Cotant, Council Members Leroy S. Quick, Marvin C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart. And City Clerk Ron C. Conlin. Councilman Steven M. England was excused. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to Special Meeting Minutes of, April 14, 1998, Regular Meeting Minutes of, April 14, 1998 and Special Meeting Minutes of, April 16, 1998. Councilman Wood moved to approve Special Meeting Minutes of, April 14, 1998 as read. Councilman Quick seconded. All council members present voted in favor of motion. Councilman Quick moved to approve Regular Meeting Minutes of, April 14, 1998 as read. Councilman Gunter seconded. All council members present voted in favor of motion. Councilman Gunter moved to approve Special Meeting Minutes of, April 16, 1998 as read. Councilman Quick seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - D. Matthew Lucas, Summer Snow, 355 Kurtwood Drive has applied for license to sell shaved ice from a vending truck on City streets. Police Department recommended approval of the business license. Councilman Wood moved to grant a business license to D. Matthew Lewis, 355 Kurtwood Drive, Summer Snow to sell shaved ice from a vending truck on City streets. Councilman Quick seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - Jim Smith, 1108 Linwood Ave. SW, Tumwater, Washington has applied for a business license to operate a Go Kart Track on Wa1Mart's Parking Lot. Police Department stated they received no complaints from last year. 79 COUNCIL MEETING MINUTES - (cont.) April 28, 1998 BUSINESS LICENSE APPLICATION - FRANKIES FAST TRACK - (cont.) Councilman Gunter moved to grant a license to Jim Smith, Frankies Fast Track to operate a Go Kart Track at the WalMart Parking Lot. Councilman Wood seconded. All council members present voted in favor of motion. PROCLAMATION - POPPY MONTH AND MAY 15T ". AND 16T "., 1998 POPPY DAYS - Councilman Wood moved to authorize Mayor Cotant to proclaim, May 15`h. and May 16`h., 1998 as "Poppy Days" and the Month of May as, "Poppy Month ". Councilman Quick seconded. All council members present voted in favor of motion. FRASURE INDUSTRIAL PARK 1ST. ADDITION FINAL PLAT - Tim Shurtliff, 426 W. Lewis passed out a copy of the preliminary plat that was approved, stating the reason is because Charlie Frasure is requesting a change in the preliminary plat, Mr. Frasure is required to go back through the Land Use & Development Commission for approval of these changes. Mr. Shurtliff explained the proposed changes. Mr. Shurtliff said Charlie Frasure would like to get some kind, of approval or understanding the Council is aware the preliminary plat will be changed. Mr. Shurtliff explained there will be four lots added to the preliminary plat, two on each side of Brooke Lane. Mr. Sturtliff said, Charlie Frasure would like to do the construction on the proposed addition to the preliminary plat at same time he is doing the already approved preliminary plat, including Laurel Lane improvements. PWD Smart recommended Council give Charlie Frasure approval to start construction. Councilman Quick moved to approve the Frasure Industrial Park I ". Addition Final Plat as presented. Councilman Wood seconded. All council members present voted in favor of motion. ORDINANCE #481 - Repealing Sections 15.04.010, 15.04.020, 15.04.040, of the Chubbuck Municipal Code, revising the Title of Chapter 15.04 to " Uniform Codes ", repealing Chapter 15.08, 15.28 and 8.32 in their entirety; adopting a revised Chapter 15.04 to adopt the 1997 Editions of the Uniform Building Code, adopting the 1996 Editions of the National Electrical Code, adopting Appendix B, Chapter 13 of the Uniform Mechanical Code with respect to fuel gas piping; adopting Uniform Code for abatement of dangerous buildings, 1996 Edition, setting forth a standard to determine when an existing structure must be updated to the Handicap Accessibility Code; requiring the building department to be advised when a habitable structure is damaged, setting forth the method by which value of construction is determined for purposed of permit assessment. 81 COUNCIL MEETING MINUTES - (cont.) Councilman Wood moved to dispense with the rule of reading Ordinance #481 on three separate days. Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Wood, yes. Councilman Gunter moved to adopt Ordinance #481 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Wood, yes. APPROVAL OF CERTAIN POLICE DEPARTMENT RECORD DESTRUCTION - Chief Jerry Rowland presented a list of records that are duplications that he would suggest be destroyed. Councilman Quick moved to grant Chief Jerry Rowland permission to destroy the listed records. Councilman Wood seconded. All council members present voted in favor of motion. ORDINANCE #482 - Changing the name of Eva Street in the Kasiska Subdivision, to Sequoia. Mayor Cotant read Ordinance #482 in full for the first and final reading. Councilman Wood moved to dispense with the rule of reading Ordinance #482 on three separate days. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Wood, yes. Councilman Wood moved to adopt Ordinance #482 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Wood, yes. ORDINANCE #483 - De- Annexing certain lands presently included within the boundaries and jurisdictional limits of the City of Chubbuck. Mayor Cotant read Ordinance #483 in full for the first reading and final reading. Councilman Quick moved to dispense with rule of reading Ordinance #483 on three separate days. April 28, 1998 ORDINANCE #484 - Adding Section 1.04.0 10 to the Chubbuck Municipal to provide an administrative charge of ten percent, (10 %) may be added to any time and materials charge assessed by the City to compensate the City for its general overhead. Attorney Holmes read Ordinance #484 in full for the first reading. Councilman Quick moved to dispense with the rule of reading Ordinance #484 Councilman Wood seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Wood, yes. Councilman Wood moved to adopt Ordinance #484 as read. Councilman Gunter seconded. ORDINANCE - Repealing Sections 08.08.010, 08.08.020 and 08.08.030 of the Chubbuck Municipal Code and inserting in lieu thereof Section 08.08.0 10 requiring any retail sales of non - aerial common fireworks or public display or other event using fireworks to have a permit. Mayor Cotant and Attorney Holmes read ordinance in full for the second reading. Council tabled the ordinance until the May 12, 1998 Council Meeting. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Wood moved to approve computer print -out claims as presented. Councilman Gunter seconded. All council members present voted in favor of motion. HEALTH INSURANCE DISCUSSION - City Clerk Ron Conlin stated there will be an Employee Meeting, Thursday, at 4:30 p.m. in City Council Chambers.
