HomeMy WebLinkAbout004 03 80LAND USE & LAND DEVELOPMENT COMMISSION MINUTES April 3, 1980 Minutes of the regular meeting of the Land Use & Land Development Commission held in the city municipal building, April 3, 1980 Meeting called to order at 8:05 p.m. by Chairman Dee Stalder. Present: Chairman Stalder, Commission Members: Dell Peters, Mike Metcalfe, Richard Allen, Becky Hopkins, Myrna Cain, Dean Wood, Engineer Steven M. Smart, and Secretary Myrna Crapo. Chairman Stalder asked for any corrections or additions to the minutes of March 6 and March 20, 1980, there being none, Dean Wood moved to accept minutes as written. Richard Allen seconded motion with an unanimous vote in favor. PUBLIC HEARING FOR CONDITIONAL USE PERMIT TO ALLOW SIGN- at 4705 Yellowstone. Cosgriff, Inc. wanted to erect an off premise Poster Panel. Jeff Wilson explained the sign structure and appearance, along with showing a picture of the sign. The sign is already in use. After general discussion, Richard Allen moved to recommend to the City Council the approval of the conditional use permit to erect the off premise Poster Sign at 4705 Yellowstone. Dean Wood seconded the motion with all present commission members voting in favor. PUBLIC HEARING FOR CONDITIONAL USE PERMIT TO ALLOW SIGN - at McKee's Feed and Garden Center 130 Evans Lane. William McKee is requesting a permit to erect a free standing sign on-premise and a wall on-premise sign. Mr. McKee explained the specifications of the signs stating that the free standing sign is to be placed on the corner of the lot facing Yellowstone. There would be no moving parts on the sign and it would be lighted inside with yellow, black and red lights. The wall on-premise sign would be wood letters with one spot lights on each side.' Mike Metcalfe moved to recommend to the city council to approve the conditional use permit for McKee's Feed and Garden Center to erect a free standing sign on-premise and the wall on-premise sign of 130 Evans Lane subject to being in conformity with city ordinances. Dell Peters seconded motion, with all voting in favor. PUBLIC HEARING TO REVIEW A PRELIMINARY PLAT - for S & N Estates, a subdivision located in the Chubbuck impact area lying North of Tyhee Road, just East of the railroad tracks, in Bannock County, Idaho, proposed to be developed by Kent Shiozawa, Ronald Nelson and Richard Nelson. Neil Mogan representing Harper, Morgan & Assoc. Inc. explained the preliminary plat. There are 22 lots which includes one well lot. There will be easements for the gas company and for the proposed community irrigation. There will be underground water with a community well. The Health and Welfare have given preliminary approval. There will be individual sewage disposal with drain fields and asphalt pavement for roads with no curb or gutters. The Commission asked the engineer for his recommendations. Since they are within a mile of Chubbuck City limits and in Chubbuck's Impace Area the city needs to allow full standards in this area. Engineer Smart made the following recommendations: PUBLIC HEARING ON PRELIMINARY PLAT - 3 4 5 6 7 8 Fire hydrants and fire flow needs to be accounted for in their design. Comprehensive plan, land use for this area is Industrial Need underground utilities Recreational land according to the ordinance requires 4/10 acre. Need to have curb, gutter, sidewalks, and dry wells. Need 2" asphalt mat. 6" duct line pipe is required by city ordinance Developers should be committed to develope the road easement if and when the adjacent land is ever developed. Lot 3 includes area of lot 2 and needs to be pulled out. The dimensions on the easement need to be established. Mr. Morgan informed the commission that the developer will go to the City Council for a wavier on the following: 1. To allow aerial power. 2. From curb, gutter and sidewalks 3. From Industrial Zone. They also want to discuss the water system because of the great demand required by fire hydrants. Mike Metcalfe moved to recommend to the City Council to accept the preliminary Plat submitted by S & N Estates, a subdivision located in the City of Chubbuck Impact Area, subject to city engineers recommendations. Dean Wood seconded the motion. Roll call vote: Peters, ~ves; Metcalfe, yes; Allen, yes; Wood, yes; Stalder, yes; Cain, yes; Hopkins, abstained. PUBLIC HEARING ESTABLISHING THE AREA OF CITY IMPACT - Considering a proposed amendment to or substitution for Ordinance No. 177 with such amendment or substitution to provide further for allocating the responsibility for regulating land use and development between Bannock County and the City of Chubbuck with respect to the area of city impact continued from the March 6, 1980 meeting. Chairman Stalder opened the hearing. After consulting with Engineer Smart to see if any additional information was available, Richard Allen moved to table this item until further information is available. Dale Peters seconded motion, with all voting in favor. Mike Metcalfe moved, Dean Wood seconded, with full commission approval that meeting adjourn at 8:50 p.m. H.
