HomeMy WebLinkAbout012 03 92LAND USE AND DEVELOPMENT COMMiSSiON December 3, 1992 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal building December 3, 1992. Present: Chairman Kent Kearns, Commission Members: Myrna Cain, Richard Pearson, T. Kent Hill, Pete Anderson, Attorney Tom Holmes, Public Works Director Steve Smart, Project Engineer Gerd Dixon and Secretary Myrna Crapo. Chairman Kent Kearns called the meeting to order at 8:00 P.M. Chairman Kearns asked for approval of the November 5, 1992 minutes. Myrna Cain moved to approve the minutes with T. Kent Hill seconding. All commission members voted in favor. GENERAL BUSINESS: DAVID WESSELL with Bannock Planing organization gave a presentation on general INTRODUCTION iNTO THE COMPREHENSIVE PLANING. The Comprehensive plan is a guide to the future to be used to identify some problems and possible solutions to those problems. We would produce the plan together considering i. vision/utopian and 2. negotiations. Some of the elements in the comprehensive plan are 1. land use, 2. population, 3. natural resources, 4. economic development,etc. The commission expressed a desire to hold the third and fourth sessions jointly with the city council, so we could have a common understanding of what we were trying to achieve in the city. Discussion on a proposed ordinance to REQUINE CONDITI©NAL USE PE~MI'I' WiTH RESPECT TO ALL COMMERCIAL ON iNDUSTRiAL USES OF LAND WHICH HAVE NEGULAR OR CONTiNUiNG MO'I'ON VEHICLE TNAFFIC AND WHICH AREAS THE LANDOWNER DOES NOT WISH TO PAVE ON OTHERWISE SURFACE. The commission reviewed the proposed ordinance and discussed: 1. Using the conditional use permits to help regulate. 2. Having a plan that would fit everyone without so many variances. 3. The need to streamline this proposed ordinance LAND USE AND DEVELOPMENT COMMISSION December 3, 1992 4. The creating of problems such as at Briarwood where use of the property has created a road. Paving needs to be required because of use. 5. The car lot across from Cowboy Oil where we couldn't require paving or landscaping, etc. because of the current ordinance. 6. The need to require paving the access to the parking area. 7. The hard surface from paving creating a water problem, and makes it necessary to have dry wells. 8. Every use not needing a hard surface unless it is not being maintained. Sometime a compacted gravel sprayed with oil can be good. 9. Conditional use on case by case basis. i0. individual cases could be identified and examined in a design review. 1i. What would trigger enforcement. 12. How much is too much traffic on a lot. 13. A conditional use is easier to defend in court than requiring paving because of a nuisance. 14. Not fitting a conditional use. A site review would be better. Attorney Tom Holmes was to rewrite this ordinance incorporating the suggesting received from the Land Use Commission and present it for the next meeting. Discussion on a proposed ordinance to BAN RAILROAD CARS, TRUCKS, TRAILERS, VANS, AND OTHER SiMiLAR STRUCTURES FROM BEING USED AS ACCESSORY STRUCTURES FOR STORAGE OR OTHERh'ISE. Pete Anderson moved to present this ordinance at the next Land Use meeting for a public hearing. Richard Pearson seconded the motion; with all commission members voting in favor. APPROVAL OF FiNDiNG Ob' FACTS AND CONCLUSIONS Ob' LAW ON MELVIN JACKSON. Richard Pearson moved to approve the finding of Fact and Conclusions of Law on Melvin Jackson· Pete Anderson seconded with all commission members voting in favor.
