January 12, 1993
Minutes of a regular meeting held at the city municipal building,
January 12, 1993.
Present: Mayor John O. Cotant, Council members Leroy S. quick,
Steven M. England, David A. Landor, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
INVOCATION was given by Bishop Kent Hansen, Chubbuck 2nd. Ward,
Church of Jesus Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to Regular Meeting Minutes of December 8, 1992.
Councilman Quick moved to approve Regular Meeting Minutes of
December 8, i992 as read. Councilman Wood seconded. Ali
council members present voted in favor of motion.
PUBLIC HEARING - A proposal by the City of chuboucK %o amend
Chapter 18.12.030 (a), to ban railroad cars, truck trailers,
vans and other similar structures from being used as accessory
structures for storage or otherwise.
Mayor Cotant declared the public hearing open.

Councilman Quick expressed concern the ordinance might be too
restrictive in industrial zones.
Mayor Cotant suggested leaving as is, and require a
conditional use permit in commercial and industrial zones.
After further discussion, Council decided not to amend Chapter
18.12.030 (a) to ban railroad cars, ~ruck trailers, vans and
other similar structures from being used as accessory
structures for storage.
BIRTH DEFECT PREVENTION PROCLAMATION - Mayor Cotant read the "Birth
Defect Prevention Proclamation" in tull.
Councilman wood moved to direct Mayor Cotant to proclaim
January 24th., 1993 through, January 30th., 1993, as ':Birth
Defect Prevention Week". Councilman Quick seconded. Ail
council members voted in favor of motion.
ORDINANCE - Adding Section i8.08.040 (c} to the Chubbuck Municipal
Code to establish the maximum ratio of lot depth to lot width.
Attorney Holmes read ordinance in full for the second reading.
After discussion, the Council tabled the lot depth to lot
width ordinance, until the January 26th., 1993 Council
Meeting.
LANDSCAPING ORDINANCE Amending Chapter i8.14.020 (c) of the
Chubbuck Municipal Code to reduce the size of trees growing
from two to two and one-half inches to one to one and one-
half inches.
Mayor Cotant read ordinance in full for the second reading.
After discussion, the Council tabled the Landscaping Ordinance
until the January 26th., i993 Council Meeting.
ORDINANCE - Providing tot changes in the Land Use Pattern
prescribed in the City's Comprehensive Plan, with respect to
certain lands within the boundaries of the City of chubbuck,
lying east of interstate 15, located in the Nb 1/4, Section
11, Township 6 South, Range 34 E.B.M., from Single Family
Residential (R-l), to General Commercial (C-23; providing for
change of Land Use District with respect to certain lands
within the boundarqes of the City of Chubbuck located in the
N 1/2, NW 1/4, NW i/4, Section lu, Township 6 south, Range 34
E.B.M. from Agriculture (a) to Limited Residential (R-2);
ORDINANCE - (cont,j -
providing for changes in the Land Use Pattern prescribed in
the City's Comprehensive Plan; declaring that the City Council
finds that such change in Land Use District is compatible with
the alterations made in the Land Use Pattern prescribed by the
City's Comprehensive Plan.

After discussion, the Council tabled the ordinance until the
January 26th., 1993 Council Meeting.
ORDINANCE ¢389 - An ordinance vacating a portion of the plat of
Aero Park Subdivision, a subdivision to Bannock County, Idaho.
Mayor Co,ant read Ordinance ¢389 in full for the first
reading.
Councilman England moved to dispense with the rule of reading
Ordinance ¢389 on three separate days. Councilman Landon
seconded. Roll Call Vote: Quick, yes; England, yes; Landon,
yes; Wood, yes.
Councilman Wood moved ~o adopt Ordinance ¢389 as read.

MAILBOX ORDINANCE - An ordinance amending Section 10.04.050 of the
Chubbuck Municipal Code to make it unlawful to park in front
of a mailbox or otherwise obstruct access to a mailbox.
Mayor Cotant read ordinance in full for the first reading.
Attorney Holmes stated the only change in current ordinance
is the requirement of no parking in front of a mailbox or
within twelve feet of a mailbox.
After discussion, Council decided to table the Mailbox
Ordinance until the January 26th., i993 Council Meeting.
GRAFFITI ORDINANCE - Enacting Chapter 9.28 of the Chubbuck
Municipal Code providing for the removal of graffiti,
providing for the removal of graffiti providing for notice and
service of notice upon property owners, requiring them to
abate any graffiti nuisance; providing for removal Dy the city
if the owner fails to remove the graffiti; providing for
assessment of the costs of any such removal against the
property pursuant to Idaho Code 50-1008.
Attorney Holmes read Graffiti Ordinance in full for first
reading.

GRAFFITI ORDINANCE -(cont.) -
After discussion, Council decided to table the Graffiti
Ordinance until the January 26th., 1993 Council Meeting.
FINANCIAL REPORT for month of December, i992 presented to Mayor
Cotant and Council.
WATER AND SEWER RATE DISCUSSION - Mayor Cotant suggested the water
and sewer rate discussion be tabied until the January 26th.,
1993 Council Meeting, after further review.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved to approve computer print-out claims as
presented. Councilman England seconded. Ail council members
voted in favor of motion.
CHUBBUCK DAYS CELEBRATIONs - Councilman Wood skated the Association
of Idaho Cities Convention will be held the last week in June,
1993. Councilman Wood was asked to meet with Keith Hlrschi,
Chubbuck Baseoall Commissioner, %hen decide which weekend to
have the chubbuck Days Celebration.
At
8:48 p.m., Councilman Landon moved ~o go ~o executive session
meeting, to discuss dismissal of an employee as authorized by
Idaho Code 67-2~45 (b). Councilman Wood seconded. 100% of
council members voted in favor of mo%ion.
No action or final decision was made.

Councilman England moved to adjourn from executive
meeting to regular meeting. Councilman Landon
Ali council members voted in favor of motion.
At 9:39 p.m., Councilman Wood moved, Councilman Landon seconded,
with full council approval to adjourn meeting.
