Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Steven M. Smart and City Clerk Ron C. Conlln. Public Works Director Steven M. Smart was excused. Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant. INVOCATION was given by Bishop Ted Corrington, Chubbuck 5th. Ward, The Church of Jesus Christ of Latter-Day Saints. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections or additions to regular meeting min~ltes of A~lgust 8, 1995. Councilman Wood moved to approve regular meeting minutes August 8, 1995 as read. Councilman Gunter seconded. All council members present voted in favor of motion. of WATERLINE CONSTRUCTION BID RECAP - PWD Smart presented a recap of the Hawthorne Ave. Waterline Construction Bid: Bidder E & G Const. Councilman England seconded. council members voted in favor of motion. low bid of S102,537.00, &G Ail BUSINESS LICENSE APPLICATION Michael Lionl Perrigo, Llonl Ind. Contractors, 426 1/2 E. Chubbuck Rd. has applied for license to do General Contracting in the City of Chubbuck. Mr. Perrlgo presented a license and required bond from the City of Pocatello. Chubbuck Police Department approved the license application. BUSINESS LICENSE APPLICATION - MICHAEL PERRIGO - (cont.) 117 Councilman Gunter moved to grant a business license to Michael Lioni Perrigo, Lioni Ind. Contractors to do general contracting in the City, subject to Mr. Perrigo including the City of Chubbuck as additional insured on his Certificate of Insurance. Mr. Perrigo was directed to send the Certificate of Insurance to Chief of Police Jerry Rowland. Councilman Quick seconded. All council members voted in favor of motion. PUBLIC HEARING - 1995-96 FISCAL YEAR BUDGET - Mayor Cotant declared the public hearing open. Mayor Cotant read the public hearing notice in full. Roy Rhodes, 4431 Hawthorne Rd. asked why the increase of approx. S280,000. in General Fund Revenue Sources other than property taxes. City Clerk Ron Conlin explained most of the increase is due to the first year of Urban Renewal Funds collected, ($194,510.), and budgeted in the General Fund, the balance is some increases in each of the departments. Mayor Cotant stated where he would like to see Urban Renewal Funds might be used in the General Fund. Mayor Cotant suggested the City require a 1% franchise fee from Idaho Power Co. approx. ($24,000.). $20,000. of this will be used to give relief on property taxes to residents. Mayor Cotant suggested some be used on the "Drug Free Work Place" Program that will be implemented. Mayor Cotant stated, Attorney Holmes has not requested an increase in contract, but suggested some consideration be given. Mayor Cotant suggested, when the sewer lawsuit with the City of Pocatello is resolved, if possible the resident sewer rate be lowered approx. $5.00 per residence. There will be further discussion at the September 12, 1995 Council Meeting. Discussion about increasing Mayor and Council salaries, $100.00 for Councilmembers, S200.00 for Mayor. City Clerk Conlln stated the last day an ordinance, for this budget year increasing the salaries of Mayor and Council can be adopted September 8, 1995. There being no more comment, Mayor Cotant declared the public hearing closed. 119 ORDINANCE #440 An ordinance appropriating the several sums of money deemed necessary and sufficient to defray all expenses and liabilities of the City of Chubbuck for the fiscal year beginning on the First Day of October, 1995, and ending on the 30th. day of September, 1996, and designating the different funds to which shall be drawn and paid, and known as the "Annual Appropriation Ordinance of Fiscal Year, 1995-96", pursuant to the provisions of Section 50-1003, Idaho Code. Attorney Holmes read Ordinance #440 in full for the first reading. Councilman Quick moved to dispense with the rule of reading Ordinance S440 on three separate days. Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Wood moved to adopt Ordinance #440 as read. Councilman Quick seconded. Roll Call Vote: Qulck, yes; England, yes; Wood, yes; Gunter, yes. RESOLUTION #5-95 Dollar certification of budget request to Bannock County Commissioners. City Clerk Conlln read Resolution #5-95 in full. Councilman Wood moved to adopt Resolution #5-95 as read. Councilman Gunter seconded. All council members voted in favor of motion. PROFESSIONAL SERVICES CONTRACT - Contract between the Chubbuck Development Authority and SICOG. Todd Hong, SICOG Planning Director was present at the August 8, 1995 Council Meeting, explaining changes in 1995-96 Contract. After discussion, Councilman Wood moved to authorize Mayor Cotant to enter into a Professional Services Contract with SICOG. Councilman England seconded. All council members voted in favor of motion. WATER DAMAGE CLAIM - M.J. Nelson, 606 Boyd presented a water damage claim, ($2,177.94), with receipts on May 30, 1995. The damage occurred on November 6, 1995. The claim was sent to City Insurance Co. City Insurance Co. denied the claim, and the appeal, because the damage claim was not turned in within 180 days, as required by State Law. WATER DAMAGE CLAIM - M.J. NELSON - (cont.) 121 Mr. Nelson said, because of time of year, he could not get the repair work completed. Mr. Nelson said he did receive the claim form from the City, but, did not open, so he was not aware of the deadline. After discussion, council was in consensus to pay the claim. City Clerk Conlln was dir~ected to send in all details of why Mr. Nelson did not get the claim into the City by required deadline, to ICRMP, suggesting they reverse their decision. ~ CLAIMS - Computer print-out and hand check claims presented to Mayor Cotant and Council. M.J. Nelson, 606 Boyd Water damage claim - $ 2,177.94 Councilman Gunter moved to approve computer-print and hand check claims as presented. Councilman Gunter seconded.
