Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant. PLEDGE ALLEGIANCE TO THE FLAG: INVOCATION: Bishop James Eborn, Chubbuck 3rd. Ward, The Church of Jesus Christ of Latter-Day Saints. APPROVAL OF MINUTES Mayor Cotant asked for corrections or additions to regular meeting minutes of June 25, 1996. Councilman Wood moved to approve regular meeting minutes of June 25, 1996 as read. Councilman England seconded. All council members voted in favor of motion. BUSINESS LICENSE APPLICATION DENIAL - Michael Perrigo, 426 1/2 E. Chubbuck Road has applled for a business license to conduct a continuous garage sale at least two times a week. Mu. Perrigo was denied the business license because code only allows two garage sales a year. City received a complaint from one of Mr. Perrigo's neighbors. Mr. Perrigo explained he is terminally ill, this is the only way he can make money. Attorney Holmes suggested Mr. Perrlgo apply for a major home occupation permit which includes, Mr. Perrigo obtaining approval signatures from all know occupants of the property within 30~' of the applicant's property. Mr. Perrigo was directed to apply for a major home occupation permit. Mr. Perrigo will come to City Offices to pick up application, then return the application completed as soon as possible. EASTERN POWER COUNTY FIRE DISTRICT Chairman Ron Olson and Secretary Connie Rowland were present. Mr. Olson stated as a flue district they are struggling to find the funds to pay increases proposed by the City of Chubbuck Fire Department. Mr. Olson stated they can pay what is budgeted in the 1996 Budget, but are hard pressed to pay more. 119 EASTERN POWER COUNTY FIRE DISTRICT - (cont.) Mr. Otson stated the Chubbuck Fire Department has done an outstanding 3ob for their district. After discussion, Council decided not to raise the fire protection fee to Eastern Power County Fire District in the 1996-97 Budget Year. Council will review the fee during the 1997-98 Budget Year. ORDINANCE %458 - Providing for change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck, from Agricultural, (A) to Single Family Residential, (R-l); declaring that the City Council finds that such change in Land Use District is compatible with the Land Use pattern prescribed by the City's Comprehensive Plan. Attorney Holmes read Ordinance %457 in full for the first reading. Councilman Wood moved to dispense with rule of reading Ordinance #457 on three separate days. Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Gunter moved to adopt Ordinance #457 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - CARY CAMPBELL - Councilman Wood moved to accept the Findings of Fact, Conclusions of Law and Decision for a change in land use district for the Cary Campbell proposal. Councilman Quick seconded. Ail council members voted in favor of motion. DISCUSSION ABOUT HILINE SUBDIVISION Councilman Wood expressed concern about City of Chubbuck's potential costs of future sewer line maintenance in Hlline Subdivision. The two parties involved are not speaking. Councilman England suggested the City make an offer on the lot. POCATELLO PARKS AND RECREATION FEE REQUEST City of Pocatello stated they re-evaluated their Parks and Recreation programs and presented the following options to the City of Chubbuck: 1. Charge all city/county residents the same per capita amount based on total budgets. 2. Implement a new day user fee for non-residents of the, i.e. $3.00 per day surcharge. 121 POCATELLO PARKS AND RECREATION FEE REQUEST - (cont.) 3. Implement an annual passport fee of $41.00 per no~-city resident to use programs and facilities at resident prices. 4. Formulate a resident fee structure and a non- resident fee structure that is more equitable. 5. Charge City of Chubbuck an annual amount of $22,5~.00 that will allow non-residents of Pocatello to use all facilities and programs at resident rates. After discussion, Councilman Gunter moved to deny City of Pocatello request of an annual fee for Parks and Recreation, in amount of $22,50~. that would allow non-residents of Pocatello to use all facilities and programs at Pocate!lo resident rates. Councilman Wood seconded. Ail council members voted in favor of motion. MINIMUM PARKING REQUIREMENTS - CARMIKE THEATRES - Carmike Theatres agreed to widen the intersection at Poleline Rd. and Quinn Rd. By doing this, this will eliminate six parking spaces. PWD Smart and Building Inspector Cary Campbell recommended approval of waiver of parking spaces. Councilman England moved to allow Carmike Theatres a waiver in parking requirements, to 205 spaces. Councliman Gunter seconded. All council members voted in favor of motion, CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Gunter moved to approve computer print-out claims as presented. Councilman England seconded. All council members voted in favor of motion.
