Cotant, Council members Leroy S. Quick, Steven bi. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7:30 p.m. by Mayor John O. Cotant. PLEDGE ALLEGIANCE TO THE FLAG: APPROVAL OF MINUTES: Mayor Cotant asked for corrections or additions to regular meeting minutes of October 22, 1996. Councilman Wood moved to approve regular meeting minutes of October 22, 1996 as read. Councilman Gunter seconded. All council members voted in favor of motion. HOMES WEST~ INC. - PLANNED UNIT DEVELOPMENT FINAL PLAT - PWD Smart stated the Preliminary Plat and Development Preliminary Plan were approved in July, 1996. This is the final plat. Attorney Holmes recommended the Final Plat and Final Development Plan go to the Land Use and Development Commission as required by City Code. Derek Leslie, Homes West, Inc. was told his Final Development Plan will need to be complete~ then given to Public Works Department for review. If everything is okay the Final Development Plan will be put on the December 5, 1996, Land Use & Development Commission Agenda, then forwarded, with recommendations to the City Council Agenda, December 10, 1996. BUSINESS LICENSE APPLICATION - Darrell Pinney, The Elves Christmas Forest has applied for license to sell christmas trees at the Chubbuck Wal-Mart Parking lot~ 4240 Yellowstone Ave. Police and Fire Departments recommended approval of the license. Councilman Quick moved to approve a business license to Darrell Pinney, The Elves Christmas Forest, to sell christmas trees at the Wal-Mart Parking Lot, 4240 Yellowstone Ave. Councilman England seconded. All council members voted in favor of motion. 183 ORDINANCE #463 - Amending Chubbuck Code Section 18.08.040(B), to provide height and area regulations for, g-3, R-4 and C-1. Mayor Cotant read Ordinance #463 in full for the third and final reading. Councilman Gunter moved to adopt Ordinance 1463 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood~ yes; Gunter, yes. ORDINANCE #464 - Amending Section 10.06.040 of the Chubbuck Municipal Code to clarify the unlawful use of accessible parking special placards and amending Section 10.06.070 making it unlawful to display altered special license plates, placards, or their registration cards and decals. Mayor Cotant read Ordinance #464 by title only for the third and final reading. Councilman England moved to adopt Ordinance #464 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE #465 - Adding Section 16.12.025, "Access Management" to the Chubbuck Municipal Code. Mayor Cotant read Ordinance #465 in full for the second reading. Attorney Holmes suggested, "and as may from time to time be amended," be inserted after; as adopted by the Bannock Planning Organization, on September 3, 1996. Councilman Quick moved to dispense with rule of reading Ordinance #465 on three separate days. Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter~ yes. Councilman Quick moved to adopt Ordinance #465, subject to inserting; "and as may from time to time be amended", after; as adopted by the Bannock Planning Organization~ on September 3~ ].996. Councilman England seconded. Roll call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. PROCLAMATION - Mayor Cotant read proclamation if full. Councilman Wood moved to direct Mayor Cotant to proclaim, November 24th. to December 1, 1996 as "Bible Week". Councilman Gunter seconded. Ail council members voted in favor of motion. 185 GENERAL EMPLOYEE POLICY - Council reviewed the revised Personnel Policy Manual which included two amendments. On page 6, Article 1, paragraph (C), employees is changed to twelve months, to the Police Department. the probationary be consistent with On page 10, a change has been made to paragraph (D)(17), referring to alcohol or illegal drug use and providing that testing positive for use of drugs shall be evidence of being under the influence at work. Nothing else has been changed in the policy. After discussion, Councilman England moved to adopt the Revised October, 1996 General Employee Policy as read. Councilman Gunter seconded, all council members voted in favor of motion. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Wood moved to approve computer print-out claims as presented. Councilman England seconded. All council members voted in favor of motion. At 8: 10 p.m., Councilman Gunter moved to go into executive session meeting as authorized by Idaho Code 63-2346(a) to discuss hiring of personnel in 1996-97 Fiscal Year Budget. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. 100% of council voted in favor of motion.
