Cotant, Steven M. England, David Thomas J. Holmes, Public City Clerk Ron C. Conlin. Jr., Council members Leroy S. Quick, A. Landor, W. Dean Wood, Attorney Works Director Steven M. SmaPt and Meeting was called to order at 7:30 p.m. by Mayor Cotant. PURPOSE OF SPECIAL MEETING is to discuss a petition for change in liquor sales hours. PETITION - A petition to the City of Chubbuck for a 2:00 a.m. closing time for all Chubbuck Night Clubs: also the privilege to purchase beer, wine and liquor on Sundays, was presented to Mayor Cotant and Council at the February 27, 1990 Council Meeting. After discussion, Attorney Holmes was directed to draft an amended ordinance, for presentation at a Special Meeting, March 6, 1990, at 7:30 p.m. ORDINANCE 329 - An ordinance, amending Section 5.12.030 to bring it into compliance with Idaho Code; amending Section 5.12.090 to allow Sunday sale of beer; adopting a new Chapter 5.08 to revise and update Chubbuck's liquor-by-the-drink ordinance; adopting a new Chapter 5.16 to revise and update Chubbuck's wine ordinance; validating 1990 licenses issued prior to passage of this ordinance; adopting Section 9.08.110 to provide for when patrons must leave the premises. The intent of Ordinance ¢329 is to adopt an ordinance to allow Sunday sales of beer, liquor and wine. Further the ordinance will revise and update Chubbuck's liquor by-the- drink ordinance and bring provisions of other existing alcoholic beverage ordinances into compliance with ~daho Law. Attorney Holmes presented and gave an explanation of Ordinance ~329. Bob Walker, Five Mile Inn stated the Chubbuck night clubs want to be competitive with the City of Pocatello night clubs, the Sunday sales would help. Councilman England suggested, if the ordinance is adopted, it would be a good idea to review the ordinance every three ct six months for problems that might occur. Mayor Cotant stated, if there is a problem the Police Department will notify the Mayor and Council, Councilman Wood asked Asst. Chief of Police Jerry Rowland, if 51 ORDINANCE ~329 - (Cont.) this ordinance is adopted, would it require officer in the department. APC Rowland said, department has enough man power to cover. an extra police at this time the Dwain Kinghorn, 145 Hiway Ave. said in the past, he has always voted against liquor sales on Sundays, but, the City of Chubbuck has changed so much in past years, that he feels the council should let Chubbuck night clubs do business on Sundays, so they can compete with the City of Pocatello night clubs. Mr. Kinghorn stated the Police Department has advanced and is stronger than it was in the past. Mayor Cotant and Attorney Holmes read Ordinance ¢329 in full for the first reading. City Clerk Conlin was directed to put Ordinance ~329, on council agenda every three months for review. Councilman Quick moved to dispense with the rule of reading Ordinance ~329 on three separate occasions. Councilman Landon seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Wood, yes. Councilman Wood moved to adopt Ordinance ¢329 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Wood, yes. Conlin, City Clerk CALL OF SPECIAL MEETING CITY OF CHUBBUCK Pursuant to Idaho Code Section 50-604, the undersigned Mayor of the City of Chubbuck, Idaho, hereby calls a special meeting of the City Council to be held at the Chubbuck Municipal Building, 5160 Yellowstone Avenue, at the hour of 7:30 p.m., on the 6th day, of March, 1990.
