July 9, 1987
Minutes of the regular meeting of the Land Use and Development Commission
held in the city municipal building, July 9, 1987.
Present: Chairman Pete Anderson, Commission members Sue P~rrish,',
Myrna Cain, Robert Allen, Larry Call, Bob Anderson, Councilmember Becky'
A. Hopkins, Attorney B. Lynn Winmill, Public Works Director Steven M.
Smart and City Clerk Ron C. Conlin.
Meeting called to order at 7'35 p.m. by Chairman Anderson.
Chairman Anderson introduced Mr. Larry Call as a new member of the Land Use and
DeVelopment Commission.
Chairman Anderson asked for any additions or corrections to the June 4, 1987
minutes. There being none, Sue Parrish made motion to accept the minutes
as mailed. Myrna Cain seconded.the motion, with all commission members
voting in favor of motion.
Chairman Anderson reviewed the rules for public hearings.
PUBLIC HEARING ITEM:
A proposal by Kal S. Kinghorn, 4832 Freedom, for a variance from the
minimum sideyard requirements to build a double car garage. Property is
presently zoned (R-2) Limited Residential.
Fire Chief Cary Campbell expressed concern that the parties invOlved shoutd make
some kind of an agreement. If they get under the 3' minimum, there will be some
rather restrictive items they will have to do to be in compliance with the
uilding code. The application asks_.fO~ avarianceof up to two feet of property

Public Works Director Steve Smart stated there is 9' on the north side of the home.
Kal Kinghorn, 4832 Freedom Ave. stated the reason he is asking for a variance,
is~ he~ has a 3 bedroom ranch style home and would like to install a ~ub~e.
car garage.
Chairman Anderson opened the public hearing.
SteWart Hartly, 4818 Freedom stated he is the neighbor on the south side of the
property. Mr. Hartly stated he was having trouble finding the property lines.
Mr. Hartly said he could find the property on the south side of his property,
but could not find the boundry on the north side. He asked if the City could
come to his home and establish the boundry lines. Engineer Smart said the City
does not have a survey crew and therefore does not take on that responsibility.
Attorney Winmill suggested the commission might require the landowner to have the
property line surveyed.
Robert Allen asked Mr. Hartly if he is' in disagreement with Mr. Kinghorn's applica-
tion. Mr. Hartly said he was not. he just wanted to understand all the
ramifications of the application.

Chairman Anderson closed the public hearing~and asked comment from the commission.
Robert Allen said he did not have a problem with the variance application, but,
he agreed the property boundaries should be surveyed~for exact distances.
Attorney Winmill stated the City does not have obligation to survey the property
boundaries_to establish the boundaries.
Robert Allen made a motion that the variance be granted to Kal S. Kinghorn,
4832 Freedom~for a minimum of two foot setback, subject to requirement of
surveying and establishing the property line. Sue Parrish seconded the motion.
A roll call vote was taken. Sue Parrish, yes; Myrna Cain, yes; Pete Anderson,
yes; Bob Anderson, yes; Robert Allen, yes; Larry Call, yes. The motion passed
unanimously.
STANDARDS FOR THE COMPREHENSIVE PLAN in reference to annexing, and changing of
current zoning to comply with current conditions.
Chairman Anderson asked the commission to read and review the standards that
Attorney Winmill had proposed and have their questions ready for the next
months meeting.
Chairman Anderson informed the commission that areas in the city are zoned
one way and actually being used in another way and that we need to take a
look at that zoning.
Chairman Anderson gave a report on previous discussions by the commission members.
Chairman Anderson stated the commission should invite residents from a certain
area to the next meeting, to get their input.
After discussion it was decided, the residents in Neider, Heights, Alturas Park, Roy
Subdivisions~wil]. be notified prior to the next Land Use and Development
Commission Meeting. The meeting will be afact finding~meeting. Anyone
interested is welcome to come and express themselves.
Chairman Anderson stated Attorney Winmill has drafted some goals and objectives
that should be incorporated into our Comprehensive Plan.
The commission was asked to read and review the standard% and have any questions
ready for the next commission meeting.
Sue Parrish moved to adjourn and Councilwom~Hg.~kins seconded. ?he meeting was
