COUNCIL MEETING MINUTES
January 9, 1990

Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin. Councilman Elect W. Dean Wood was present.L
Meeting was called to order at 6:42 p.m. by Mayor Cotant.
PURPOSE OF SPECIAL MEETING shall be to discuss possible litagation with
the Sixth District Court.
At
6:43 p.m., Councilman England moved to go into executive session
meeting ~o consider and advise Attorney Holmes on the possible
litagation with the Sixth District Court, as authorized by Idaho
Code 63-2345 (f). Councilman Landon seconded. 100% of council voted
in favor of motion.
Mayor Cotant and Council discussed Resolution #7-89, a resolution
of the City of Chubbuck, withdrawing from Resolution #1986-29, being
a joint resolution of the City of Chubbuck and the City of Pocatello
to aid in the operation of the Magistrate Division of the District
Court of the Sixth Judicial District.
No action or final decision was made.
At 7:20 p.m., Councilman Landon moved to adjourn from executive
session meeting to regular meeting. Councilman Kinghorn seconded.
All councilmembers voted in favor of motion.
RESCINDING RESOLUTION ~7-89 - A resolution of the City of Chubbuck,
withdrawing from Resolution #1986-29, being a Joint Resolution of the
City of Chubbuck and the City of Pocatello to aid in the operation
of the Magistrate Division of the District Court of the Six~h Judicial
District.

presented to the Association of Idaho Cities, to be taken to the~
Legislature in opposition to Resolution #1989-29.
Councilman England moved to rescind Resolution ~7-89. Councilman
seconded. All councilmembers voted in favor of motion.
7:25 p.m., Councilman England moved, Councilman Landon seconded,
full council approval to adjourn the meeting.

Pursuant to Idaho Code Section 50 -604, the undersigned Mayor
of the City of Chubbuck, Idaho, hereby calls a special meeting of
the City Council to be held at the Chubbuck Municipal Building,
5160 Yellowstone Ave., at the hour of 6:30 p.m., on the 9th day,
of January, 1990. The object of the special meeting shall be to
discuss possible litigation with the Sixth Judicial District Court.
