COUNCIL MEETING MINUTES
December 14, 1993
Minutes of regular meeting held at city municipal building,
December 14, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk ~on C. Conlln.
Meeting was called to order at 7~30 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to regular meeting minutes of November 23, 1993.
Councilman England moved to approve regular meeting minutes
of November 9, 1993 as read. Councilman Wood seconded. All
council members voted in favor of motion.
CHANGE OF ZONING PROPOSAL BY K.G. GIBBS, 435 E. CHUBBUCK RD. -
A proposal by K.G. Gibbs, 426 E. Chubbuck Rd. for a change in
Land Use District to Industrial (I), for property in the
NE1/4, NE1/4, Section 10, Township 6 South, ~ange 34, E.B.M.
(435 E. Chubbuck Rd.). Proposal was tabled from November 9,
1993 Council Meeting.
PWD Smart passed to Mayor Cotant and Council, a new site plan
map, defining the zoning line as the zoning ordinance and as
the Comprehensive Plan explains.
Attorney Holmes stated, the best Mr. Glbb's could ask for is
only a portion of his property is (R-2), based on the
Comprehensive Plan. Zoning Ordinance #98 shows Mr. Glbb's
property is (R-2).
Attorney ~olmes stated the only way Mr. Gibb's can be allowed
to operate his trailer manufacturing business on this
property, is the Council amending the Comprehensive Plan.
Mayor Cotant said the intent of the original zoning line was
to be along the west end of Dee Green's property.
Mr. Kline stated Mr. Gibbs would like to have the property
rezoned, but, in all likely hood, this will not happen. Mr.
Kline said because of the amount of monies Glbb's has put out
toward the business, Mr. Gibbs would like a two year period
to phase the business from the property. If the Council will
not approve this, they would like to have at least until, May
1, 1994.

ZONING CHANGE PROPOSAL BY K.G. GIBBS (cont.) -
After discussion, Councilman Quick moved to deny the change
of zoning request by K.G. Gibbs at 435 E. Chubbuck Road,
giving Mr. Gibbs until July i, 1994 to phase the trailer
manufacturing business from 435 E. Chubbuck Rd. Councilman
Wood seconded. All council members voted in favor of motion.
COMMERCIAL SANITATION AGREEMENT - SNAKE RIVER SANITATION AND CITY
OF CHUBBUCK -
PWD Smart passed copies of agreement to Mayor Cotant and
Council.
Jim Evans, Snake River Sanitation said the reason Snake River
Sanitation prefers the five year agreement is because of the
investment of purchasing the containers.
PWD Smart stated he sent all commercial customers a letter
advising them the change is coming. City will pick up current
containers as Snake River Sanitation delivers theirs. Mr.
Evans said all Snake River Sanitation Containers will be in
by the end of December.
Councilman Quick moved to direct Mayor Cotant to enter into
agreement with Snake River Sanitation for commercial
sanitation pickup, on terms in proposed agreement, finding
that picking up and hauling commercial sanitation is an
ordinary and necessary function of the City, and an ordinary
and necessary expense. That it is the finding of the Chubbuck
City Council that this agreement will fill that function.
Councilman England seconded. All council members voted in
favor of motion.
BUSINESS LICENSE APPLICATION David Jenkins,

Councilman Wood moved to approve a business license to David
Jenkins, Jenkins & Son Christmas Trees, to sell christmas
trees at the Green Triangle Parking Lot. Councilman Gunter
seconded. All council members voted in favor of motion.
RENEWAL OF LIQUOR, WINE AND BEER LICENSES for year of, 1994
Police Department have approved the renewal of licenses
present holders of liquor, wine and beer licenses.

City Clerk Conlln explained, Idaho Unlimited, Cattle Baron and
Tina's Oxbow have not applied for license as of yet. City
Clerk Conlin etated he talked to all of them, they said they
will have the applications, with fees, prior to the last week
in December, 1993.

