Cotant, Council members Leroy S. Quick, Steven M. England~ W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7:30 p.m. by Mayor John O. Cotant. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES: Mayor Cotant asked for corrections or additions to Regular Meeting Minutes of July 8, 1997, and Special Meeting Minutes of July 15, 1997. Councilman Wood moved to approve Regular Meeting Minutes July 8, 1997 as read. Councilman England seconded. Ail council members voted in favor of motion. of Councilman Quick moved to approve Special Meeting Minutes of July 15~ 1997 as read. Councilman Wood seconded. BUSINESS LICENSE APPLICATION Becky Fisher, Beautiful Exterior, 1733 Falcon Circle, Pocatello~ Idaho has applied for license · to do home improvements door to door in the City. Mayor Cotant asked for comments from public. Becky Fisher, 1733 Falcon Circle explained their business. Police Chief Jerry Rowland stated Bruce Kolbe had been cited in 1992 for operating without a business license, they have been warned twice by the Police Department, once by Chief Rowland. Chief Rowland stated, Friday he cited Becky Fisher with operating without a business license. Chief Rowland stated there have been complaints about Mr. Kolbe's work, one in writing. Roger Harris, 334 Steven Street, Inkom stated he paid Mr. Kolbe $10,000. with the understanding to buy the bulk of the material to start project and he would pay the crew as they finished each project. Mr. Kolbe bid the home for $21,561. As of today Mr. Harris owes him $198.00. Paid for industrial metal roof, received the cheapest & not all of it even. Mr. Harris stated the Attorney General's Office has sent him two notices that have been returned and have been marked as no such street. Pocatello Building Department, in nearly 25i jobs done up to 1992, he only got four building permits. Mr. Kolbe's license has been suspended indefinitely in Pocatello once as for Cobra Construction and also as Beautiful Exteriors. There are also complaints from the following individuals: Nora Snow, LaMar & Anita Johns, Don Haskett and Conley and Sherry Beebee. Mr. Harris stated the City of Chubbuck should not grant Becky Fisher and Bruce Kolbe a license to make home improvements in the City. Mr. Kolbe gave explanation of these concerns. Joni Barker, 804 Bonanza explained Bruce Kolbe did not do her job as he presented, so she is having someone else do the job. Ms. Barker stated she knows of two other people Mr. Kolbe is doing jobs for, Mr. Kolbe says he is finished with the jobs, but the individuals say he is not. Joni Barker expressed concern about City granting Becky Fisher and Bruce Kolbe a business license to do home improvements in the City. Police Chief Jerry Rowland recommended, if Council does grant Becky Fisher and Bruce Kolbe a business license, that a $10,000. bond be required. Also a stipulation, that if a building permit is not taken out for every job, the business license be revoked. Council was in agreement Becky Fisher and Bruce Kolbe should make an appointment with City Building Official Cary Campbell and discuss jobs in progress, along with discussing the granting of a business license. City Building Official Cary Campbell will recommend approval, or denial to the Council. If a business license is granted, Becky Fisher and Bruce Kolbe are required to have a $10,000. bond or cash, and also if the license is granted, the stipulation of Becky Fisher and Bruce Kolbe are required to get a building permit for every job in 'the City of Chubbuck. 113 DAY CARE LICENSE APPLICATION -Lola Williams and Juanita Hernadez, Fun Time Kids, 265 E. Chubbuck Rd., Suite B have applied for license to operate a day care center at 265 E. Chubbuck Road.~ Suite B. PWD Smart stated Building Official Campbell has not received enough information about the day care center, to recommend approval or denial. Councilman England moved to table the day care license application applied for by Lola Williams and Juanita Hernadez, Fund Time Kids, 265 E. Chubbuck Road, Councilman Gunter seconded. All council members voted in favor of motion. BUSINESS LICENSE APPLICATION - Mike Glover, Snack in a Sack, 2626 W. 5200 South, Rexburg~ Idaho has applied to sell snacks to businesses in the City of Chubbuck. Police Department recommended approval of business license request. Councilman England moved to grant a business license to Mike Glarer, Snack in a Sack, Rexburg, Idaho