COUNCIL MEETING MINUTES
May 11, 1993
Minutes of regular meeting minutes held in the city municipal
building, May 11, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. Quick~
Steven M. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to special meeting minutes of April 27, 1993, and
regular meeting minutes of April 27, 1993.
Councilman Wood moved to approve special meeting minutes of
April 27, 1993 as read. Councilman Quick seconded. All council
members voted in favor of motion.
Councilman Quick moved to approve regular meeting minutes of
April 27, 1993 as read. Councilman Landon seconded. All
council members voted in favor of motion.
FINAL PLAT - HERITAGE WEST i4 SUBDIVISION - PWD Smart stated Staff
met with Mike Bird~ American Heritage, reviewing construction
drawings, PWD Smart said everything is in order.
PWD Smart said the exact determination of park dedication has
not been set as of yet. The park dedication could be as much
as $320.00 per lot, depending on size of park required.
PWD Smart suggested the Staff determine amount of required
contribution and collect when issuing building permits.
Councilman Quick suggested a formula for a required park
contribution be presented to Council for approval.
Councilman Landon moved to approve the Final Plat for' Heritage
West #4 Subdivision, subject to City Staff determining park
contribution formula, then collecting when building permits
are issued. Councilman England seconded. All council members
voted in favor of motion.
FINAL PLAT - MISTI MANOR SUBDIVISION - PWD Smart stated Staff met
with Joe Osier, reviewing construction drawings, PWD Smart
said everything is in order.
Council reviewed Final Plat drawings.
Discussion about required park land dedication required.

Kent Kearns, 4871 Elizabeth said he felt $320.00 per lot is
excessively low, given the life time of a park. PWD Smart said
the fee is not to cover maintenance costs~ but, development
costs only.
Councilman Wood moved to approve the Final Plat of Misti Manor
Subdivision, subject to the park dedication requirement being
collected when the building permit is issued, Councilman
England seconded. All council members voted in favor of
motion,
BUS BENCH PROPOSAL - Dan Tucker, Mountain West Marketing presented
Mayor Cotant and Council a proposal on the placement of "bus
benches" or public seating units throughout the City of
Chubbuck.
Mr. Tucker said the term of the agreement would be a seven
year exclusive agreement. The City of Chubbuck will collect
quarterly installments of $250.00, or ten percent, of net
advertising revenues collected in the quarter~ whichever is
greater
Mayor Cotant expressed concern of canceling the original
contract with Dan Bellows, Community Advertising because Mr.
Bellows has supplied bus benches as he agreed on in the
original agreement, there have been no complaints about the
service he has provided the past three years. Mr. Bellows has
been very supportive of the Chubbuck D.A.R.E. Program.
Councilman Landon stated the Council may have made a mistake
terminating Mr. Bellow~s original agreement.
Council affirmed the motion made at April 13, 1993, Council
Meeting~ to enter into a five year agreement with Dan
Bellow's, Community Advertising to supply bus benches around
the City of Chubbuck.
BUS STOP BENCHES - PWD Smart stated he received a call from Idaho
Transportation Department right-of-way agent to inform us that
the benches that are placed in the right-of-way on the State
of Federal aid highways, can only be placed there after the
City and lTD execute an agreement.
PWD Smart stated the agreement would require the City to hold
the State harmless from liability, There are also some
regulations regarding advertisement on the road right-of-way.
ITD said that could probably be handled through the
agreement we would negotiate.
Attorney Holmes was directed to incorporate into the agreement
with Dan Bellows, Community Advertising.

