COUNCIL MEETING MINUTES
November 26, 1996
Minutes of regular meeting held at city municipal building,
November 26, 1996.
Present: Mayor John O. Cotant, Council members Steven M. England~
W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes,
Public Works Director Steven M. Smart and City Clerk 2on C.
Conlin. Councilman Leroy S. Quick was excused.
Meeting called to order at 7:38 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG:
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or
additions to regular meeting minutes of November 12, 1996.
Councilman Wood moved to approve regular meeting minutes of
November 26, 1996 as read. Councilman England seconded. All
council members present voted in favor of motion.
ORDINANCE #466 - Expressing an intent to sell, convey or exchange
certain described real property owned by the City; authorizing
a sale for cash or terms of said parcel by public auction to
the highest bidders for amounts equaling or exceeding the
appraisals; reserving to the City the right to reject any or
all bids on any parcel; prohibiting such sale from occurring
until sixty days have expired from the date of passage of this
ordinance and a public hearing has been held during that
period; providing that proceeds from sales shall be used to
discharge city indebtedness or for public improvements;
providing that if the property is not sold at public auction,
the same may be exchanged for other property without further
notice or auction.
Mayor Cotant read Ordinance #466 in full for the first and
final reading.
Councilman Wood moved to dispense with rule of reading
Ordinance #466 on three separate days. Councilman Gunter
seconded. Roll Call Vote: Quick~ absent; England, yes; Wood,
yes; Gunter, yes.
Councilman England moved to adopt Ordinance #466 as read.
Councilman Wood seconded. Roll Call Vote: Quick, absent;
England, yes; Wood~ yes; Gunter~ yes.

ORDINANCE #467 - Vacating the Jeff Lane right-of-way on the
approved and recorded plat of Bar-X Tracts Subdivision.
Attorney Homes read Ordinance #467 in full for the first and
final reading.
Councilman England moved to dispense with rule of reading
Ordinance #467 on three separate days. Councilman Wood
seconded. Roll Call Vote: Quick, absent; England, yes; Wood,
yes; Gunter~ yes.
Councilman Gunter moved to adopt Ordinance #467 as read.
Councilman Wood seconded. Roll Call Vote: Quick, absent;
England~ yes; Wood~ yes; Gunter, yes.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved to approve computer print-out claims as
read. Councilman Gunter seconded. All council members present
voted in favor of motion.
At 7:55 p.m., Councilman England moved to go into executive session
meeting as authorized by Idaho Code 63-2345(a) to discuss a
personnel matter. Councilman Wood seconded. Roll Call Vote:
Quick, absent; England, yes; Wood, yes; Gunter~ yes. 100% of
council present, voted in favor of motion.
No action or final decision was made
At
8:00 p.m.~ Councilman Wood moved, Councilman Quick seconded,
with full council approval to adjourn to regular meeting from
executive session meeting.
PERSONNEL MATTER - Councilman Wood moved to waive contractual
agreement inregards to monies owed only, with former Police
Officer Brent Lusk. Councilman Gunter seconded. All council
members present voted in favor of motion.
At 8:05 p.m., Councilman Wood moved, Councilman Gunter seconded,
with full council approval to adjourn meeting.
