August 2, 1984
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building August 2,
1984.
Present: Chairman Pete Anderson, Commission Members: LeRoy
Quick, Ron Nelson, Sue Parrish, Janet Williams, Dee Stalder,
Myrna Cain, Public Works Director Steven Smart and Secretary
Dorothy Ward.
Meeting called to order at 8:00 p.m. by Chairman Anderson.
Chairman Anderson asked for any additions or corrections to the
minutes of July-S, 1984, there being none, Janet Williams
made motion to accept minutes as written. Sue Parrish
seconded motion Qith all commissiOn members voting in favor.
PUBLIC HEARING:
1. Review a preliminary plat for the Briscoe Subdivision,
1st Addition, a subdivision located east of Whitaker
Road, west of Highline and north of Vern, proposed to
be developed by Franklin Briscoe, 5058 Whitaker Road,
Chubbuck, Idaho.
Chairman Anderson asked for comments from city staff. Steven
Smart reported:
1. Subdivision across from a developed street, developed
for Briscoe Subdivision.
Subdivision consists of three lots, would recommend
it include lot of Mariano Ybarra, Jr.
A 50 foot street easement,for future development has
been requested, to the north. Mr. Smart would
recommend the 50' easement.

5. Curb in, but sidewalks are not in on these lots.
Mr. Briscoe said he would like to maintain the Fort Hall Irrigation
rights to these lots, if he could hook-up the pressure
system already in.
Chairman Anderson closed the public hearing and asked for comments
from commission members.
Commission members discussed with Mr. Ybarro his lot being
included in the subdivision. He stated he would be
agreeable to having it included. They then reminded
him it would be necessary for him to install side
walks on his property.
The discussion included the following:
1. Review of recommendations of Steven Smart.
2. Easements for utilities.
Sidewalks have been put in as lots have been developed
in the Briscoe Subdivision.
Sue Parrish made motion to recommend to the City Council to
approve the preliminary plat of the Briscoe Subdivision,
1st Addition, on condition that when any building permits
purchased on any of the lots, sidewalks should be built
when property developed.
Sue Parrish withdrew motion, with more discussion from commission.
Sue Parrish made motion to recommend to the City Council they
approve the preliminary plat of the Briscoe Subdivision, 1st
addition. With the stipulation when building permits are
requested and sidewalks installed on either side of Mr.
Ybarra's lot or when he requests a building permit, he be
required to put sidewalks on his property. That requirements,
made by law, concerning irrigation water be met and easements
furnished as needed. Commission recommends that Mr. Ybarra's
property to be included in the plat of the Briscoe Subdivision,
1st Addition. Janet Williams seconded the motion.
Roll call vote: Parrish, yes; Stalder, yes; Cain, yes;
Williams, yes; Quick, yes; Nelson, yes; Anderson, yes.
Dee Stalder made motion to adjourn at 8:45 p.m.
