June 5, 1980
Minutes of the regular meeting of the Land Use and Development Commission
held in the city municipal building, June 5, 1980.
Present: Chairman Dee Stalder, Commission Members: Becky Hopkins, Myrna
Cain, Janet Williams, Richard Allen and Mike Metcalfe, City Engineer
Steven Smart and Secretary Dorothy Ward. Del Peters was excused.
Meeting called to order at 8:10 p.m. by Chairman Stalder.
Chairman Stalder asked for any corrections or additions to the minutes of
May 1, 1980. There being none, Richard Allen made motion minutes be
accepted as written, Janet ~lilliams seconded the motion. All voted in
favor.
PUBLIC HEARING ITEM: Empey Sign Company asking for a conditional use
permit to erect one flat on-premise sign and one free standing on-premise
sign at 4759 Yellowstone.
John Croly of Empey Sign Co. said the the on-premise sign would be metal
letters on a non-illuminated five by sixteen area attached to building.
The free standing sign will be a stacked sign on the canopy, with metal
supports and located eight feet back from highway. He said he had talked
to the highway department about this sign and they had given their
approval.
Engineer Smart said the application appeared to be within the limits of
the ordinance.
Richard Allen made motion to recommend to the City Council for their approval,
the conditional use permit to Empev Sign Company to erect one flat on-premise
sign andv ~ free standing on-premiSe sign to be located at 4759 Yellowstone.
Janet Williams seconded the motion. The Commission voted unanimously all in
favor.
OTHER BUSINESS: APPLICATION FOR A DESIGN REVIEW PERMIT, DAVID L. GARVIN,
A-I TV SERVICE.
Richard Allen asked if there had been any changes in the application. Mr.
Garvin said no, the reason he was re-applying was because the forty five day
limitation had expired and the cOuncil had had to deny his application, until
such time he had a survey taken to establish his easement to the back of his
property. The problem was there was a possibility he did not have adequate
access on his own property and a building permit could not be issued until
such time he could provide parking at the rear of his business.

Mr. Garvin said he had the survey made; although he does not have the
engineering report, he did have photos showing the survey stakes and
they indicated there was adequate access.
Mike Metcalfe made motion to recommend to the city council for approval
the Design Review Permit of David L. Garvin, A-!TV Service, 5003
-Yellowstone, subject to the survey accuracy report. Richar Allen
seconded the motion. All voted in favor.
Chairman Stalder brought to the attention of the commission the
July meeting would fall the night before a holiday. Mike Metcalfe made
motion the regular meeting of the Land Use Commission be held on July
10, 1980 at 8:00 p.m. Janet Williams seconded motion. The voting was
unanimous in favor.
A discussion followed on the responsibility of the commission towards
the city council and the business that comes before them.
Mike Metcalfe made a motion to recommend the City Council investigate
the ordinance requirements and possibilities to revise ordinance to
eliminate the public hearing on the city council level; retaining public
hearing at the Land Use & Development level with direct imput from public
and land use commission being presented at one time. Richard Allen
seconded the motion. All voted in favor.
The motion was made by Richard Allen and seconded by Mike Metcalfe to
adjourn at 9:15 p.m.
