Present: Chairman Peter Andersen, Commission Members: Myrna Cain, Janet Williams Ronald Nelson, Sue Parrish,iLeRoy Quick, Public Works Director Steven Smart, Secretary Myrna Crapo. Meeting was called to order at 8:00 p.m. by Chairman Andersen. Chairman Andersen asked for any additions or corrections to the minutes of June 7, 1984. There being none Janet Williams made motion to accept the minutes as written. Myrna Cain seconded the motion, with full commission approval. PUBLIC HEARING ITEM: PROPOSAL BY CONNIE MCKAY-WOOD, 922 Stanley, Chubbuck, Idaho. for a conditional use permit to construct a two family dwelling at 5067 Rose. Property is presently zoned General Residential (R-2). Chairman Andersen read the public hearing notification and asked for comments from the~City Staff. Steve Smart presented his comments. Chairman Andersen asked for comments from Conie McKay-Wood. She had none. Chairman Andersen then asked for comments from the floor for or against the proposal. There were no comments fr.om the floor. The public hearing'was then closed. Chairman Andersen opened the meeting to comments from the con, mission members. The commission discussed: " Zonings! for the area Setback requirements AmPle space available Landscaping of the area will be grass and will be maintained by the owners. Sue. Parrish moved to grant a conditonal use permit to Connie McKay-Wood to build a duplex at 5067 Rose. Ron Nelson seconded. Chairman Andersen called for a vote on the~motion: Parrish, yes; Wil.l~i~ams, 'yes, Cain, yes; Andersen, yes; Quick, yes; Nelson, yes. Chairman Andersen opened the public hearing on the proposal of Brent V. Simonson, 289 Canal Street, Chubbuck, Idaho for a Variance in the minimum required side year building setback to build a garage. Property is presently zoned General Residential (R-2). Chairman Andersen asked for comments from the city staff. Engineer Steve Smart explained his findings to the Commission. He informed the commission that a side yard variance would leave 2' rather than the 5' required. He also advise thecommission of a blanket variance that was issued in 1979 to the developer, so they could use thelside yard requirement from the. previous. ordinance, allowing a five foot side yard. Page 2 Land Use 6nd Development Commission JulY 5, 1984 Chairman Andersen asked Mr. Simonson for his comments. Mr. Simonson explained the~ history on the home and why they bought it. Chairman Andersen opened the hearing to the public for comments for or against the proposal. There being no comments thepublic hearing was closed. The proposal was opened to thecommission for discussion. They discussed: The neighborS feeTings, Possible solutions to the garage problem such as. 1) building on the back of the property. 2) buying 3' of ground from the neighbors. 3) building a one car garage. r~ad Chairman Andersen from the ordinance on the granting of variances and the. commission discussed it. Janet Williams made a motion to deny the request for a variance by Brent V. Simonsson, 589'Canal Street in the minimum required side yard building setback to build a garage-because the hardship was not serious and immediate and alleviating thelhardship will create a possible present or future hardship on other parties on Canal Street. Myrna Cain seconded it. Chairman Andersen called for vote on motion: Parrish, abstained; Williams, yes; Cain, yes; Andersen, yes; Quick, yes; Nelson, yes. Chairman Andersen informed Mr. & Mrs. Simonson of their right to appeal to the City CounCil within 25 days~ Myrna Cain made motion to adjourn at 8'40 p.m., with Sue Parrish seconding the motion.
