HomeMy WebLinkAbout008 07 80LAND USE & LAND DEVELOPMENT COMMISSION MINUTES August 7, 1980 Minutes of the regular meeting of the Land Use & Development Commission held in the city municipal building August 7, 1980. Present: Acting Chairman Dwain A. Kinghorn, Commission Members: Becky Hopkins, Myrna Cain, Janet Williams, City Engineer Steven M. Smart and Secretary Dorothy Ward. Chairman Mike Metcalfe and Dee Stalder were excused. Meeting called to order at 8:10 p.m. by Chairman Kinghorn. Chairman Kinghorn asked for any additions or corrections to the ~nutes of July 10, 1980; there being none, Janet Williams made motion to accept the minutes as written. Myrna Cain seconded with full commission voting in favor. PUBLIC HEARING ITEM: 1. A proposal by Reverend William P. Carroll, for a conditional use permit to construct St Pauls Catholic church at 820 W. Chubbuck Road. Pete G. Anderson, of H. Tom Myers and Associates, presented the plans for the church. He said they were ready to start construction, that they had let the bids and were now evaluating the low bid, He said the design would fit into the neighborhood, that it is a low profile building. Mr. Anderson said the church had fenced the east and west side of the property with chain link fence. Chairman Kinghorn reviewed with the commission the recommendations of the citY engineer. He said they had two main entrances on West Chubbuck Road and one on Todd which made good traffic flow. There was adequate parking and at the present time in the city ordinance there was no requirements for a sign on a church. Mr. Anderson said there would be indirect lighting on the outside. C. I. Tanaka, 4835 Trent, expressed concern with the construction sight. He said the dirt piles were an annoyance to the neighborhood with blowing of the dirt. He said he had no objection to the church but felt they should try to control the dirt. He asked that a condtion be put on the granting of the conditional use permit, that the exterior of the building and surrounding area would be competed within a year. Reverend Carroll said excavation had been done about two weeks ago and the contract would be for 180 days. Jackie Korn, 4851 Cole, said they were one of the first people to purchase property in this subdivision and were aware how annoying blowing dirt was but they also realized a certain amount had to be tolerated with construction going on. She said the church would control the dirt as soon as the water tap was completed. Becky Hopkins asked about the paving of the Parking lot. Reverend Carroll said it would be to late this fall to blacktop but that gravel with a seal coat would be laid, ST PAULS CATHOLIC CHURCH - continued Reverend Carroll said they need to have their water tap to try to control the dirt problem, and that landscaping would depend on the weather but that grass and the parking area would be taken care of as soon as possible. Janet Williams made motion to recommend to the city council the conditional use permit of Reverend William P. Carroll, to build St. Pauls Catholic church at 820 W, Chubbuck Road be granted with two conditions: 1. Paving and grass be started by October 1, !981. 2. They make reasonable effort to control the dirt during the construction period. Myrna Cain seconded the motion with all commission members voting in favor. PUBLIC HEARING ITEM: 2. A proposal by John E, Murray and Charlie Frasure for a conditional use permit to construct a roller skating rink in the 100 block of the proposed West Ward Drive. Charlie Frasure and John Murray said the building would be an enclosed area, consisting of approximately 12,800 square feet, it would be a pre-engineered building with masonry walls and a steel roof. They said they had been to California looking at roller skating rinks and were now ready to start construction on their own. Commission discussed at some length the parking situation and the parking spaces that are required under city ordinance. Their plat shows parking spaces for 137 cars and the ordinance calls for parking fo~ 256 cars. They said they were sure as the shopping center developed more parking would be available if needed~during peak hours. Engineer Smart said plat lies within the bounds of shopping center plat, and they have access to steets and utilities, after shopping center is completed; but the responsibility is up to Mr. Frasure and Mr. Murray to install the utilities. Becky Hopkins made motion to recommend to the city council for their approval the conditional use permit of John E. Murray and Charlie Frasure to construct a roller skating rink in the 100 block of the proposed West Ward Drive with the following conditions: 1. The developers provide for parking according to the ordinance or provide a written agreement with shopping center to provide parking space and or to monitor and hold an additional 120 spaces on their own adjacent property as determined by city engineer and developer. 2. The plat of Chubbuck Plaza Development needs to be completed or Roller Skating dev'~l'op~ property will need to be platted. Janet Williams seconded the motion. Roll call vote, Hopkins, yes; Cain, yes, Williams, yes, Kinghorn, yes. OTHER BUSINESS: MARGARET OHLIN, review of variance to keep present animals on their property at 4855 Joy. Property is zoned General Residential (R-2). Mrs, Ohlin said they had 4 Mallard ducks and two rabbits. Chairman Kinghorn asked the secretary if there had been any complaints registered about the animals. He was told there had not been any comment. Becky Hopkins made motion to extend the variance request of Mrs. Margaret Ohlin to keep their present animals on their property at 4855 Joy, subject to a yearly review. ROBERT AND KAREN KENNEDY, review of variance to operate a drapery shop at 5!22 Hawthorne Rd. Property is zoned General Residential (R,2). Mr. & Mrs. Kennedy were not present. Becky Hopkins made motion to table this item until the Kennedy's were present. Myrna Cain seconded the motion. All voted in favor.
