HomeMy WebLinkAbout0499 Parking Space Requirements 1998CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 499 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 18.12.030 I TO CHANGE THE REQUIRED PARKING FOR ELEMENTARY AND JUNIOR HIGH SCHOOLS TO TWO PARKING SPACES FOR EACH CLASSROOM AND ONE FOR EACH FIVE SEATS AND TO CHANGE THE PARKING FOR COLLEGES AND UNIVERSITIES TO ONE FOR EACH FOUR STUDENTS IN ADDITION TO ONE FOR EACH THREE EMPLOYEES AND 25% OF THE TOTAL FOR VISITOR PARKING; ESTABLISHING A CONDITIONAL USE PERMIT PROCEDURE FOR REDUCTION IN TOTAL PARKING SPACES REQUIRED WHERE A JOINT USE AGREEMENT EXISTS BETWEEN ADJACENT PROPERTY OWNERS; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 18.12.030(I) is amended as follows: I. Off-street parking requirements. Type of Use Schools public, parochial or private) 1. Elementary and junior high schools 2. High schools 3. Business, technical and trade schools 4. Colleges, universities 5. Kindergartens, child care centers, nursery schools and similar uses Ordinance - Page 1 dsc chbbck03.302 Parking Space Rewired 2 for each classroom and 1 for every S 5 seats in auditoriums or assembly halls 1 for every 10 students and 1 for each teacher and employee 1 for each 2 students 1 for each 4 students. 1 for each 3 employees and parking for visitors calculated as 25% of the total for students and employees 2 for each classroom, but not less than 6 for the building In the interpretation of this subsection I, the following shall govern: 1. Parking spaces for other permitted or conditional uses not listed in this subsection shall be determined by the City Council. 2. Fractional numbers shall be increased to the next whole number. 3. Where for any reason parking demand is unusually high or low, then the parking space provisions cited above may be adjusted proportionately by the Council without the necessity of a variance. 4. Paved surfaces must be provided for all off-street parking and such surfaces must be maintained, kept clean and have striping designating the parking area. Such parking spaces and the striping shall comply with acceptable parking lot design and with all appropriate laws including the Americans with Disabilities Act. 5. A paved driveway shall connect the public right of way or other road providing access to the property and the required off-street parking. 6. Two or more adjacent or contiguous other than residential) users of off street parking subject to this subsection I may petition for a conditional use permit to decrease the total number of required narking spaces on the basis that the users have entered into a -oint use agreement for parking. In reviewing this conditional use permit, in addition to the requirements set forth in 18.28.040, the following factors shall be considered: A. Whether the uses of the property and the suggested number of parking places b the he applicant will be compatible as to type of use or hours of use resulting in an actual reduction in the number of parking spaces needed. Whether the reduced number of parking spaces is offset by other desirable amenities such as increased landscaping or common area or reduced need for onsite storm water retention due to decreased hard surface parkin area. rea. C. Such other factors as applicant or the reviewing body may deem appropriate given the proposed use of the land and location of the land with respect to other development. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18.12 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
