COUNCIL MEETING MINUTES
February 23, 1993
Minutes of a regular meeting held at the city municipal building,
February 23, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to Regular Meeting Minutes of February 9, 1993.
Councilman Quick moved to approve Regular Meeting Minutes of
February 9, 1993 as read. Councilman Landon seconded. All
council members voted in favor of motion.
PROPOSED HEALTH AND WELFARE BUILDING AT 4425 BURLEY DRIVE - Mayor
Cotant stated the State Health & We]fare Officials want to
]ocate at 4425 Bur]ey Drive. They are required to have a bus
stop at the location, the City of Pocate]lo is asking
$4,930.00 annually, to provide the coverage.
Jim Morphy, Gate City Reality expressed concern about how the
City of Pocatello came about the fee of $4,930.00.
Mr. Morphy asked the City's help in working with the City of
Pocatello in working out these concerns.
Mayor Cotant suggested the Region O Health & Welfare Director,
Peterson Investments, Key Bank Officials, City of Pocatello
and City of Chubbuck meet and discuss all issues and concerns.
Mr. Morphy said he will coordinate and get back with us.
PRELIMINARY PLAT APPLICATION - An application by Joe Osier, 11010
W. Hickory, Boise, Idaho for review of s preliminary plat of
Misti Manor Subdivision located near the southeast corner of
Hawthorne Rd., (4700 block) and W. Chubbuck Road (400 block).
Tim Shurtliff, Shurtliff Engineering was presented to address
the following:
Road section requiring narrow strip of land between
sidewalks and street. Mr. Osier said he would prefer
to stay with standard city street, Mr. Shurtliff said
he will talk to Mr. Osier again about the preference,
but cannot say whether or not he will change his
mind. Mr. Shurtliff suggested staying with standard
city street requirement, leaving open to negotiate,

if both the city and developer feel the walkways would
be advantageous to both city and developer.
The city is desirous of upgrading the 6" waterline on
Hawthorne Rd to 16" waterline. Mr. Shurtliff stated
Mr. Osier will install 16" waterline from where the
present line ends, to the end of his property.
Discussion about the possibility of the City paying
the difference in the cost of the materials.
3. Hr. Shurtliff said, Mr. Osier would prefer to provide
a lot type park area.
Mayor Cotant stated the City is requiring there be an 8' set
back on Chubbuck Rd. City is requiring a 8' set back on
Hawthorne Rd. along Mr. Osier's property,
Discussion about installation of pressurized irrigation
systems being required in all new subdivisions.
PWD Smart recommended establishing standards before requiring
developers to install pressurized irrigation systems.
PWD Smart explained the following recommendations:
1. The developer will be required to extend a sewer line
(8") on Hawthorne from Juliette Way to the southern
property limit.
2. A water line (16") will be required to be placed in
Hawthorne Road, from Juliette Way to the southern
property limit. PWD Smart suggested the City
participate with the installation of the 16" water
line.
3. Water lines ending in cul-de-sacs shall be looped
back to main lines in Chubbuck and Hawthorne Roads to
avoid dead end lines,
4. Hawthorne and Chubbuck Rds. have been designated Minor
Arterial Roads, therefore, a 33' ROW (from centerline)
shall be dedicated to the City.
5. Mayor Cotant suggested Mr. Osier meet the park
dedication requirement, by donating 8/1Orbs. of an
acre for park somewhere on the south side of Misti
Manor Subdivision.
Councilman England moved to approve the recommendations of the
Land Use and Development Commission for approval of Misti
Manor Subdivision Preliminary Plat with conditions as outlined
in the staff report: 1) Developer will be required to extend

