COUNCIL MEETING MINUTES
October 27"., 1998
Minutes of regular meeting held at City Municipal Building, October 27"., 1998.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
INVOCATION was given by Council Member W. Dean Wood.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to Regular
Meeting Minutes of October 13"., 1998.
Councilman Quick moved to approve Regular Meeting Minutes of October 13` "., 1998 as
read. Councilman Wood seconded. All council members present voted in favor of
motion.
HEARING ON FEE INCREASES - RESOLUTION #8 -98 AND RESOLUTION #9 -98 -
Mayor Cotant declared the hearing open asking for comment from public.
PWD Smart stated the City of Pocatello has raised wastewater treatment rates and
wastewater utility plant capacity service fees to the City of Chubbuck, effective the I". of
October. These resolutions cover the increases.
Richard Marley, 5150 Stuart asked how this will affect his sewer bill. The rate is $18.50
per single family home at this time, the increase will increase the single family sewer rate
to $19.75 per month. Mr. Marley expressed concern City of Pocatello will keep raising
the rate.
Discussion about how wastewater is metered to City of Pocatello sewer capacity plant.
There being not other comment, Mayor Cotant declared the public hearing closed.
RESOLUTION #8 -98 - Amending the rates to be charged by the City for wastewater collection
and treatment services furnished through the Municipal Wastewater System.
Councilman England moved to adopt Resolution #8 -98 as read. Councilman Gunter
seconded. All council members voted in favor of motion.

RESOLUTION #9 -98 - Amending the fees to be charged by the City for connection to the City
Wastewater Collection System and treatment services furnished through the Municipal
Wastewater System.
Councilman Wood moved to adopt Resolution #9 -98 as read. Councilman England
seconded. All council members voted in favor of motion.
INTERGOVERNMENTAL AGREEMENT WITH RESPECT TO THE CHUBBUCK
DEVELOPMENT AUTHORITY AND IT'S URBAN RENEWAL PLAN - This
Intergovernmental Agreement is entered into pursuant to Idaho Code 67 -2332 by and
among the Chubbuck Development Authority, the City of Chubbuck and Bannock
County, through its Board of Commissioners and the Bannock County Assessor.
Councilman Gunter moved to direct Mayor Cotant to enter into the Intergovernmental
Agreement with Bannock County with respect to the Chubbuck Development Authority
and it's Urban Renewal Plan. Councilman Quick seconded. All council members voted in
favor of motion.
RESOLUTION # 10 -98 - Approving the change of control of the Cable Communications
Franchise.
Councilman England moved to adopt Resolution #10 -98 as read. Councilman Wood
seconded. All council members voted in favor of motion.
CABLE TV FRANCHISE ORDINANCE - Repealing former Cable TV Ordinance Number 262
and enacting a new Cable TV Franchise Ordinance.
Attorney Holmes read Cable TV Franchise Ordinance by title only, for the second
reading.
Council tabled the Cable TV Franchise Ordinance until the November 10`h., 1998 Council
Meeting.
IDAHO POWER FRANCHISE ORDINANCE - Scott McDonald is in process of incorporating
suggested changes at October 13`h., 1998 Council Meeting.
Council decided to table the Idaho Power Franchise Ordinance, until the November 10"'.,
1998 Council Meeting. The proposed ordinance was read two times by title at prior
Council Meetings.

ORDINANCE - Amending Section 18.12.030 (I), to change the required parking for elementary
and junior high schools to two parking spaces for each classroom and one for each five
seats and to change the parking for colleges and universities to one for each four students
in addition to one for each three employees and 25% of the total for visitor parking;
establishing a conditional use permit procedure for reduction in total parking spaces
required where a joint use agreement exists between adjacent property owners.
Mayor Cotant read ordinance by title only for the second reading, one of which was in
full.
Council decided to table the ordinance until the November 10"., 1998 Council Meeting.
PER DIEM FOR CITY EMPLOYEES - Chief of Police Jerry Rowland said it had come to his
attention there was some confusion as to our per diem request at last Council Meeting.
For the purpose of making the request easier and less confusing, he submits the following
for approval:
All travel done in state, out of state, or to "resort" towns be granted a total of
$30.00 per day for per diem. Individual meal allocations will be divided up as
follows:
Breakfast - $ 7.50
Lunch - $10.50
Dinner - $16.50
Breakfast and Lunch - $18.00
Lunch and Dinner - $27.00
Councilman Gunter asked why the totals of breakfast, lunch and dinner do not add up to
the $30.00.
After discussion, Council decided to table the City Employee per diem request until the
November 10t'., 1998 Council meeting.
AGREEMENT - RADIOS TO IDAHO STATE UNIVERSITY OF PUBLIC SAFETY
Councilman Quick moved to direct Mayor Cotant to enter into agreement with Idaho
State University Department of Public Safety for radios described in the agreement.

FINANCIAL REPORT for month of September, 1998 presented to Mayor Cotant and Council.
QUARTERLY REPORT for Ending September 30"'., 1998.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Wood moved to approve computer print -out claims as presented.
Councilman England seconded. All council members voted in favor of motion.
At 8:18 p.m., Councilman Wood moved, Councilman Quick seconded, with full council
approval to adjourn meeting.
