COUNCIL MEETING MINUTES
July 27, 1993
Minutes of regular meeting held in the city municipal building,
July 27, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, W. Dean Wood, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin. Council member David A.
Landon and Attorney Thomas J. Holmes were excused.
Meeting called to order at 7:32 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to regular meeting minutes of July 13th., 1993.
Councilman Quick moved to approve regular meeting minutes of
July 13th., 1993 as read. Councilman England seconded. All
council members voted in favor of motion.
PRELIMINARY PLAT - ESPIE 1ST. ADDITION SUBDIVISION - An application
by Roy J. Lacey, 12411 N. Corey Lane for a review of
preliminary plat for Espie Subdivision 1st. Addition, located
on a tract of land on the west side of Hawthorne Road (5500
block)(south 1/2 of the northeast quarter of Section 4,
Township 6 South, Range 34, East B.M.
Public Hearing was conducted July 13, 1993, Council tabled
until the preliminary plat could be shown with a park to the
south west corner of the Subdivision.
Council was presented copies of two plats, one showing the
park platted on the southwest corner, the other showing the
park platted on the northwest corner.
Tim Shurtliff, Shurliff Engineering stated Mr. Lacey would
prefer the park to be on the northwest corner of Espie 1st.
Addition Subdivision. This would create the possible growth of
the park, if additional land is donated at the time the rest
of the subdivision expands. Also this would make the park more
centrally located when land develops in the future.
Mr. Shurtliff explained pros and cons of both locations of
parks.
Chris Smith, 507 Darris expressed concern about small parks,
Mr. Smith said the smaller parks draw people to hang out. Mr.
expressed concern about problems smaller park create for
Police Departments.
Mayor Cotant stated residents do like the small parks, mostly
because kids will not have to walk far to play.

Mr. Lacey said there is no way Mr. Lemmon is going to let a
street go to Siphon Rd. on the northwest end.
PWD Smart recommended the plat be approved with park
dedication.
Councilman Wood moved to approve recommendations of Land Use
and Development Commission and approve Espie Subdivision 1st.
Addition Preliminary Plat subject to the park being platted on
the northwest corner of Espie Subdivision 1st, Addition.
Councilman Quick seconded. All council members present voted
in favor of motion.
ACCEPTANCE OF OFFER OF DEDICATION - HERITAGE WEST NO. 3 - Mayor
Cotant read the Acceptance in full.
PWD Smart stated requirements have been met, and recommended
accepting the offer of dedication.
Councilman Quick moved to accept the offer of dedication of
Heritage West No. 3 Subdivision as read. Councilman England
seconded. Ail council members present voted in favor of
motion.
BEER
AND WINE APPLICATION - CIRCLE K CORPORATION - City Clerk
Conlin explained Circle K Corporation had changes in
ownership, which required them to get a transfer on their wine
license, also a new beer license.
City Clerk Conlin stated Circle K is in the process of getting
the required State and County transfer, but, did not want any
interruptions in their selling of beer and wine.
Councilman England moved to 1) Approve a transfer of Circle
K wine license to new owners. 2) Approve a beer license to
new Circle K owners. Councilman Wood seconded. All council
members voted in favor of motion.
WATER SERVICE CONNECTION FEES AT 145 MINGO - DELL DYE - Dell Dye,
145 Mingo was presented to contest having to pay a water
service connection from the main line into the property along
with necessary pavement patching fees, prior to having his
water turned on, this amount came to approx. $900.00. Mr. Dye
said he contacted City Offices making arrangements on the
bill, but, could not come up with all the $900.00 prior to the
water being turned on. City Staff turned water off because the
$900.00 had not been paid in full prior to Mr. Dye moving in.
Mr. Dye stated he understands he will owe a water, sewer and
sanitation bill to be paid each month, in addition to the

water connection fee of approx. $900.00, being paid on, or
before January 27, 1994.
Councilman Wood moved to giye Mr. Dye a 6 month period to have
the water service connection fee of approx. $900.00 paid in
full. Councilman England seconded. All council members present
voted in favor of motion.
CLAIMS Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved approve computer print-out claims read.
Councilman England seconded. All council members present voted
in favor of motion.
At 8:25 p.m., Councilman England moved, Councilman Quick seconded,
with full council approval to adjourn meeting.

LEFT OWING AS OF 7/29/93 FOR THE WATER CONNECTION FEE IS $843.58
THIS AMOUNT DOES NOT REFLECT YOUR REGULAR MONTHLY WATER, SEWER AND
SANITATION BILL.
