Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building March 19, 1992.
Present: Chairman Kent Kearns, Commission Members: Mary Harker,
Betty Poole, Richard Pearson, Pete Anderson, Myrna Cain, Gayle
Anderson; Council Representative LeRoy Quick, Attorney Tom
Holmes, Public Works Director, Steve Smart and Secretary Myrna
Crapo.
Chairman Kent Kearns called the meeting to order at 8:00 PM.
Chairman Kearns asked for approval of the March 5, 1992 minutes.
Myrna Cain moved to approved the minutes as mailed with Mary
Harker seconding. Ail commission members voted in favor.
Chairman Kearns asked if any member of the commission had a
conflict of interest with anything on the agenda. There was
none.
PUBLIC HEARING
1. A PROPOSAL BY AMERICAN HERITAGE for a chance in Land Use
District upon requested annexation to Single Family
Residential IR-l) for property located on the north end of
Freedom and Independence Streets.
Chairman Kearns opened the public hearing.

The public hearing was then closed. The meeting was then
opened up to discussion by the commission.
The park dedication fee was discussed and the
construction was to be done under the new standards.

Pete Anderson moved to recommend to the city council
annexation of this property with the designation of an R-1
zone and with the park contribution as worked out between the
city and the developer. Myrna Cain seconded.

2. AN APPLICATION BY AMERICAN HERITAGE INC, FOR A REVIEW OF
PRELIMINARY PLAT OF HERITAGE WEST NO. 3 SUBDIVISION, a
subdivision located on a tract of land at the north end of
Freedom and Independence Streets.
Chairman Kearns asked for input from the city staff. The
commission discussed neighborhood mail box units being
indicated on the plat. These mail boxes would fall inside the
utility easements.
Chairman Kearns opened the public hearing and asked for public
input. There was none and the hearing was closed. It was
then opened to commission discussion.
Pete Anderson recommended approval of the preliminary plat of
Heritage West #3 Subdivisions with the indication of the
neighborhood mail box units to be included on the final plat.
Mary Harker seconded the motion.

3. A PROPOSAL BY ROY J. LACEY, 12411 NORTH COREY LAND FOR A CHANGE
IN LAND USE DISTRICT UPON REQUESTED ANNEXATION to Single
Family Residential (R-1 and Limited Residential (R-2) a
subdivision located on the west side of Hawthorne Road 5500
block. Chairman Kearns opened the public hearing.
Kent Hill, 5321 Hawthorne Road, expressed his concerns for the
safety of pedestrians walking along Hawthorne Road. They can
only walk on the one side and the traffic on Hawthorne Road is
heavy.
Glenna Kelin, 5564 Hawthorne Road, told the commission that
she had two elementary age children who walked to Chubbuck
School. The school district asked them to send their children
to Ellis so a bus could pick them up in front of her home as
the school district didn't want to be responsible for the
safety of her children as they walked down Hawthorne Road.
The corner at Siphon and Hawthorne Road has caused problems
for school buses turning there.
When there was a fire at Chandlers the fire truck had
difficulty because of that intersection.

Ray England, 11953 N. Hawthorne Road had talked to the
Pocatello Urban Transit employees and they had to change their
routes because of the Hawthorne and Siphon intersection.
Maggie England, 11953 N. Hawthorne Road reviewed for the
commission part of Chapter 18 of the supplemental controls.
Chairman Kearns closed the public hearing and opened it up to
commission discussion.
The commission then discussed:
1. comprehensive plan and transportation problem, whether they
were the same issue or separate. It is a transportation
problem and not a zoning problem.
2. Future street widening on Hawthorne, using the 14' easement
on the canal bank.
3. Sidewalk to be put in front of this subdivision.
4. The routes of the fire truck in this area.
Richard Pearson moved to recommend to the city council
approval of the change in land use district upon requested
annexation to single family R1 and Limited Residential R2; a
subdivision located on the west side of Hawthorne Road 5500
block. Myrna Cain seconded the motion.
The commission then discussed including the park dedication
fee in the motion.
Richard Pearson amended the motion to include the park fees as
part of the annexation into the city. Myrna Cain seconded the
amendment.

Pearson, yes; Kent Kearns, yes; LeRoy Quick, yes; Myrna Cain,
yes; Gayle Anderson, no.
4. An application by Roy J. Lacey, for a review of preliminary plat
of Espie Subdivision, a subdivision located on a tract of land
on the west side of Hawthorne Road 5500 block.
Chairman Kearns asked for input from the city staff. Steve
Smart, Public Works Director discussed items in Exhibit "A"
that had been prepared'by Attorney Tom Holmes to help address
the problems that had been brought up at the previous
meetings.
1. Water System. A 6" water lines would be sufficient.

2. Traffic: 1500 vehicles per day instead of 3,000 per day as
previously thought.
The streets need to be developed & widened down the road. The
impact of this subdivision is very small.
3. Sewer Easement: Is serviceable within the easement.
Lacey agreed to move the park to the west end.

