COUNCIL MEETING MINUTES
March 25, 1997
Minutes of regular meeting held at city municipal building,
March 25th., 1997.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney
Thomas J. Holmes and City Clerk Ron C. Conlin. Public Works
Director Steven M. Smart was excused.
Meeting called to order at 7:30 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or
additions to regular meeting minutes of March 11~ 1997.
Councilman Quick moved to approve regular meeting minutes of
March 11~ 1997 as read. Councilman Wood seconded. All c~
members present voted in favor of motion.
Councilman Wood moved to approve Special ~{eeting Minutes of
March ]3, ].997 as read. Councilman Quick seconded. Ail council
members present voted in favor of motion.
PRELIMINARY PLAT - ZONING CHANGE ANNEXATION - AFFORDABLE
RESIDENTIAL COMMUNITIES An application by L. Don Hammond, Dale
Hancock and Scott Jackson, Suite 850~ Denver, Colorado for
review of a preliminary plat and change in Land Use District,
upon requested annexation, to (R-2), General Residential.
At last Council Meeting the Council asked Mitchell Greet and
Bill Chisum to present an amended preliminary plat with
recommended changes at tonight's Council meeting.
Mayor Cotant suggested the developer that wants to develop a
trailer court in the City should be aware that a court must be
developed in a manner it will enhance our community and not in
future years become an eyesore. The traffic impact will be
heavy as this development comld produce over 2000 trips a
day. Mayor Cotant soggested the developers take this
subdivision and review their options then move toward a
subdivision that has the appearance of a normal subdivision.
Attorney Holmes stated the city received a formal objection to
any further consideration of the application by both Briarwood
Properties and Briarwood Estates Homeowner's Association
because, neither party received the required public hearing
notice.

ANNEXATION -
Attorney Holmes stated, since Briarwood owners did not receive
proper notice of the application, the application will have to
be heard by the Land Use & Development Commission and C:ity
Council again.
Mitch Greer, Shepherd Engineering was present to represented
L. Don Hammond~ Dale Hancock and Scott Jackson, Affordable
Residential Communities. Mr. Greet presented some changes on
the original plat.:
I. Gave up an entire roll of lots.
Z. Added along Alamo Street based on Council concerns,
accommodated the entire width of what would be a
future collee'tor street.
~. Proposing a fence along Alamo between this project and
the Briarwood Subdivision.
4. Park dedication of over four acres. Mr. Greet said the
park is visible from all homes.
5. They will maintain a landscape buffer between the
proposal and Hiline Rd., from Briarwood Subdivision
through the proposed subdivision.
6. Dedicated additional right-a-wa~ along Hiline Rd. to
allow for f~ture expansion.
?. Developer did agree the grass swell would be a good
way to dispose of run off. Based on Staff
recommendations, developer will install concrete
divider between the pavement, install grass swell and
sidewalk, no curb.
S. Mr. Greet stated the developer has strong Restrictive
Covenants.
Curtis Christie~ 526 Holly asked how many of the manufactured
homes will be new. Mr. Greer said they will all be the newer
style homes, pitched roof, etc~
Don Hammond, 28505 Bannock Highway, ~14 stated all the homes
will be very late mode] or new. Mr. Hammond said all lots are
large enough for double wide, but he is not sure how manywill
be double wide, it depends on what individuals purchase.
Mr. Hammond stated each of the individ~al units will be owned
by the tenant. Ali the lots will be rented~ but renting the
home will not be allowed by the Restrictive Covenanants. There
will be an on site manager at all times.
Bruce Daniels~ 472 Briarwood expressed concern about the look
of a trailer park in the area.

bir. Hammond stated there will be cinder blocks every five :feet,
under the manufactured home. There will not be a concrete
permanent foundation.
Concern about some of the residences being within 50' of a
railroad track.
John Van Houten, 412 Briarwood expressed concern about how
water and sewer system would handle the additional 2~7 homes,
without effecting pressure. Project Engineer Gerd Dixon said
the 2S7 new homes, woul~ have little effect on the City water
Clint Shipman, 521 Briarwood expressed concern about the
increased traffic on Whitaker and Hiline Rds.
Mr. Christie expressed concern about additional crime, police
and fire protection that will be needed in the area beca~se of
237 additional manufactured homes.
Beth Gilbreath, 473 Holly asked if Recreational Vehicles will
be allowed to park on the south and north park areas shown on
the plat. Mr. Hammond said t~ere will be no RV parking in the
park areas. The Restrictive Covenanants do not allow.
Mayor Cotant stated the Conditional Use Permit, Preliminary
Plat, change in zoning and annexation will have to be
republished and heard again by the Land Use & Development
Commission and City Council because of the owner of Briarwood
Lo~s not sold~ not receiving proper notice of the public
hearings.
Mayor' Cotant suggested Don Hammond get to the Lanct Use &
Development Commission and City Council a cop~ of the
Restrictive Covenants that will be enforced in the
subdivision.
Msyor Cotant suggested the developers talk to the City about
the following:
1. Impact on streets and traffic patterns.
2. Accommodating the existing and ftYture traffic
in and out of the subdivision.
3. Possible traffic light on Hiline Rd.

Mr. Greet stated a traffic light would not be .justified on
Hiline Rd.

CLAIMS - Computer print-out claims presented to Mayor Cotant and
Cou~cil.
Councilman Quick moved to approve computer print-out claima as
presented. Councilman England seconded. Ail council members
voted in favor of motion.
At 8:55 p.m., Councilman Quick moved, Councilman England seconded,
with full council approval to adjourn meeting.
