May 3, 1984
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building May 3,
1984.
Present: Chairman Pete Anderson, Commission Members: Myrna Cain,
Janet williams, Sue Parrish, Dee Stalder, Thomas Nield,
Ronald Nelson,Richard Allen, City Attorney B. Lynn Winmill,
Public Works Director Steven Smart, Secretary Dorothy Ward.
Robert Allen was excused.
Meeting called to order at 8:00 p.m. by Chairman Anderson.
Chairman Anderson asked for any additions or corrections to the
minutes of April 5, 1984. There being none, Sue Parrish made
motion to accept minutes as written. Myrna Cain seconded the
motion, with full commission approval.
PUBLIC HEARING ITEM:
1. REVIEW OF PRELIMINARY PLAT FOR THE MARANATHA SUBDIVISION
located in the Chubbuck impact area, lying south of Tyhee Road,
north of Siphon Road on the east side of Hawthorne Road, proposed
to be developed by the Idaho Christian Center, P.O.Box 2652.
Pocatello, Idaho.
Chairman Anderson asked for comments from Steven Smart. Mr.
Smart explainded that subdivision was in the county, but
within Chubbuck's Impact Area. He stated they were not
requesting annexation, but he felt city standards should
be required of the developer, so that if at some future
time they were annexed by the city, the subdivision should
meet city standards.
Robert W. Ford, Star Route, Box 43, Idaho Christian Center,
stated their church had purchased the eleven acres of
ground, they wish to subdivide, Keep %hr~e acres for
their church and school and sell the remaining acres. He
said they would use the money from the sale of lots [o
build their church. He said they operated a school for
their own children, which would probably never be more than
forty children.
Mr. Ford said they intended to have strict restrictions, that
mobile homes would not be allowed, and they wished to have
a limited number of animals. He said they would require
at least 1100 square feet minimum for the homes.
Myrna Cain asked if homes would be single family residences.
Ford said they would be for single family.

Commission Members questioned Mr. Ford about the road, curb,
gUtter and sidewalk§. Mr. Ford said their r~s~ri~tive
covenantS would require the people to put in curb, gutter
sidewalk, and paved road if and when the subdivision was
annexed by the city.
Attorney Winmill reminded the commission the city,does not
enforce restrictive covenants, that it is up to the home
owners to do so.
Chairman Anderson opened meeting for public comment.
David Klatt, 5645 Eve, Chubbuck, Idaho, representing Forsgren,
Perkins Engineers, said originally lookin~ at'a county
subdivision, and had planned for road according to county
specs, then had found out it wo~ld be in city impact area.
Gene Hancock, Rte #2,-Box 201, Pocatello, Idaho, exPressed
concern about public buildings being built on this
property and what controls would be enforced on zoning.
Attorney Winmill explained to the commission members and those
in the audiance, that the city had no control over the
zoning and what would be allowed on the property. The
City's subdivision ordinances was all the city had control
over, the remainder fell under county jurisdiction.
Don Hulse, Rte # 2, Box 199 E, Pocatello, Idaho, said he was
concerned about the water rights, that Fort Hall Irrigation
furnished water for all the property.
Arden Hansen, Rte ~2 Box 198, Pocatello, Idaho, said he would
like to go on record as opposing the subdivision. He said
he lived across the street, a~d was concerned about the
natural flow of water which would flow toward his home.
Doyle Ganske, Rte #2 Box 199D, Pocatello, Idaho, said he also
lived across the street and would be opposed to six wells
and six septic tanks that close to his property.
Chairman Anderson closed public testimony and opened meeting for
commission members discussion.
Attorney Winmill said nat necessarily because of ~6blic opinion
could the subdivision be denied as long as they are willing
to comply with city ordinances and would be willing to comply
with additional restrictions imposed by the commission, to
solve problems raised, such as drainage, sewer, water and
roads.
Commission members discussed:
Fiscal aspects of subdivision ordinance, such as
utilities, sewer, water, roads and drainage.
2. The water rights to the property.
3. The cost of hooking up to city sewer and water, from

Paradise acres.
Chairman Anderson asked Mr. Ford if, with what had come to light,
- he would be willing to come back in June, 1984, and maybe
be able to answer the questions that had been raised.
Mr. Ford stated they would come back in June, hopefully with the
answers needed.
Dee Stalder made motion to table the request of the Idaho Christian
Center, Maranatha Subdivision, for review of their preliminary
plat, until the June 7, 1984 meeting. Thomas Nield seconded the
motion.
At this time commission members discussed items that needed to be
clarified so that Mr. Ford would be able to furnish the
answers.
Thomas Nield said would have to be treated as any other subdivision.
He said to hook-up to the sewer and water from Paradise Acres
would be prohibitive. City standards should be required on
curb, sidewalk, gutter and roads and drywells.
He said he felt Fire Department should be consulted, as city
would be providing fire protection.
Mr. Nield stated that subdivision ordinance required park land
or money in lieu of, and this could not be waived. Attorney
Winmill said on a subdivision of this size, it would not be
a large dollar item.
Sue Parrish stated she would like to see the percolation report
from the Health Department.
Ron Nelson said if they installed a community well, the water lines
would be in, if at such a time the city annexed the subdivision.
Discussed if private wells and septic tanks installed, dry sewer
and dry water lines be installed.
Chairman Anderson called for vote on motion. Nield, yes; Nelson,
yes; Allen, yes; Cain, yes; Williams, yes; Parrish, yes;
StaIder, yes; Anderson, yes. Motion carried.
Ron Nelson made motion to adjourn at 9:30 p.m, with Richard Allen
All commission members voted in favor.
