HomeMy WebLinkAbout009 01 94 LAND USE AND DEVELOPMENT MEETING September 1, 1994 Minutes of the regular meeting of the Land Use and Development Commission held in the city municipal building. Present: Chairman Kent Kearns~ Commission Members: Mary Harker~ Gayle Anderson, Pete Anderson; Council Representative Dean Wood; Attorney Tom Holmes, Project Engineer Gerd Dixon, Public Works Director Steve Smart and Secretary Myrna Crapo. Chairman Kent Kearns called the meeting to order at 8:15 PM. Chairman Kearns asked for approval of the minutes of the August 4, 1994 meeting. Dean Wood moved to approved the minutes with Gayle Anderson seconding. All voted in favor. Chairman Kearns asked if any of the commission members had a conflict of interest. There were none. PUBLIC HEARING: A PROPOSAL BY CHUBBUCK UNITED METHODIST CHURCH, P.O. BOX 5419, FOR A CONDITIONAL USE PERMIT TO ALLOW A CHURCH AT 5147 WHITAKER ROAD. Property is zoned limited residential (R-2). Chairman Kearns asked Gerd Dixon if he had any additional comments. He pointed out that the conditional use for the previous church was not transferable and required a new conditional use permit for the United Methodist Church. Karen Jackson, 4916 Easy representing the church explained to the commission they wanted two signs, one in front and the other on Whitaker and Chubbuck Road (off site.). Karen Jackson gave attorney Tom Holmes a drawing showing the proposed sign. Steve Smart informed the commission that Cary Campbell had advised her to add the sign request to the application and address it at that time. The church would like to replace the wording on the current sign. The commission then discussed the need to make a motion on the sign at this time. It was decided to have the city staff review it at a later time. ~ The hearing was opened to public testimony; there being none it was closed and opened to the commission for discussion. Dean Wood moved to approve the conditional use permit at 5147 Whitaker Road, with Mary Harker seconding. Land Use and Development Commission Page 2 September 1, 1994 AN APPLICATION BY FRANKLIN BRISCOE, 5058 WHITAKER FOR A REVIEW OF A PRELIMINARY PLAT OF BRISCOE SUBDIVISION, PHASE III, a subdivision located between 5100 and 5200 Whitaker Road. Property is presently zoned limited residential (R-2). Franklin Briscoe, 5058 Whitaker Road explained this application. Ralph Henderson and the Beeches wanted to buy some land from him. The commission discussed curb, requirements and drainage problems. gutter and sidewalk Attorney Holmes felt that the city needed to require a sidewalk the same as they did for Shiozawa property. The Commission discussed the need for the city to be consistent with requiring this of everyone. If we wait until the ground is developed before requiring the sidewalks it would probably take an L.I.D. to do the whole street at once and that would triple the cost. It would be better to put it in at this time. Mr. Briscoe stated he didn't want to put sidewalks in. The public hearing was then opened to public testimony and there being none the public testimony portion was closed and opened to commission for discussion and a motion. Pete Anderson moved that we recommend the city approve the preliminary plat for Briscoe Subdivision Addition #3 with the condition that the curb and gutter not be required, but the sidewalk be required along with the drain swell according to the city Engineers standards for that area. Dean Wood seconded. Roll call vote. Pete Anderson, yes; Kent Kearns, yes; Mary Harker, yes; Dean Wood, yes; Gayle Anderson, no. AN APPLICATION BY ROBERT & GLORIA BACH, 4200 PHILBIN ROAD #35, FOR A CONDITIONAL USE PERMIT TO PLACE A MANUFACTURED HOME ON lot #2, block #5 phase II, Briscoe Meadows Subdivision, (lot west of 252 Briscoe Road). Property is presently zoned limited residential (R-2). Robert Bach, 4200 Philbin Road #35 explained to the commission that they would be moving a $68,000 1993 manufactured home on a permanent foundation with a $8,900 garage behind. The address would be 272 Briscoe Road. Chairman Kearns opened the meeting to public testimony, there being none he closed that portion of the public hearing and opened it to the commission for a discussion and a motion. Land Use and Development Commission Page 3 September 1, 1994 Pete Anderson made a motion that we approve the conditional use permit for Robert and Gloria Bach at 272 Briscoe Road to place a production dwelling on the property with the condition that the conditional use permit be transferable at the sale of the house. Gayle Anderson seconded the motion with a roll call vote. Pete Anderson, yes; Kent Kearns, yes; Mary Harker, yes; Dean Wood, yes; Gayle Anderson, yes. GENERAL BUSINESS: Chairman Kearns informed the commission of the upcoming Idaho Planning Association Fall Conference in Twin Falls October 26, 27 and 28th. The commission discussed the need to send whoever could go. Chairman Kearns was the only person who might be able to attend the meeting. It would involve staying over night. The commission discussed having the city pay for the conference. Dean Wood, the council representative felt that it would be a good thing for the city to do. Myrna Crapo, secretary was directed to contact Richard Pearson and Myrna Cain to see if either of them could attend. Discussion on a proposal by the City of Chubbuck amending section 18.14 to clarify the amount of a landscaped area that may be in non grass or ground cover. The commission discussed different ways ordinance might be changed: in which this 1. Showing 5' on center for shrubby instead of the 10'. 2. Putting it through the design review committee 3. Requiring sprinkler irrigation 4. Requiring a minimum shrub size 5. A change of significant occupancy or remodeling to require the landscaping. 6. a list of drought resistent plants. Peter Anderson moved to submit this to public hearing on the next months meeting with Mary Harker seconding. All voted in favor. Approval of findings of fact for James E. Thilmont. moved to approve the finding of facts of James E. with Mary Harker seconding. Ail voted in favor. Dean Wood Thilmont Study Sessions. The study session will be held every 4th Thursday at 7:30 pm if there is a significant subdivision or a controversial issue. Land Use and Development Commission Page 4 September 1, 1994 The staff needed to decide if a meeting was necessary and to let the commission members know if there would be a study session for that month. David Wessel, Planner and Project Manager for Comprehensive Plan. David discussed having the study sessions being used for work sessions on the comprehensive plan. Dean Wood suggested inviting the council to the next planning session September 22 at 7:30 pm. David Wessel then discussed with the commission: 1. Previous maps that have been drawn and the fact that there are very few streets going straight through in the city. 2. The land uses, community design and long term transportation objectives. 3. The city buying the land for collector streets. To create infill we need collector streets in the city. 4. The city could create incentives by a. tax increments, b. utility hook-up, c. density bonus. 5. An interchange at Siphon Road and E. Chubbuck Road. 6. Using zoning patterns at Siphon Road for incentive to have private individuals build the interchange. Kent Kearns, Chairman rna C~apo, Secretary
