COUNCIL MEETING MINUTES
October 16, 1996

Present: Mayor John O. Cotant, Councilmembers Leroy S. Quick,
Steven M. England, W. Dean Wood, Marvin C. Gunter, Public
Works Director Steven M. Smart and City Clerk Ron C. Conlin.
Attorney Thomas J. Holmes was excused.
Meeting called to order at 5:00 p.m. by Mayor John O. Cotant.
The
object of the Special Meeting shall be to discuss, 1)
Guidelines for policies on controlled access arterial and
collectors and proposed access and circulation plans. 2)
Executive Session Meeting to consider possible purchase of
city property. 3) Council may wish to consider purchase of
property at 204 Hiway Ave. 4) Cotant Park fence discussion -
Clark & Tracy Anderson, 703 Bonanza.
COTANT PARK FENCE DISCUSSION - CLARK & TRACY ANDERSON, 703 BONANZA
Mayor Cotant stated Mr. & Mrs. Anderson came in to discuss
their continued problem of kids going through their yard to
get to Cotant Park and kids going after balls thrown or hit
into their yard. There is a practice field located next
their property. Mr. & Mrs. Anderson asked for some help on the
installation of a fence.
Discussion about what type of fence will be best to install.
Councilman Gunter expressed concern about setting a precedence
if the City participates with the installation of a fence.
Councilman England suggested, maybe City can purchase fence
material, then ].et the Anderson's install the fence.
51ayor Cotant suggested he will talk to Mr. & Mrs. Anderson
again to see how much they want the City to participate.
Councilman England moved to direct Mayor Cotant to talk to Mr.
& ~rs. Anderson about City purchasing fencing material, then
requiring Mr. & Mrs. Anderson to install the fence. Councilman
Wood seconded. Ail council members voted in favor of motion.
At 5:
22 p.m., Councilman England moved to go into executive session
meeting as authorized by Idaho Code 63-2345(c) to discuss
acquisition of real property which is not owned by a public
agency. Gunter seconded. Roll Call Vote: Quick, yes; England~
yes; Wood~ yes; Gunter, yes. 100% of council voted in favor of
motion.

No action or final decision was made.
At
5:30 p.m., Councilman Wood moved to adjourn from executive
session meeting. Councilman Quick seconded. All council
members voted in favor of motion.
PROPOSED PURCHASE OF 204 HIWAY AVE. - PWD Smart explained the
appraisal prepared by Steve Teeples.
After discussion, Councilman England moved to direct Mayor
Cotant to enter into negotiations for 204 Eiway property,
not to exceed the amount of $75,000.00. Councilman Quick
seconded. All council members voted in favor of motion.
CONTROLLED ACCESS ARTERIAL & COLLECTORS AND PROPOSED ACCESS AND
CIRCULATION PLANS - At the October 8, 1996 Council Meeting~ .
Council requested a Special Meeting to conduct a study
session on the guidelines. ~'
PWD Smart explained the guidelines, stating the purpose of
access management.
Derrol from Bannock Planning Organization was present to
answer questions and concerns of Mayor Cotant and CounCil.~
Larry Kohntopp~ Planning Assistant was present to pres6~t ~his
suggestions on site access and parking design.
PWD Smart stated Attorney Holmes is drafting an ordinance
for presentation to Council, at the October 22, 1996 Council
Meeting.
At 6:21 p.m., Councilman Wood moved, Councilman England seconded,
with full council approval to adjourn meeting.

Pursuant to..Ida~ Code Section 50-604, the undersigned )fayor
of the City of Chubbuck, Idaho, hereby calls a special meeting of
the City Council to be held at the Chubbuck Municipal Building, at
the hour of 5:00 p.m., on Tuesday, the 15th. day of October, 1996.
