HomeMy WebLinkAbout0461 Land Use Development Commission 1996CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 461 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTIONS 2.28.020 OF THE CHUBBUCK MUNICIPAL CODE TO PROVIDE THE MEMBERS OF THE CITY COUNCIL SITTING ON THE LAND USE AND DEVELOPMENT COMMISSION SHALL BE NON-VOTING; PROVIDING COMPENSATION OF TEN DOLLARS PER MONTH TO EACH COMMISSION MEMBER REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 2.28 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Amending Section 2.28.020. Section 2.28.020 of the Chubbuck Municipal Code is amended as follows: 2.28.020 Membership; terms of office. A. The planning commission shall consist of nine members to be appointed by the mayor with the consent and approval of the council, one of which members shall be a member of the council; provided, further that one member appointed shall also be a member of the Bannock County planning committee or similar intergovernmental planning agency. B. The member who is a member of the council shall not have a vote in commission decisions and shall serve for an indefinite time at the pleasure of the mayor and other members of the council. The other such members shall serve as follows: four of such members shall serve for a term of two years and four members shall serve a term of four years, the respective terms of office to be determined by lot at the first meeting held after the effective date of this chapter. As between the two additional offices created by this amendatory ordinance, the determination of which shall have an initial term of four years and which shall have an initial term of two years, will be accomplished by lot at the first meeting held after the effective date of this chapter. Two members of the commission may be nonresidents of the City of Chubbuck who reside within two miles of the city limits of the city; other members shall be residents of the city. D. Members shall be selected without regard to political affiliations, and each shall sefve withetit eempensa4ioB be reimbursed $10.00 per month for each moth of service. The commission shall elect its own chairman and may create and fill such other offices as it may determine necessary. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 2.28 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