4. Lot Size: Costs less to maintain utilities pass the lots.
From valuation stand points smaller lots are more economically
reasonable for the city.
Attorney Tom Holmes discussed with the commission the changes
that the council had done from the previous Land Use
recommendations.
1. Required the park to be completed including turf,
sprinklers and 6' fence.
2. They moved the stubbed 2nd entrance to the north part of
lot 9 block 2.
3. The council advised Mr. Lacey that future development might
not be approved without a double access.
Chairman Kearns explained the format for the public hearing.
Ray England reviewed a copy of the letter Kent Kearns had
received from the attorney on the format of the meeting.
There was a discussion by the people present on the format
that Chairman Kearns had proposed.
Chairman Kearns opened the public hearing.
Roy Lacey, 12411N. corey Lane told the commission that he had
followed comprehensive plan. He would like to see it ok'd.
Kent Hill reviewed exhibit "A" that had been previously
discussed with his version.
1. Bigger lots would upgrade the subdivision.
2. An 8" water line would be better as it would allow future
subdivisions the needed water flow.
3. Valuation as figured was incorrect as it didn't take into
consideration the home owners exception.
4. There had been bad impressions created by allowing work to
begin on the sewer and the city inspecting it.
A ten minute recess was called because of the heated
discussion.

Ray England asked the commission to consider:
1. The present circumstances, such as traffic, water size,
etc. that were present now.
2. Perimeter fence around the property
3. Sewer lines situated on the property
4. Asked Mr. Smart, PWD, about the traffic count, whether
there was more cars on Hawthorne or Siphon. Mr. Smart
informed him that Siphon Road had 1,600 while Hawthorne Road
had 1,300.
Maggie England talked about:
1. Solar heating in place of wood stoves
2. Looking closer at pedestrian safety
3. Requiring sidewalk on west side of Hawthorne in front of
this subdivision. She doesn't want sidewalks there because
the other land owners will be expected to do the same thing;
and she doesn't want to.
4. Larger lots being profitable.
5. Fence on perimeter
Debbie Wagner, 5359 Hawthorne asked Steve Smart, PWD, about
permits required to hook onto the sewer.
Jay Christensen, 15170 W. Lacey road spoke in favor of the
preliminary plat, as a realtor he can see the need for
additional affordable housing in the area.
Tim Shurtliff, Shurtliff Engineering addressed:
1. Traffic problems at Hawthorne and Siphon need correcting.
That problem will be there whether this subdivision goes
forward or not.
2. Water nets grow as the city grows.
3. Residents always abuts agricultural unless it is internal
growth.
Sandy Pickens, 5333 Hawthorne, Since it is in the middle of an
agricultural area, we would like larger lots and bigger houses
to compliment ours.
Dan Wagner, 5359 Hawthorne Works for a sign company. Darris
Ellis, a contractor can't sell lots in Paradise Acres so he
has gone to Highland area to build.
Maggie England, is asking for larger homes and bigger lots
similar to those in surrounding area. Kent Kearns
closed the public hearings.
Kent Kearns addressed some of the points brought up:
1. Small lots bringing in inadequate revenue is questionable.
What costs the city more is blank lots within the city.

2. The on going work of Mr Lacey's is a gamble, but it is his
right.
3. Supplemental contrOls section as far as the Land Use is
concerned is when commercial adjoins residential. Screening
fences are not required between R-1 to Agriculture.
Gayle Anderson felt that with larger lots you have a greater
chance of weeds. The best and most proficient use of the
ground is small lots.
Chairman Kearns reviewed the petition items one by one and
asked Mr. Lacey to look at putting them in the restrictive
covenants as a good will jester.
Richard Pearson made a motion to recommend to the city council
the acceptance of the application by Roy J. Lacey, for a
review of the preliminary plat of the Espie Subdivision, a
subdivision located on a tract of land on the west side of
Hawthorne Road 5500 block with the following conditions:
1. Move the park to the Southwest corner from where it was
originally approved
2. Loop the water lines
3. Stub through lot 9, block 2
4. Take out the walk way

A PROPOSAL BY THE CITY OF CHUBBUCK TO AMEND THE CHUBBUCK LAND
USE ORDINANCE ADDING DEFINITION OF SCREENING FENCE AND SOLID
FENCE to the general land use definitions and amend
conflicting sections of the code.
Chairman Kearns asked for any additional city input. The
public hearing was then opened. There being no comments the
hearing was closed and opened to discussion by the commission.
Myrna Cain moved to recommend to the city council that they
adopt the amendment to the Chubbuck Land Use Ordinance adding
definition of screening fence and solid fence to the General
Land Use Definitions and amend conflicting sections of the
code. Mary Harker seconded. Roll call vote: Mary Harker,
yes; Betty Poole, yes; Richard Pearson, yes; Kent Kearns, yes;
Pete Anderson, yes; LeRoy Quick, yes; Myrna Cain, yes; Gayle
Anderson, yes.
