Present: Chairman Kent Kearns, Commission Members: Myrna Cain, Richard Pearson, Mary Harker, Pete Anderson, Council Member, Dean Wood; Attorney Tom Holmes, Project Engineer Gerd Dixon, and Secretary Myrna Crapo Chairman Kent Kearns called the meeting to order at 8:00 p.m. Chairman Kearns asked for approval of the minutes of November 4, 1993. Mary Harker moved to approve the minutes as mailed with Myrna Cain seconding. Ail voted in favor. PUBLIC HEARING: Chairman Kearns asked if any of the commission members had a conflict of interest. There was none. A PROPOSAL BY THE CITY OF CHUBBUCK TO REQUIRE PAVED DRIVEWAY CONNECTING THE PUBLIC RIGHT OF WAY WITH ANY REQUIRED OFF- STREET PARKING SPACES; TO REQUIRE APPROPRIATE STRIPING. Chairman Kearns opened the hearing for public comments. Lily Tydeman, 5008 Yellowstone asked the commission to explain this ordinance. Attorney Tom Holmes explained that this ordinance would require the drive way into paved parking be hard surfaced. This is not for existing businesses, unless a change in the business triggers the ordinance. The public testimony was closed and opened to the commission for discussion. Pete Andersen moved we recommend to the city council to adopt this ordinance. Myrna Cain seconded the motion. Roll call vote: Myrna Cain, yes; Richard Pearson, yes; Pete Anderson, yes; Kent Kearns, yes; Mary Harker, yes; Dean Wood, yes. A PROPOSAL BY THE CITY OF CHUBBUCK TO ALLOW A CLASS III PRODUCTION BUILDING TO BE USED AS A PRODUCTION BUILDING SALES OFFICE. The commission discussed what a class III production building was. this ordinance would only allow Class III in production building sales sites. Land Use and Development Commission Page 2 December 2, 1993 The hearing was opened for public comments, there was none so Chairman Kearns opened it to the commission. Pete Anderson moved that we recommend to the city council to adopt this ordinance. Mary Harker seconded. Roll call vote: Myrna Cain, yes; Richard Pearson, yes; Pete Anderson, yes; Kent Kearns, yes; Mary Harker, yes; Dean Wood, yes. Chairman Kearns closed the public hearings. GENERAL BUSINESS: 1. A request by Gary Long to build a duplex at 131Hiway Avenue. Gerd Dixon, project engineer, explain that the Land Use Commission had to define the geographical area. This duplex was required to come before the land use so we could determine the geographic area. We need some guidelines on what needs to be considered to formulate a geographical area. The subdivision area would work for this application, but might not in all areas. Gary Long, 131Hiway, explained that this would be a family apartment. They weren't aware of this limitation until they received a letter from Steve Smart. They had requested a new address and this triggered the letter. The commission then discussed this request. Pete Anderson moved that we recognize Hiway Acres Subdivision as a geographical area since it is virtually an island of residential development being bordered on all sides by either vacant property or commercial general zone; and to allow the duplex to be built. Myrna Cain seconded. Roll call vote: Myrna Cain, yes; Richard Pearson, yes; Pete Andersen, yes; Kent Kearns, yes; Mary Harker, yes; Dean Wood, yes. The commission then discussed: 1. The need to identify where we can have duplexes. We need a definition of how may duplex's could be put in a subdivision. 2. The need to take a look at this ordinance as there are some potential problems. 3. Attorney Holmes to come up with some items for discussion concerning this requirement. Land Use and Development Commission Page 3 December 2, 1993 Councilman Dean Wood asked for the commissions feeling on building homes with smaller lot sizes as they were doing in part of Idaho Falls. The commission then talked about: 1. Allowing smaller lots than our minimum lot sizes so people can have a less expensive home. 2. Affordable housing districts being created within Chubbuck 3. Using Planned Unit Developments to create smaller lot sizes. 4. Attorney Tom Holmes to get a copy of the Idaho Falls ordinances for land use requirements. e rns, Ch i%man yrna ~rapo, Secre~ary