ORDINANCE i398 - An ordinance enacting Chapter 10.16, recreational
motor vehicle operation; to provide for recreational motor
vehicle operations; to provide for the regulation of
recreational motor vehicles.
Mayor Cotant read Ordinance i398 by title for the three
reading.
Mayor Cotant asked for comment from individuals present. There
Councilman England moved to adopt Ordinance i398 as read.
Councilman Wood seconded. Roll Call Vote: Quick, yes; England,
yes; Landon, yes; Wood, yes.
PROCLAMATION - MENTAL HEALTH MONTH - Mayor Cotant read the
proclamation in full.
Councilman Landon moved to direct Mayor Cotant to proclaim May
"Mental Health Month". Councilman Wood seconded. Ail council
members voted in favor of motion.
PROCLAMATION - POPPY DAYS - Mayor Cotant read the proclamation in
full.
Councilman Quick moved to direct Mayor Cotant to proclaim, May
14th. and 15th., as "Poppy Days"; and May as "Poppy Month".
Councilman Landon seconded. All council members voted in favor
of motion.
PROCLAMATION BUCKLE UP AMERICA WEEK - Mayor Cotant read the
proclamation in full.
Councilman Wood moved to direct Mayor Cotant to proclaim the
week of May 24th., 1993 as "Buckle Up America" Week.
Councilman Quick seconded. Ail council members voted in favor
of motion.
LIQUOR, WINE AND BEER LICENSE APPLICATION - Clifford Reinke, Reinke
Enterprises, DBA Cattle Baron Rest./Lounge has applied for a
liquor~ wine and beer license to operate in the Days Inn
Rest./Lounge.
Police Department stated they did not have a problem with the
application.
City Clerk Conlin stated Mr. Reinke applied for license to
sell liquor, wine and beer license the Wednesday prior to this
Council Meeting, May 5, 1993. City Clerk Conlin polled the
council, receiving approval from all council members.

Councilman Wood moved to approve a liquor, wine and beer
license to Clifford Reinke, DBA Cattle Baron Rest./Lounge to
operate at the Days Inn, 133 W. Burnside Ave. Councilman Quick
seconded. Ail council members voted in favor of motion.
CLAIM - GERD DIXON DAMAGED JEANS - Project Engineer Gerd Dixon
presented a claim to the City stating his pants were ruined by
chlorine sprayed on them by chlorination equipment while Gerd
was checking equipment.
PWD Smart said Charlie Piquet and Gerd Dixon have lost
clothing because of the chlorine.
Councilman Landon suggested any City Employee wear protective
clothing while working with the chlorine in the future.
After discussion, Councilman Landon moved to pay the claim of
$61.00 presented by Gerd Dixon. Councilman Wood seconded. Ail
council members voted in favor of motion.
COPS
ON PATROL COMMITTEE REPORT - Michael Clark, 4880 Trent stated
a committee of 10 members has been formed, there have been
rules and policy procedures drafted in cooperation with the
Chubbuck Police Department. Mr. Clark stated equipment,
(radio, cellular telephones, etc.) have been purchased to
assist in what the COP are trying to do in the community. The
equipment has been purchased by donations, fund raisers, etc.
Mr. Clark said the COP Committee would challenge Mayor Cotant
and Council to come to the training sessions to understand how
the COP Program would assist the City. The committee will
prepare a schedule, and advise the Council.
Mr. Clark stated the key issues of the COP Program is to only
observe, record and report.
Mr. Clark proposed the City send out a letter with water bills
explaining the COP Program, so all neighborhoods might be
involved. Mayor Cotant and Council was in agreement.
Mr. Clark suggested a space be provided on the utility bill,
asking for a donation of $2.00 per residence for purchase of
equipment needed for the program. Discussion about how monies
collected be received and disbursed.
Councilman Landon suggested an address be put on the Mayor's
Letter stating, any monies donated be sent to specific
address.
Mayor Cotant and Council thanked Mr. Clark for his work.
CHUBBUCK DAYS REPORT - Councilman Wood gave a report on the 1992-93
Chubbuck Days Schedule,
CLAIMS Councilman England moved to approve computer print out
claims as read. Councilman Landon seconded. All council
members voted in favor of motion.
At 8:50 p.m., Councilman England moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