to sell snacks 'to businesses in the City of Chubbuck, Councilman Gunter seconded. Ail council members voted in favor of motion, City Clerk Conlin was directed to put on licenae~ no door to door residential selling. RESIDENTS INVITED TO DISCUSS LETTER~.ta~:OR' ' COTANT SENT TO MOBILE MANOR AND BRIARWOOD SUBDIVISIONS There were five or six residents present to discuss the letter. Captain Jim Phelps will work with Mobile Manor Residents with clean up in the area. 115 ORDINANCE - Adopting Chapter 16.48, providing system and procedure for use of a key box or hazardous materials information unit where necessary. Attorney Holmes read ordinance by title only for the second reading. Councilman England asked if the ordinance might create a situation where someone with the knowledge could break in a business. Fire Chief Dickman stated the key box is released by dispatch. Discussion about, encouraging businesses to use, rather than making mandatory. Discussing about over regulating businesses and residents. Council requested Fire Chief Dickman present names of businesses effected by the ordinance. Cit>~ Clerk Conlin will include in Council packet for August 1-th.9 Council Meeting. Council tabled the ordinance until the August 12, 1997 Council Meeting. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Wood moved to approve computer print-out claims as presented. Councilman Gunter seconded. All council members: voted in favor of motion. At Ron C. Conlin, City Clerk 9:45 p.m., Council~nan Quick moved, Councilman Wood seconded, with full council approval to adjourn meeting. ~C o't ant, Mayo ~ Mr. Kolbe told us that he was licensed and bonded for two stories and that he was the factory rep. According to the Pocatello Building Department, in nearly 251 jobs done up to 1992, he only got four (4) building perm/ts--in Pocatello where they are required! BRUCE KOI~BE'~IOBS IN AMERICAN FALLS Nora Snow: Didn't finish her sid/ng--d/dn't put up siding around the doom after committing to do so. He took her to small cia/ms court in American Fails for $650 and lost. Verbally committed to put up her fence, and to put lights, numbers, and door bells back on the house then didn't. Later sa/d it wasn't something he wrote into contract bids but charged extra for after the work was done. He verbally committed to put up a new facia board before s/ding it, because it was curled. Later, she discovered that/nstead of replacing the board, he had only shaved off some of the curl and covered it w/th the siding. He contracted with her to put insulation behind the s/ding, but she later found that he had not done that. (He did the same thing to a couple in Chubbuck--Halls.) She is writing a letter to Mayor Angstadt and ~e Pocatello City Council. La Mar & Anita Johns: Never did complete the job he contracted to do--a piece of hang/ng facia. They had to hound him an entire summer to finish the work around their chimney, which he said wasn't part of the contract to do. They also had to hound him to put trim on around the doors by making dozens of calls to him to get him back to do the work. Verbally he contracted with them to repair a 6-inch crack in the/r garage siding that had been installed by another contractor. He saidhe-nbeded to remove the entire piece of siding (15 feet by 4 inches) in order to get a proper match. After many calls to him to replace that siding, he sa/d he'd ordered the piece from Dam Lumber in American Falls. When they called the lumber yard to verify that, they were told he had neVer ordered it from them. The lumber yard also told them they should call the police, as they stated that Mr. Kolbe was an unsavory businessman. (The Johns never contacted the police.) They finally gave up calling him trying to get him back to fix the sagging piece of facia, which is still sagging. They are writing to Mayor Angstadt and the city council. Don Haskett: There is a spot on their garage that Kolbe never finished. The siding is 4 inches too short, and Bruce said he would have to replace the entire piece of s/ding, which he never did. They are writing Mayor Angstadt and the city council. .Conlev & Sherry Beebee: Kolbe's workmanship left much to be desired. He finally did what he contracted to do after being hounded for one year! He also attempted to do the facia in _three different colon. Mr. Beebee will help any way he can. They are writing a letter to Mayor Angstadt and the city council.