a 10" sewer line on Kimberly Rd. from Chubbuck Rd. to the
southern property limit. 2) A 16" waterline is required to go
down Hawthorne Road with the City paying for installation of
the line (170') to Mr. Osier's property, City will pay for the
difference in cost of materials of 6" and 16" waterline on Mr.
Osier's property (492'). 3. Hawthorne and Chubbuck Roads be
widened to a Minor Arterial widths. 4. Curb, gutter, sidewalk
installed along Hawthorne and W. Chubbuck Rd., street patched
to the curb location. 5. Park dedication to be determined on
Final Plat. Councilman Wood seconded. All council members
voted in favor of motion.
GLASS ORDINANCE - An ordinance adding Chapter 8.38 to the Chubbuck
Municipal Code to define and designate city parks and to ban
glass beverage containers from said parks.
Council tabled the glass ordinance until the March 9, 1993
Council Meeting.
BUSINESS LICENSE APPLICATION - Great Western Auctions, Blackfoot,
Idaho has applied for license to conduct an auction at Tom's
Gyro, Yellowstone Ave. on Saturday, February 20, 1993.
City Clerk Conlin polled the council prior to this council
meeting.
Councilman Quick moved to approve a license to Great Western
Auctions, Blackfoot, Idaho to conduct an auction at Tom's
Gyro, Yellowstone Ave., February 20, 1993. Councilman Landon
seconded. All council members voted in favor of motion.
LIQUOR CATERING PERMIT APPLICATION - Blue Ribbon Restaurant has
applied for a Liquor Catering Permit to cater a Redi-Gro
Fertilizer Co. event, Wednesday, February 24, 1993 at 2:00
p.m. to 1:00 a.m. at the Days Inn in Chubbuck. The Days Inn
does not have a liquor license.
Chief of Police Jerry Rowland approved the Liquor Catering
Permit.
Councilman England moved to approve a Liquor Cater Permit to
the Blue Ribbon, Pocatello to cater an event for Redi-Gro
Fertilizer Co. February 24, 1993, 2 p.m. to 1:00 a.m. at the
Days Inn in Chubbuck. Councilman Landon seconded. All council
members voted in favor of motion.
BID
- City of Chubbuck accepted bids for loading and hauling
approximately 65 cubic yards of contaminated soil, in
conjunction with accidental spill mitigation procedures until
2:00 p.m., February 23, 1993.

PWO Smart stated the
PWD Smart presented the following bids:
Silver Sage $ 10,745.00 5% bid bond
PMI Pacific Mechanical $ 11,700.00 5% bid bond
Councilman Wood moved to authorize Mayor Cotant to enter into
agreement with Silver Sage for the low bid of $10,745.00,
subject to Attorney Holmes, review and approval of
agreement. Councilman England seconded. All council members
voted in favor of motion.
PROPOSED PERSONNEL POLICY AMENDMENTS PWD Smart presented
suggested changes in current personnel policy.
1. V. EMPLOYEE BENEFITS A. Medical and Hospitalization
Insurance : Health and accident insurance coverage is provided
by the City at no cost to all regular, and eligible
probation employees who work at least thirty (30) per work
week, and their dependents. Employees who work less than
thirty ¢30} hours per work week will not have any health
premium oaid by the City.
2. V. EMPLOYEE BENEFITS - E. 1. Regular employees will
vacation based on the following schedules:

3. V. EMPLOYEE BENEFITS - F. Sick Leave Accumulated as of
October 1, 1992:

order of the Mayor and City Council.1
Uoon termination of an emoloyee, the emoloyee will bm
comoensated for fifty oercent (50%) of his/her accumulated
sick leave dave for the first ninety (90) days and for ~wenty
five 25%) of the remainin~ accumulated sick leave days as of
October 1, 1992.
If an employee has accumulated sick leave in place as of
October 1. 1992. and must use it, ~hat employee can build sick
leave back uD to the level tha~ employee had as of October 1,
1992. If employee la~er terminates, employee will bo

compensated for the amount built back up to {but not
exceedinq) the accumulated sick leave that employee had as of
October 1, 1992.
Sick Leave Accumulated after October 1, 1992:
After October 1, 1992, employees will not be compensated for
unused sick leave accumulated after October 1, 1992. (except
as set forth above for time used ko build back to ore-October
1 1992 levels .
Councilman Landon moved to approve the above personnel policy
changes. Councilman Wood seconded. All council members voted
in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman England moved to approve computer print-out claims
ae presented, Councilman Landon seconded. All council members
voted in favor of motion.
At 9:15 p.m., Councilman Quick moved, Councilman Wood seconded,
with full council approval to adjourn meeting.
