ORDINANCE NO. 414
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
15.08.030 TO ADOPT A MORE RECENT VERSION OF THE UNIFORM
FIRE CODE AND TO NOT ADOPT CERTAIN SECTIONS DEALING WITH
FIREWORKS; ADDING 15.08.025 PROVIDING FOR THE ADOPTION OF
FUTURE EDITIONS BY RESOLUTION; AMENDING SECTION 15.08.030
TO PROVIDE FOR THE CLERK TO MAINTAIN COPIES OF FUTURE
EDITIONS OF THE FIRE CODE SO ADOPTED; REPEALING PRIOR
CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF
THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL
OTHER SECTIONS AND PROVISIONS OF CHAPTER 15.08 NOT HEREIN
AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amend 15.08.020. Section 15.08.020 of the Chubbuck Municipal Code
is amended as follows:
15.08.020 Adopted. The 4473 1991 edition of the Uniform Fire Code,
promulgated by the International Conference of Building Officials and the
Western Fire Chiefs Association, is adopted and incorporated as an
ordinance of the city in its current form and as it may hereafter be
amended, as though set forth at length in this chapter; provided, however,
Section 78.101 through and including 78.202 dealing with fireworks are not
adopted.
Section 2. New Section 15.08.025. The following section 15.08.025 is added to
the Chubbuck Municipal Code:
15.08.025 Procedure for adopting future editions. Future editions of the
Uniform Fire Code may be adopted, as the same are published from time
to time by the International Conference of Building Officials, by resolution
of the mayor and council of the city. Such resolution shall identify with
particularity the edition of the Uniform Fire Code so adopted and shall
recite that it is adopted pursuant to this chapter. Unless specifically stated
to the contrary in the text thereof, such resolution shall have the effect of
adopting the future edition and any appendices or standards previously
adopted by ordinance.
Section 3. Amend 15.08.030. Section 15.08.030 of the Chubbuck Municipal Code
is amended as follows:

15.08.030 Filing. Three copies of the 4773 1991 edition of the Uniform
Fire Code, together with -ail three copies of any future amendments
thereto, and of the resolutions of the mayor and council adopting the
amendments duly certified by the city clerk, shall be kept on file in the
clerk's office for use and examination by the public.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of
the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent of
such conflict. All other sections and provisions of Chapter 15.08 not herein amended
shall remain in full force and effect.
Section 2. Severability. If any provision of this ordinance is held invalid, for any
reason, by any court of competent jurisdiction, such holding shall not affect the validity
or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three
separate days, one of which shall be a reading in full, is hereby dispensed with, and this
Ordinance shall become effective upon its passage, approval and publication as provided
by law.