Councilman Wood moved to approve the renewal of present beer,
wine and liquor licenses for the year of 1994, subject to the
compliance of all requirements of ordinance and statutes as
determined by the City Clerk. Councilman Quick seconded. All
council members voted in favor of motion.
PUBLIC HEARING ORDINANCE amending Chapter 18,12.03~ (I} of the
Chubbuck Municipal Code to require paved driveway connecting
the public right of way with any required off-street parking
spaces.
Mayor Cotant declared the public hearing open.
Attorney Holmes read ordinance in full for the first reading,
Mayor Cotant asked for comment, there being no comment, Mayor
Cotant declared the public hearing closed.
Council decided to table the proposed ordinance until the
January 11, 1994 Council Meeting.
PUBLIC HEARING - ORDINANCE amendlng Section 18.12.030 (L) to allow
a Class III production building to be used as a production
building sales office.
Mayor Cotant declared the public hearlng open.
Mayor Cotant read ordinance in full for the first reading.
Mayor Cotant asked for comment, there being no comment, Mayor
Cotant declared the public hearing closed.
Council decided to table the proposed ordinance until the
January 11, 1994 Council Meeting.
LETTER OF INTENT PM10 REDUCTION - The Power-Bannock County
Particulate Matter (PMi0) Air Quality Improvement Plan of May
1993 identifies wintertime roadway sanding materials as a
significant source of PMi~ contribution in our community. The
City of Chubbuck intends to participate in the reduction of
airborne PMi0 concentration from paved roads.
PWD Smart stated DEQ told him they had to have the Letter of
Intent prior to December 10, 1993.
PWD Smart gave a report on the Letter of Intent presented to
Idaho Division of Environmental Quality.

Reduction to DEQ as presented. Councilman Quick seconded. Ail
council members voted in favor of motion.

GENERAL DISCUSSION -
Councilman Gunter reported on a meeting he attended, he
said the plan is to create a committee that will go after
funding, grants, etc. to help with the beautification of
the Chubbuck-Pocatello area. Councilman Gunter stated this
was the first meeting, there will be more.
Geri and Dennis O'Dell, 49Q1 Yellowstone Ave., Space 9Q
representing Charles Moreno the owner was present to see
if they could dispose of their sanitation in the mobile
home court. They felt the cost they have to pa~ for
sanitation ls too much. City Ordinance requires sanitation
be picked up, or contracted out, by the City. Mr. O'Dell
suggested, because of traffic, speeders, trucks% etc. that
Llsh Ave. be closed to the public. Mayor Cotant said the
City will address the problems without closing off Llsh
Ave. Mr. O'Dell was asked to call the City when he sees
a problem. Mayor Cotant suggested signs be placed at each
entrance, advising drivers it is a private street. Mr. and
Mrs. O'Dell will meet with Chief of Police Jerry Rowland
to discuss ways to correct the problems.

At 8~55 p.m., Councilman Wood moved, Councilman Gunter seconded,
with full council approval to adjourn meeting.

RE: Letter of Intent - PM]0 Reduction
Dear Ms. Bills,
The Power-Bannock county Particulate Matter (PM]o) Air Quality
Improvement Plan of May 1993 £dentifies wintertime roadway sanding
materials as a significant source of PM~o contribution in our
community. The City of Chubbuck intends to participate in the
reduction of airborne PM]o concentration from paved roads by taking
the following actions.
Public Awareness
The City of Chubbuck will participate with City of Pocatello,
Bannock County, Idaho Transportation Department and the Idaho
Division of Environmental Quality in public awareness. We
will participate in publishing a newspaper article explaining
changes made in sanding aggregate application and clean up
practices to reduce airborne particulate level in the non-
attainment area. The City of Chubbuck will also contribute to
other public information media articles as necessary.
Establish an anti-skid material qradation specification that
reduces the amount of PM10~
The City of Chubbuck will purchase anti-skid aggregate having
a fraction passing the number 200 (75 micron) sieve having a
maximum of eight (8) percent. Anti-skid aggregate will also
meet a hardness and durability standard of a maximum loss of
30% as measured by the Los Angeles Abrasion Test.
Decrease the amount of anti-skid material applied.
Anti-skid aggregate will be applied only at intersections and
on grades. Other locations for which sanding is requested

will be investigated and assessed prior to a~·y application.
The City of Chubbuck will optimize sanding efforts. Snow
plows will be used prio~ to applying sanding material and
sanding material wil~ b~ ~pplied early in storm conditions to
mitigate slick roads. Our goal is to reduce the amount of
anti-skid aggregate by l0 percent from levels used in 1992-93.
Use of chemical de-icinq aqents.
The City of Chubbuck will obtain necessary equipment by
December 15, 1994 to enable the City to apply a liquid
solution of calcium chloride salt to anti-skid aggregate. The
City will use approximately four percent calcium chloride in
the anti-skid aggregate. The City of Chubbuck will also use
straight sodium chloride rock salt at major intersections and
locations along arterial roads to reduce requirments for anti-
skid aggregate.

Implement rapid clean-uD.
Anti-skid material applied during the course of storm events
will be collected using the City street sweeper. City crews
will begin collection of the sanding aggregate as soon as
practical after the pavement bares and drys. Clean up of
excess material accumulated over the winter will begin within
seven days after the pavement bares and drys. Water would be
used in the street sweeper to reduce airborne dust if weather
permits.
