October 26, 1993
Minutes of regular meeting held at city municipal building,
October 26th, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting was called to order at 7~30 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to regular meeting minutes of October 12, 1993.
Councilman Wood moved to approve regular meeting minutes of
October 12th, 1993 as read. Councilman Quick seconded. All
council members present voted in favor of motion.
ORDINANCE - Adding Section 13.04.105 to the Chubbuck Municipal Code
to provide for minimum water, sewer and landfill construction
fees for residences turning services off for a period of time
while temporarily away from the premises.
Councilman Wood suggested, if the City decides to charge
residents when they leave for the winter, that we broaden the
base and charge owners of vacant lots throughout the City.
Councilman England suggested if we do decide to charge the
residents that leave for the winter be charged for the costs
of water bond, sewer bond and sanitation landfill fee only,
which would amount to approx., $8.60 total.
After discussion, Council decided to table the ordinance until
next spring.
FIREWORKS PERMIT - Landis Fireworks and Lasers to shoot a fireworks
display for Klmberly Nursery, 212 E. Chubbuck Rd., November
27, 1993. The fireworks show will be in the field across the
street from the nursery.
Certificate of Insurance is in order.
Councilman Wood moved to approve a permit to Landis Fireworks
and Lasers, to shoot a fireworks display for Kimberly Nursery,
212 E. Chubbuck Road. The fireworks show will be in the field
across the street from the nursery. Councilman Quick seconded.
All council members voted in favor of motion.

FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - Council
reviewed the Findings of Fact, Conclusions of Law and Decision
of the Appeal of the Land Use and Development Commission's
decision approving a conditional use permit for Kevin Kugler
to sell and repair used appliances at 4801 Yellowstone Ave.
Councilman England moved to approve the Findings of Pact,
Conclusions of Law and Decision as presented. Councilman
Landon seconded. All council members voted in favor of motion.
PUBLIC DRINKING WATER FEE ASSESSMENT TO IDAHO DEPARTMENT OF HEALTH
AND WELFARE Mayor Cotant gave report on Association of Idaho
Cities opinion on paying the fee.
After discussion, Councilman England moved to pay the Public
Drinking Water Fee Assessment by the month, ($682.00 per
month), under protest. Councilman Wood seconded. All council
members voted in favor of motion.
FINANCIAL REPORT for month of September, 1993 presented to Mayor
Cotant and Council.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved to approve computer print-out claims as
presented. Councilman Quick seconded. All council members
voted in favor of motion.
GENERAL DISCUSSION -
1. "Adopt-A-Highway" - October 30th., 1993.
Veda Rupp, 12789 Hiline Rd. stated Rodney Rupp is willing
to donate land for the City of Chubbuck to drill a well.
PWD Smart stated while the City of Chubbuck appreciates the
offer, there is a problem getting the water distributed,
a 16" water line would have to be installed to get water
from the land to Hlline Rd. approx. 1/2 mile.
At 8:20 p.m., Councilman Wood moved, Councilman England seconded,
with full council approval to adjourn meeting.
