Present: Chairwoman Sue Parrish, Commission Members: Pete Anderson, Myrna Cain, Bob Anderson, Kent Kearns; Councilman Dean Wood; Engineer Steve Smart, Project Engineer Gerd Dixon, Attorney Tom Holmes, Secretary Myrna Crapo. Meeting called to order by Chairwoman Sue Parrish at 8:00 pm. Chairwoman Sue Parrish asked for approval of the minutes as written and mailed· Kent Kearns asked for the following corrections: 1. On page 2 add s to restriction; 2. correct the spelling for depicted; 3. under item #2 after "satisfaction" insert the word "and". Kent Kearns moved to approve the minutes with those corrections. Myrna Cain seconded, with all commission members voting in favor. PUBLIC HEARING: A PROPOSAL BY DOUGLAS & LAREE ANDERSON, 848 W. 150 N. BLACKFOOT, ID FOR A CONDITIONAL USE PERMIT TO PLACE A DOUBLE WIDE TRAILER AT 312 ADAMS, property is presently zoned Limited Residential (R-2). Chairwoman Sue Parrish opened the public Hearing. Darold E. Burrows, 302 Adams told the commission that he had sold this piece of ground to the Andersons. They will be living next door to them and that they had no objections to the trailer. LaRee Anderson, 848 W. 150 N. Blackfoot, explained to the commission what the trailer looked like, and then showed some pictures of the trailer. They kept their yard well landscaped and had in the past won a Chubbuck Pride Award. Chairwoman Sue Parrish closed the public hearing and opened the meeting to discussion by the commission. The commission then discussed the type of foundation that was required by the chubbuck's code. LAND USE AND DEVELOPMENT COMMISSION JUNE 7, 1990 PAGE 2 Pete Anderson made a motion to grant the conditional use permit for Douglas and LaRee Anderson to place a double wide trailer at 312 Adams with the condition that it comply to all the building ordinances and the Land Use Ordinances regarding the Class II Production Dwelling in a R-2 zone. Myrna Cain seconded the motion. Roll Call Vote: Pete Anderson, yes; Myrna Cain, Yes; Bob Anderson, yes; Sue Parrish, yes; Kent Kearns, yes; Dean Wood, yes. GENERAL BUSINESS: DISCUSSION ON A PROPOSED ORDINANCE TO DEFINE ADULT BUSINESS in the schedule of Land Use Controls. Chairwoman Sue Parrish read the ordinance and then the commission discussed it. Pete Anderson moved to present this for a public hearing at the next regular Land Use Commission Meeting. Myrna Cain seconded, all commission members voted in favor. DISCUSSION ON A PROPOSED ORDINANCE TO DEFINE SELF-SERVICE STORAGE FACILITIES in the schedule of land use controls. Chairwoman Sue Parrish read commission then discussed: the ordinance. The 1. Storage units being used as a second business 2. Automotive repair by renters 3. Hazardous chemicals being stored. 4. Fire wall that would be required 5. Storage units behind apartments for tenants or for other renters. 6. C-2 Zone needing additional guidelines a. Paved asphalt b. Landscape c. Security fences 7. Being allowed conditionally in residential zones· a. needs to be compatible with the area The commission asked attorney Tom Homes to work on the ordinance and present it at the next meeting. The commJssion then discussed: a. The Deadline date b. Reasons for landscaping c. The way we want Chubbuck to look in the future Pete Anderson made a motion to hold a public hearing on this ordinance. Myrna Cain seconded the motion. All commission members voted in favor. Kent Kearns moved to adjourn at 9:30 pm with Dean Wood seconding. Su~ Parrish, Chairwoman Myrna'b~apo, secretarY' CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION FINDINGS OF FACT. CONCLUSIONS OF LAW AND DECISION This matter having come before the Commission for public hearing pursuant to public notice as required by law, on June 7, 1990, upon the application of Douglas and LaRee Anderson (hereinafter referred to as "applicant") for a conditional use permit to place a double wide mobile home (production dwelling) on the real property located at 312 Adams and the Commission having heard testimony from interested parties and being fully advised in the matter, now makes the following: FINDINGS OF FACT 1. Applicant has applied for a conditional use permit as particularly described above. 2. All legal requirements for notice of public hearing have been met. 3. The property in question is zoned R-2 - Limited Residential pursuant to the Land Use Ordinance of the City of Chubbuck. 4. The property is designated as R-2 - Limited Residential in the duly adopted Comprehensive Plan of the City of Chubbuck. 5. Relevant criteria and standards for consideration of this application are set forth in Idaho Code section 67-6512 and in Chubbuck Code section 18.28.040 (C). 6. The facts relevant to an evaluation of the relevant criteria and standards are as follows: A. This unit will meet the requirement of a Class II Production Dwelling as set forth in Section 18.04.050(P)(2) of the Chubbuck Municipal Code. B. LaRee Anderson was present and passed around photographs of the unit as it now sets in its present location in Blackfoot, Idaho. C. Testimony from Darrell Buroughs, 302 Adams Drive, who sold the lot to applicant, was received in support of the application. D. Written testimony from Troy and Lou Galloway was received showing no opposition to the application. FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - Page 1 chbbck06.132 E. No one else appeared in favor of or against the application. F. Applicant will put a concrete foundation under the unit. G. Other production units are located in the vicinity of 312 Adams. BASED UPON THE FOREGOING FINDINGS OF FACT, the Land Use and Development Commission hereby enters the following: CONCLUSIONS OF LAW 1. The use for which the permit is sought will not be injurious to the neighborhood or otherwise detrimental to the public health, safety or welfare. 2. The permit sought will not produce an adverse impact on the economic values of adjacent properties. 3. The permit sought will not produce a negative impact on transportation facilities, public utilities, schools, public parks, or the natural environment any greater than had the strict terms of the Land Use Ordinance been complied with. 4. The noise and traffic conditions generated by the use for which the permit is sought, when analyzed in conjunction with the noise and traffic conditions now exiting does not indicate that the permit should be denied. 5. The use for which the permit is sought shall not work an unreasonable hardship upon surrounding property owners by virtue of its physical natures or by the impact of changes made in the landscape of the land. 6. The aesthetic qualities of the proposed use will not conflict with aesthetic qualities of the surrounding lands. 7. The adverse impact of the proposed use on other development within the City has been minimized by Applicant as much as is reasonably possible. 8. Owners of adjacent property have expressed approval of the issuance of the requested conditional use permit. 9. The requested conditional use permit, if granted, should be maintained subject to the conditions set forth below. FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - Page 2 chbbck06.132 DECISION 1. The Land Use and Development Commission, pursuant to the foregoing, finds that the request of the applicant should be approved. 2. The following conditions, if any, are hereby imposed upon the granting of said conditional use permit and applicant, by taking advantage of said conditional use permit agrees to the imposition of the same: All land use and building code requirements for putting a class II production dwelling in an R- 2, Limited Residential area must be followed. 3. The conditional use permit requested by the Applicant is granted, subject to the foregoing conditions. DATED this 2- day of , 1990.
