COUNCIL MEETING MINUTES
May 27, 1997
Minutes of regular meeting held at city municipal building,
May 13, 1997.
Present: Mayor John O. Cotant, Council members Steven M. England,
W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes,
Public Works Director Steven M. Smart and City Clerk Ron C.
Conlin. Councilman Leroy S. Quick was excused.
Meeting called to order at 7:30 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or
additions to regular meeting minutes of May 13, 1997.
Councilman Wood moved to approve regular meeting minutes
May 13, 1997 as read. Councilman Gunter seconded. Ail
council members present voted in favor of motion.

REQUEST FOR WAIVER OF BUILDING PERMIT FEE FOR IDAHO DREAM, INC.
Darris Ellis representing Building Contractors of Southeastern
Idaho explained they decided to build a home with donated
labor, etc. to sell and put the monies to the Building
Contractors of Southeastern Idaho for various reasons,
scholarships, fighting legislation, etc. Mr. Ellis asked the
Council to waive the building permit fee of approx. $750. to
$8oo.
Council expressed concern about setting a precedence waiving
the building permit fee for one home and not another.
After discussion~ Councilman England moved to deny the request
by Idaho Dream, Inc., Darris Ellis to waive the building
permit fee for 803 E. Mountain Park Road. Councilman Wood
seconded. All council members present voted in favor of
motion.
ORDINANCE - Amending Sections 5.16.090, 5.12.090 and 5.08.080 to
extend the hours for beer, wine and liquor by the drink sales
to 2:00 a.m.; to allow beer and wine sales an hour earlier or
6:00 a.m.; to provide premises offering beer, wine and liquor
sales shall be vacated by 2:15 a.m., and providing an
effective date.
Attorney Holmes read ordinance by title only for the second
reading.
Council tabled ordinance until June 10, 1997 Council Meeting.

BUSINESS LICENSE
applied for
Parking Lot.
APPLICATION - Nolan Briscoe, 5178 Stuart has
license to sell ice drinks on Smith's Food King
Councilman England moved to grant a business license to Nolan
Briscoe, 6178 Stuart, Briscoe~s Sno Shack to sell ice drinks
from a sno shack on Smith's Food King Parking Lot. Councilman
Gunter seconded. Ail council members present voted in favor of
motion.
RESOLUTION #2-97 Whereas, the Idaho Transportation Department
has submitted an Agreement stating obligations of the State
and the City of Chubbuck for construction of Int. of Hawthorne
& Siphon Roads.
Mayor Cotant read Resolution #2-97 in full.
Councilman Gunter moved to adopt Resolution #2-97 as read.
Councilman Quick seconded. Ail council members present voted
in favor of motion.
1995-96 FISCAL YEAR AUDIT City Auditor Scott Jones was not
present. Will be on next Council Meeting Agenda.
LAMPLIGHTER HOMES~ INC. - BO Cary Campbell stated Lamplighter
Homes, Inc. is doing something different than what they
presented to the Design Review Committee.
Robert Wilkes, Lamplighter Homes, Inc. Manager stated, when
they got all their display homes in~ they found they had
enough room to put another display home on the southwest
corner of their property, that was not shown in their original
site plan.
Councilman England asked if all setback requirements are met
with the addition of the display home. Staff said they are
within required setbacks.
Mr. Wilkes stated he will go across to Parrish property line
with the required green area.
Councilman Gunter moved approve the request by Lamplighter
Homes, Inc. to put a display home on the southwest corner of
their property, subject to required landscaping being
installed. Councilman Wood seconded. All council members
present voted in favor of motion,

CAPE LICENSE APPLICATION - Nelda G. Kugler, Just For Kids
Creative Center 4801 Whitaker Road has applied for a license
to operate a day care at 4801 Whitaker Road.
Police Department recommended approval of the license.

BO Cary Campbell expressed concern about how many children
were in the home. Not sure how many children.
BO Campbell suggested a final assessment of the day care be
made.
After discussion, Councilman Wood moved to grant a day care
license to Nelda G. Kugler, 4801 Whitaker Road to operate a
day care center at 4801 Whitaker Rd., subject to approval of
Police and Building Departments, upon conditions required by
BO Campbell. Councilman England seconded. Ail council members
voted in favor of motion.

BUTLER PARKS DEDICATION FEE WAIVER REQUEST - At last Council
Meeting Jeff Butler requested the Council consider waiving the
Park Dedication Fee requirement of $285.00 per unit, for the
Western View Planned Unit Development at 311 W. Chubbuck Road.
Councilman England moved to deny Jeff Butler's request, that
Council waive the $285. per unit, Park Dedication Fee
requirement for apartments at 311 W. Chubbuck Road. Councilman
Gunter seconded. All council members present voted in favor of
motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved to approve computer print-out claims as
presented. Councilman Gunter seconded. All council members
present voted in favor of motion.
At 8:10 p.m., Councilman Wood moved, Councilman England seconded,
with full council approval to adjourn meeting.
