motion to approve minutes, k~frna Cain seconded the motion.
All co~nissionmembers voted in favor.
PUBLIC HEARING ITEM:
1. CONSOLIDATED APPLICATION BY MARK L. AND SiARY B. BUNCE FOR a variance
or in the alternative for a change of land use district to "General
_Residential" (R-2) and issuance of a conditional use permit, and for a
change of the City's conprehensive plan if necessary to allow construction of
a mulit-family dwelling on land approximatel 117 feet by 168 feet, located
in~nediatelyb~d 755 and 765 East Chubbuck Road.
ChairmanMetcalfe asked for testimony in behalf of this proposal.
~Mark Bunce said they had contacted all cu~,u,~ssion members and the people involved
in the area to explain their request. The building business is rough, he said,
and only small homesOr those being subsidized by the government are moving.
This piece of property is suitable for a multi-family dwelling he said. It is
the only piece of property in area not in a subdivision and has not been zoned.
Dewey Hess explained if the request was granted they would be the ones to build
on it. He said they would build an all brick four-plex, with parking for eight
cars in the rear and fully landscaped. He said they wouldmake their home
in the four-plex.
Comnission Member Kinghorn said he had done scme research and that he had believed
to begin with the c~ssion had made the right decision at the request of the
people not to allow the four-plex. He said a reasonable decision should be
made, considering all aspects of the proposition. He said he felt the only
way Mr. Bunce could realize the full value of this piece of ground was through
special use as it was much larger than an ordinary lot.
Roy Lacey said in his experience with vacant lotsthey becc~ae garbage collectors.
ChairmanMetcalfe asked for testimony against this proposal.
Mike Johnson, 723 Bedford, presented a petition fr~n area residents in opposition
to the proposal. Mr. Johnson asked aboutMr~ Bunce making a request for sc~e
cme else. He said he felt this would be setting a precedent for the other
undeveloped lots.
NormaMerrell, 710 E. Chubbuck Road, said she would object as all lots on East
Chubbuck Road are large and this lot is not outsized for the location it is in.

Chairman ~tcalfe read a letter frc~ Mike and Shirley Cc~ons, 806 E. Chubbuck
Road objecting to the request for a multi - family dwelling.
Keith ~rrell said he had just purchased a hc~e on ~Duntlake Street that ~ot was
equal size to the one in question.
Rodney W. Watkins, 4718 Chateau, said he was in opposition the zone change and
application. He said lot size is not extremely large in comparison to other
lots in surrounding area and he felt it would in~act the value of the other
properties.
Carol Johnson, 723 Bedford, said they felt it would be a hardship with a duplex
and a four-plex on each side of them, she also expressed concern of a precedent
being set.
George Millward, 737 Norcrest, said change would not be consistant with the
comprehensive plan and he reviewed with the cc~mission some of the concerns
of the people in the area:
1. Traffic
2. Steepness of East Chubbuck Road and Ramsgate in the winter
3. Safety factor for their children
4. Depreciation of property
5. The fact that in Mr. Bunce's restrictive covenents on his subdivision
he does not allow multi-family dwellings
6. Surrounding 16 acres that can be developed
7. Mr. Bunce had created his own hardship when large garage was built
Stanley L. Merrell, 732 Bedford, said City's comprehensive plan is a good one
and although he owns the duplex in the area he was in agreement with the
objections being made. Said as a realtor, when showing properties, you
always indicate to people the type of development in an R-1 zone. He said
he was against spot zoning and felt c~ssion should pay attention to the
public' s concern .
Dwain Kinghorn reviewed the density requirements of the ordinance and also
said the city could ask for any type of control.
Stanley L. Merrell, 732 Bedford, said the people should be listened to and
was concerned that change of the cu~rehensive plan was not desirable for
all concerned. He said Mr. Bunce was only one individual that wants a
change and that the cc~mission should weigh his investment against the
investment of all the rest of the people who objected.
Richard Allen made motion to recon~nend to the city council the application of
Mark L. and Mary B. Bunce be denied to change the comprehensive plan and
the conditional use permit be denied for a multi-family dwelling on property
117 feet by 168 feet, located ir~ediately behind 755 and 765 East Chubbuck
Road. Janet Williams seconded the motion. Allen, yes; Williams, yes;
Cain, yes; Metcalfe, yes, Kinghorn, yes.

