COUNCIL MEETING MINUTES
August 13, 1996
Minutes of regular meeting held at city municipal building,
August 13, 1996.
Present: Mayor John O. Cotant, Councll members Leroy S. Qulck,
W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes,
and Clty Clerk Ron C. Conlin. Councliman Steven M. England
and Publlc Works Director Steven M. Smart were excused.
Meetlng was called to order at 7:35 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to minutes of July 23, 1996.
Councilman Wood moved to approve regular meeting minutes of
July 23, 1996 as read. Councilman Gunter seconded. All council
members present voted in favor of motion.
DAY CARE APPLICATION - JILLANE WARD - TEACH-A-TOT, 5565 YELLOWSTONE
AVE. - Jillane Ward has made application for a Day Care Center
at the corner of Yellowstone Ave. and Siphon Road.
Tlle applicant has obtained approval from Police, Planning,
Design Review and Building Departments.
Building inspector Cary Campkell presented recommendations and
comments.
Councilman Wood moved to grant a Day Care License to Jillane
Ward, Teach-A-Tot, 5565 Yellowstone Ave., subject to complying
with recommendations of Building Inspector Cary Campbell.
Councilman Quick seconded. All council members present voted
in favor of motion.
ORDINANCE - Amending Chapter 15.24, sign regulations, to provide
for the regulation of permanent signs commonly known as
billboards, defining billboards and prohibiting further
billboards wittlin the City of Chubbuck, except for those
associated with a busimess adjacent to, or near the
billboard.
Attorney Holmes read Ordinance by title cn!y for the second
reading.
Council tabled the ordinance until the August 27, 1996 council
- Meeting.

CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Gunter moved to approve ~

as presented. Councilman Wood seconded. All council members
voted in favor of motion.
1996-97 FISCAL YEAR BUDGET DISCUSSION City Clerk Ron Conlin
presented the 1996-97 Budget Revenues as compared to the
budget requests received from departments.
City Clerk Conlin explained the expenditures are S156,979.
more than the revenues coming in.
City Clerk Conlin explained Police Department is asking for .
S154,739 more than last year, Parks Department is asking for
$57,434. more than last year. %
Discussion about using tax increment monies in construction
projects in Parks Department.
After considerable discussion, Council directed City Clerk
Conlin to set a special meeting for, Tuesday, August 25, !99S
at 5:$0 p.m. for approval of a 1996-97 Tentative Budget and
set date for public hearing of 1996-97 Fiscal Year Tentative
Budget.
At 8:Be p.m., Councilman Wood moved, Councilman Quick seconded~,
with full council approval to adjourn meeting.

TEACH-A-TOT DAY CARE
5565 YELLOWSTONE AVE.
Ms. Jillane Ward has made application for a Day Care Center at the
corner of Yellowstone Avenue and Siphon Road. This Day Care Center
is in a General Commercial (C-2) Zone. The business did not have
to obtain a Conditional Use Permit from the Land Use Commission.
However, they did have to appear before the Design Review Committee
and have completed the items required by that body.
They have obtained approval from the police, planning and building
departments.
As required by City Code 6.04.070 the City Council must authorize
the license of the Day Care Center and set any limitations by which
the business will be restricted.
At this time they are close to receiving an occupancy permit. They
have built an addition to the existing structure. They now have
total of 1961 square feet which can be used for Day Care Services.

for a building of this size, including care givers; However, the
exit doors all open in, therefore,

until the doors open outward in the direction of egress. With an
occupant load of 49, no more than 45 children may be cared for.
An occupant load of 56 would allow for 51 children and five (5)
adults to occupy the structure at any one time.
The structure's entrance ramp also does not meet the minimum slope
for handicap accessibility. The minimum slope shall be not less
than 1 in 12. If the ramp goes over a 1 in 15 sl0pe a hand rail
must be installed. Zf the occupant load does not go over 49, the
ramp may be only 36" wide. ]f the occupant load exceeds 49, the
ramp w~11 need to be at least 44" wide. They are not restricted
on the location of the one required ramp. It may be placed at
either of the ma~n doors.
I have allowed the business to use a regular water closet (in the
one and only existing bathroom) as opposed to a handicapped one,
due to the fact that most of those using the fixture will be small
pre-school chi]dren who would not be able to get on a handicapped
unit, However they still must place the required assist bars in
the bathroom,
