COUNCIL MEETING MINUTES
February 27, 1990
Minutes of regular meeting held in the city municipal building,
February 27, 1990.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landor, W. Dean Wood, Attorney
Thomas J. Holmes, Project Engineer Gerd S. Dixon and
City Clerk Ron C. Conlin. Public Works Director Steven N.
Smart was excused.
Meeting was called to order at 7:29 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to the minutes of February 13, 1990.
Councilman Quick moved to approve the February 13, 1990
minutes as read. Councilman Wood seconded. All councilmembers
voted in favor of motion.
PETITION - LIQUOR SALES - David Hegsted, Green Triangle presented
a petition to Mayor Cotant and Council, requesting a 2:00 a.m.
closing time for Chubbuck Night Clubs; also request the
privilege to sell beer, wine and liquor on Sundays, at such
Night Clubs.
Mr. Hegsted stated he felt, the night clubs in Chubbuck are
at an unfair advantage, because the City of Pocatello's night
clubs can sell beer, wine and liquor on Sundays. Mr. Hegsted
said the petition included all bar patrons, not just Chubbuck
residents.
Asst. Police Chief Jerry Rowland said he felt, changing the
hours would not be too much of a burden on the Police
Department. Assr. Chief Rowland said he was in favor of night
clubs in Chubbuck selling on Sundays, but, not allowing night
clubs to have a 2:00 a.m. closing time.
Bob Walker, Five Mile Inn stated, he felt it is important, not
to let the City of Pocatello bars take Chubbuck dollars
because of Chubbuck night clubs, not being able to open on
Sundays. Mr. Walker was in favor of night clubs being open
on Sundays. Mr. Walker said he would probably not be open most
Sundays, with the exception of Super Bowl Sunday, rodeos,
special events, erG,
Councilman England suggested an ordinance be drafted, then
presented at a Special Council Meeting, March 6, 1990, at
7:30 p.m.
FINAL PLAT - NHITAKER PLACE - Project Engineer Gerd Dixon presented
a final plat for Whitaker Place Subdivision, then gave a
report on it.

Project Engineer Dixon said the final plat complies with all
aspects of Titles 16 and 17 of City Code.
Discussion about what triggers installation of the sidewalks.
Attorney Holmes said the January 9, 1990 minutes reflect;
"Requiring sidewalks to be installed after the homes are
built, with curb and 9utter requirement being waived".
Councilman Quick suggested the council take time, to invite
residents on Whitaker Road in, and talk to them about,
installing sidewalks.
Councilman England moved to accept the Whitaker Place
Subdivision Final Plat. Councilman Quick seconded. All
councilmembers voted in favor of motion.
ORDINANCE - An ordinance, amending Section 5.04.020 of the Chubbuck
Municipal Code to provide for a higher business license fee
for temporary businesses to reflect the increased costs of
investigating those types of businesses and dealing with
complaints after said business closes.
Attorney Holmes in discussing with FC Campbell, said the
sixty days might be the wrong approach, because what we are
really concentrating on is a temporary business, that is not
in a permanent structure. In Attorney Holmes redraft he
deleted, an talked about something conducted from a hotel or
motel room, or out of a trailer or permanent structure, also
added a provision excluding fund raising activities by youth
groups.
After discussion, it was decided to table the ordinance until
the council can get copies of the redraft. The ordinance will
be on the March 13, 1990 Council Meeting Agenda
ORDINANCE ¢328 - An ordinance, amending Section 18.12.020 (a) of
the Chubbuck Municipal Code to coordinate standards for
intersection visibility with the Idaho Code Section 49-211.
Mayor Cotant read Ordinance #328 in full for first reading.
Attorney Holmes said this ordinance will conform Chubbuck Code
to Idaho Code.
Councilman Wood moved to dispense with the rule of reading
Ordinance ¢328 on three separate occasions. Councilman Landon
seconded. Roll Call Vote: Quick, yes; England, yes; Landor,
yes; Wood, yes.
Councilman England moved to adopt Ordinance #328 as read.

AMERICAN FAMILY INSURANCE PRESENTATION - Cindy Shaffer, American
Family Life Ins. was present and gave a presentation.
CLAIM - W.H. WOOD - Asst. Police Chief Rowland stated Mr. Wood owns
three duplexes on Chastain Drive. APC Rowland said members of
a 9ars lived in these complexes. APC Rowland said the police
Department had to go to Mr. Wood with search warrants, and get
his cooperation in helping with the drug bust. This claim is
for breaking down the doors during the raid. Mr. Wood's
insurance paid the claim except for the $500.00 deductible.
Mr. Wood is asking the City to pay the $500.00 deductible.
APC Rowland suggested the council approve the claim.
Councilman England moved to approve paying the $500.00 claim
to Mr. Wood. Councilman Landon seconded. All councilmembers
voted in favor of motion.
CLAIMS- Computer print-out and hand check claims presented to Mayor
Cotant and Council.
Councilman Quick moved to approve computer print-out and
hand check claims as read. Councilman Landon seconded. All
councilmembers voted in favor of motion.
At 9:00 p.m., Councilman Landon moved, Councilman England seconded,
with full council approval to adjourn meeting.