c~rehensive plan and change of land use district to "General Residential"
(R-2) with respect to a parcel of land containing approximately 21.26 acres

located west of Whitaker Road behind E1 Cielito Chapel and east of the Union
Pacific Railroad right-of-way.
Ken Satterfield, Satterfield Realty, said property is zoned partially Industrial
(I), and would need to have it zoned c~__neral Residential (R-2) in order to
develop it. He said his firm is in the development business and they see a
need for single family dwellings; their intention is to try to keep the
price down and hope for F.H.A. and V. A. approval.
Kent Kunz, 4801 Whitaker Road, said if they stay with the present comprehensive
plan there would be an island of industry surrounded by residential areas.
George Shiozawa, owner, said it would make a clean break between a residential
area and future development to the north of this development.
Dan Kunz, 5157 Whitaker Road, said he had given a 50' easement to the city for
access to line up with Hiway Avenue. He said development was inevitable,
had to decide which city would prefer, smoke stacks or residents.
C. Doty, 5049 Whitaker Road, said he had not saw any plans, but was concerned
if the area would be zoned for livestock. He said with a four-plex and the
wedding chapel and the Briscoe Subdivision, they did have a traffic problem.
He expressed concern about the adequateness of the sewer on Whitaker Road.
Mr. Satterfield said that with the development it would provide for a loop in the
water line whichwouldbe beneficial. He said there would be at least three
access roads in the subdivision and that the natural flow for the sewer would
be towards Hiway Avenue.
DwainKinghorn said city was not anxious to annex property, with the oneper
cent initiative services were hard to provide.
JanetWilliams made motion to reconr~nd to the city council for their approval
the request of Shiozawa -Kunz - Satterfield for a change in the City's
comprehensive plan~', and change of land use district to '~C~neral Residential"
(R-2), with respect to parcel of land containing approximately 21.26 acres,
located west of Whitaker Road behind E1 Cielito Chapel and east of the Union
Pacific Railroad right-of-way. Myrna Cain seconded the motion. Williams, yes;
Cain, yes, Kinghorn, no~ Metcalfe, yes.
PUBLIC HEARING ITEM:
3. PROPOSAL TO BE CONSIDERED BY THE LAND USE DEVELOPMENT COMMISSION , UPON
ITS OWN MOTION, FOR A CHANGE IN THE CITY'S CC~4PREHENSIVE PlAN and change of
land use district to "C~_neral Residential: (R-2) with respect to a parcel of
land immediately south of the parcel mentioned in ite~ #2, extending from the
southerly border of said parcel to East Chubbuck Road, and bounded on the east
by Whitaker Road and the west by the Union Pacific Railroad right-of-way.
Ralph Henderson, property owner, said he had pUrchased his property because it
was industrial and that he would not like to see the zone change made. He
said it was more advantageous to the city to be industrial.
Tony Harris, 515 Albatross, said he had eight acres in the industrial area and
did not wish it to be rezoned.

Dwain Kinghorn made motion to reconmend to the city council the comp_ rehensive
plan and change of land Use district to "General Residential" (R-2) not
be changed with respect to a parcel of land ~iately so~th of 'the-par~c~l
mentioned in item #2, extending frem the southerly border of said parcel-to
East Chubbuck Road, and bounded on the east by Whitaker Road and the west
by the Union Pacific Railroad right-of-way. Mike Metcalfe seconded the
motion. Williams, no; Cain, yes; Kinghorn, yes; Metcalfe, yes.
OTHER BUSINESS:
1. Zedco Inc., Design Review for Chicken Charlies - Chubbuck Plaza
Shopping Center. Roger Mc Atee was present to represent Mr. Long.
Steven Smart and Mr. Mc Atee went over the plans with the conraission members.
Commission members were concerned about a green area.
Mr. Smart told Cocmission Members Design Review permit had been issued to the
Chubbuck Plaza Shopping Center in October of 1979, and this is part of the
develo~nent.
Dwain Kinghorn made motion to recc~mend the Desgin Review be approved for
Chicken Charlies, to the City Council, with an addition of greenery to be
added to the design before being presented to the city council. Janet
Williams seconded the motion. The voting was unanimous in favor.
2. Review of preliminary plat for the Espie Addition, a subdivision located
in the Chubbuck impact area lying north of the Dell Acres Subdivision and west
of Hawthorne Road.
Engineer Smart told Mr. Lacey that a firm cut.~.~tment needed to be made on the
park area before the preliminary plat could be approved.
The Cu~,~Jssion discussed with Mr. Lacey the changes he had made on his plat.
Mr. Lacey said he would be willing to give the $540.00 per lot cash contribution
in lieu of park land *and capital imp_rovement funds for annexation.
Janet Williams made motion to re~d to the city council for approval the
preliminary plat of the Espie Addition subject to the following:
1. Cash contribution in lieu of park - plus capitol improvement
fees.
2. Darris Street extension be deleted and Jerry Street be extended
to the property line on north end.
3. Rec~t~ndation of city engineer to be followed.
Myrna Cain seconded the motion, with all Commission Members Voting in favor.
Janet Williams made motion to adjourn at 11:50 p.m., seconded by Myrna Cain,
with all voting in favor.
